Academics 1 Proposed Amendment to the University Interscholastic League Constitution & Contest Rules A. Brief Explanation of Proposed Amendment This amendment to Section 1002(b)(1), Lincoln-Douglas Debate, would allow additional entries in Lincoln- Douglas Debate at the district level when fewer than eight debaters are entered in the district competition. B. Factual and Policy Justifications This would align the representation rule of Lincoln-Douglas Debate with Cross-Examination Debate, allowing additional entries in order to promote competition. In UIL districts with fewer than eight Cross-Examination Debate entries competing in the district meet, schools with a full entry may enter a fourth team. Proposed Amendment to the University Interscholastic League Constitution & Contest Rules

A. Brief Explanation of Proposed Amendment

This amendment to Section 1002(b)(1), Lincoln-Douglas Debate, would allow additional entries in Lincoln-Douglas Debate at the district level when fewer than eight debaters are entered in the district competition. B. Factual and Policy Justifications

This would align the representation rule of Lincoln-Douglas Debate with Cross-Examination Debate, allowing additional entries in order to promote competition. D. Potential Fiscal Impact of the Proposed Amendment to Member Schools

This proposed amendment should have no fiscal impact beyond what a district has already appropriated to

administer the meet.

E. Legislative Council Consideration Effective Date

The Standing Committee on Academics moves that the Legislative Council pass this amendment, to be effective August 1, 2020, if approved by the Commissioner of Education.

A. Brief Explanation of Proposed Amendment This amendment to Section 1107, State Marching Band Contest, would increase the number of judges from five to seven in conferences 5A and 6A and utilize updated adjudication criteria in all conferences. B. Factual and Policy Justifications Increasing the number of judges at the state marching band contest from five to seven in conferences 5A and 6A will give schools an improved direct comparison and ranking by more closely evaluating all performance elements of each band. In addition, utilizing adjudication criteria in all conferences that more accurately reflects current performance trends of scholastic marching bands helps ensure that the UIL system remains a leader nationally in the marching band activity. The UIL marching band adjudication structure was last updated in the early 2000’s. C. Proposed Amendment Section 1107(g) of the UIL Constitution and Contest Rules would be amended as follows, effective August 1. 2020, pending approval by the Commissioner of Education:

Section 1107: STATE MARCHING BAND CONTEST

(g) Adjudication. FOR CONFERENCES A, 2A, 3A, AND 4A the UIL Office shall assign five judges, consisting of three music judges and two visual judges. FOR CONFERENCES 5A AND 6A THE UIL OFFICE SHALL ASSIGN SEVEN JUDGES, CONSISTING OF FOUR MUSIC JUDGES, TWO VISUAL JUDGES, AND ONE CONTENT/DESIGN JUDGE.

Proposed University Interscholastic League Contest Pilot Program A. Brief Explanation of Proposed Pilot This proposal would create a pilot in select music regions utilizing amended rules for the sight-reading evaluation instruction period in Section 1111, Sight Reading Evaluation. The pilot would then be reviewed and considered by UIL staff and the Legislative Council for continuation and/or implementation into the Constitution and Contest Rules. B. Factual and Policy Justifications Utilizing a teacher-led instruction process that is less restrictive than the current process and places more responsibility on the students would more accurately reflect how a piece of music is actually taught, thus better accomplishing the intent of evaluating the music literacy of the students. Updating the instruction period would also ensure that the UIL system remains a leader nationally in music performance evaluation. The UIL sight-reading instruction period rules were last updated in the early 1990s. C. Proposed Amendment A pilot, utilizing amended rules for the sight-reading instruction period would be added in select music regions, effective August 1, 2020, pending approval of the Commissioner of Education. D. Potential Fiscal Impact of the Proposed Rule to Member Schools

A. Brief Explanation of Proposed Amendment This amendment to Section 1105, Region Marching Band Contest, would limit the number of wind instruments that can be amplified at one time to ten. B. Factual and Policy Justifications Limiting the number of wind instruments that can be amplified at one time to ten will help to maintain a more competitive balance and reinforce the UIL philosophy of rewarding music education above all other criteria. UIL already defines a small ensemble in Section 1108 as having a maximum of ten members; therefore, extending the same definition into Section 1105 would maintain consistency within the music rules. C. Proposed Amendment Section 1105(h)(5)(D) of the UIL Constitution and Contest Rules would be amended as follows, effective August 1. 2020, pending approval by the Commissioner of Education:

Section 1105: REGION MARCHING BAND CONTEST (h) PERFORMANCE REGULATIONS (5) Amplification: Amplification of instruments or voice may be used with the following restrictions:

(D) Wind Instruments may be amplified only for solo and/or small ensemble features OF UP TO TEN PERFORMERS AT ONE TIME.

A. Brief Explanation of Proposed Amendment This amendment to Section 1105, Region Marching Band Contest and Section 1106, Area Marching Band Contest, would change the area marching band contest from being held on alternating years to being held annually. B. Factual and Policy Justifications Holding the area marching band contest every year, while still holding the state contest in alternating years, would give schools an annual season culminating ranked UIL event. C. Proposed Amendment Sections 1105(j) and 1106(a) of the UIL Constitution and Contest Rules would be amended as follows, effective August 1, 2020, pending approval by the Commissioner of Education:

Section 1105: REGION MARCHING BAND CONTEST

(j) REGION CERTIFICATION TO AREA. (1) Advancement. Bands will advance to area according to the following schedule:

(A) Odd numbered years: Conferences 5A and 3A. (B) Even numbered years: Conferences 6A, 4A, and 2A.

(2) (1) Certification for Advancement. On eligible years Each music region shall certify at least two bands from each conference to the area marching band contest under the following provisions:

Section 1106: AREA MARCHING BAND CONTEST

(a) CONTEST SCHEDULE. The area marching band contest will be held FOR CONFERENCES 6A, 5A,

4A, 3A, AND 2A. on the following schedule: (1) Odd Numbered Years: Conferences 5A and 3A. (2) Even Numbered Years: Conferences 6A, 4A, and 2A.

Proposed Amendment to the University Interscholastic League Constitution and Contest Rules and Procedures

A. Brief Explanation of Proposed Amendment This amendment to Section 1105, Region Marching Band Contest, would require all bands certified to advance to the area contest receive a division 1 rating at the region contest. B. Factual and Policy Justifications The rule requiring that at least two bands be certified to advance from every region contest to the area contest dates back to when only two bands advanced. Current rule advances any band receiving a division 1 rating at the region contest to the area contest, thus creating much larger area contests than when the rule limited advancement to only two bands. This is the only UIL music rule that permits advancement beyond the first round of competition without receiving a division 1 rating. Amending this rule to require that a division 1 rating be received at the region contest to advance to the area contest would raise the standard for advancement, thus resulting in more competitive area contests, and create consistency among all music events for advancement beyond the region contest. C. Proposed Amendment Section 1105(j) of the UIL Constitution and Contest Rules would be amended as follows, effective August 1, 2020, pending approval by the Commissioner of Education:

Section 1105: REGION MARCHING BAND CONTEST

(k) REGION CERTIFICATION TO AREA. (2) Advancement. Bands will advance to area according to the following schedule:

(C) Odd numbered years: Conferences 5A and 3A. (D) Even numbered years: Conferences 6A, 4A, and 2A.

(3) Certification for Advancement. On eligible years each music region shall certify at least two bands from each conference to the area marching band contest under the following provisions: (A) A any varsity band that has followed the procedures established by the Region Executive

Committee to indicate to the Region Executive Secretary the intent to advance to area and that receives a Division 1 rating at the region contest shall be certified for advancement to the area contest.

(B) In the event only one band, or no bands, receive a Division 1 rating, two bands shall be selected by the judging panel for advancement to area. In such cases the scoring procedure will conform to the ranking system as outlined on the UIL website.

Brief Explanation of Proposed Amendment This proposal would create an advisory committee to provide input on all matters related to marching band rules, policies, and procedures. B. Factual and Policy Justifications With the constant evolution of competitive marching bands, UIL staff believes the creation of an advisory committee for marching band rules and procedures would help ensure UIL remains a leader nationally in providing the best possible experience for our member schools. C. Proposed Amendment A Marching Band Advisory Committee would be added, effective August 1, 2020, pending approval by the Commission of Education D. Proposed University Interscholastic League Contest Pilot Program A. Brief Explanation of Proposed Pilot This proposal would create a state marching band contest pilot for military-style marching bands. Military-style marching bands that receive an overall division 1 rating at the region contest would be certified to advance directly to the state contest, which would be held by conference on an alternating year format similar to the state open class contest. Eligible military-style bands would be required to choose between entering the state military band contest and the state open class contest. The pilot would then be reviewed and considered by UIL staff and the Legislative Council for continuation and/or implementation into the Constitution and Contest Rules. B. Factual and Policy Justifications Military-style marching bands are an important part of the heritage of Texas bands. With the evolution of performance trends of non-military-style marching bands the comparison of these two styles in a competitive setting has become increasingly more difficult. By creating this contest both styles would be provided with an opportunity to receive the most benefit from UIL competition by having an adjudication system that best fits their style. C. Proposed Amendment A state contest pilot for military-style marching bands would be added, effective August 1, 2020, pending approval by the Commissioner of Education. D. Potential Fiscal Impact of the Proposed Rule to Member Schools

Proposed University Interscholastic League Contest Pilot Program A. Brief Explanation of Proposed Pilot This proposal would create a state contest pilot for instrumental chamber ensembles consisting of three to ten students. Any small ensemble receiving a division 1 rating at the region solo and ensemble contest would be eligible to apply. This small, but select, one-day event would be intended to serve the most advanced instrumental student musicians. The criteria for selection of participant ensembles would be the evaluation of a performance recording submitted with the application. The pilot would then be reviewed and considered by UIL staff and the Legislative Council for continuation and/or implementation into the Constitution and Contest Rules. B. Factual and Policy Justifications Instrumental chamber music competitions are becoming an important part of the culture of the most advanced student musicians in our schools. Creating this pilot contest would provide a UIL event for these students to compete for state level honors. C. Proposed Amendment A state contest pilot for instrumental chamber ensembles would be added, effective August 1, 2020, pending approval of the Commissioner of Education. D. Potential Fiscal Impact of the Proposed Rule to Member Schools

Advancing schools would incur related expenses. E. Legislative Council Consideration; Effective Date

Proposed Amendment to the University Interscholastic League Constitution and Contest Rules

A. Brief Explanation of Proposed Amendment

This amendment to Section 1205(a), Individual Report Forms, would add language to the UIL Constitution and Contest Rules in order to comply with state law. B. Factual and Policy Justifications

Section 33.096 of the Texas Education Code (TEC) was added with the passage of House Bill 76 in the 2019 Legislative session. This legislation required UIL to develop rules for the implementation of the ECG notification process for students required by UIL rules to undergo a physical examination, and for the process for school districts to request an exemption from the notification requirement. C. Proposed Amendment Section 1205(a) of the UIL Constitution and Contest Rules would be amended as follows, effective immediately, pending approval by the Commissioner of Education:

Section 1205: ATHLETIC ELIGIBILITY

(a) INDIVIDUAL REPORT FORMS. It shall be the responsibility of each school to keep on file the following required annual forms for each student who participates in any practice, scrimmage or game.

(8) COMPLETION OF FORMS AS OUTLINED IN 1, 2 AND 7 ABOVE SATISFIES THE

REQUIREMENTS CONTAINED IN SECTION 33.096 OF THE TEXAS EDUCATION CODE (TEC). (A) THE UIL MEDICAL ADVISORY COMMITTEE (MAC) HAS REVIEWED AND

UPDATED THE REQUIRED FORMS LISTED TO ENSURE COMPLIANCE WITH TEC 33.096.

(B) IF THERE IS A REASON WHY A SCHOOL CANNOT COMPLY WITH THE ABOVE REQUIREMENTS, THAT SCHOOL’S ADMINISTRATION SHOULD SUBMIT A REQUEST FOR EXEMPTION FROM TEC 33.096 TO THE UIL EXECUTIVE DIRECTOR OR THEIR DESIGNEE.

(C) AN ELECTROCARDIOGRAM (ECG) IS NOT REQUIRED. SHOULD A PARENT/GUARDIAN CHOOSE THE OPTION OF AN ECG FOR HIS OR HER CHILD, THE PARENT/GUARDIAN IS RESPONSIBLE FOR HAVING THE ECG ADMINISTERED AND READ IN COMPLIANCE WITH THE LAW. A SCHOOL DISTRICT MAY PROVIDE AN OPPORTUNITY FOR THIS THROUGH AN ECG PROGRAM AND MAY FUND THE PROGRAM. A SCHOOL IS NOT REQUIRED TO PROVIDE SUCH A PROGRAM.

Proposed Amendment to the

University Interscholastic League Constitution and Contest Rules

A. Brief Explanation of Proposed Amendment

Section 1208(h)(1), UIL Coaches Certification Program, currently requires coaches to complete the UIL Coaches Certification Program (CCP) prior to the start of their season. This amendment would require that coaches complete CCP prior to the first day of school if their sport is not in season. B. Factual and Policy Justifications Currently, coaches are required to complete the UIL Coaches Certification Program prior to their season. The amendment would extend the requirement beyond the start of their season and include the requirement of all coaches completing CCP prior to the first day of school. This will ensure that the CCP requirement is satisfied by all coaches prior to coaching athletes both in-season and in off-season athletic periods. C. Proposed Amendment

Section 1208(h)(1) of the UIL Constitution and Contest Rules would be amended as follows, effective August 1, 2020, pending approval by the Commissioner of Education:

Section 1208: ATHLETIC REGULATIONS

(h) UIL COACHES CERTIFICATION PROGRAM. (1) All coaches shall annually complete the UIL Coaches Certification Program prescribed by the UIL prior to

their sport season OR PRIOR TO THE FIRST DAY OF SCHOOL IF THEIR SPORT IS NOT IN SEASON. A COACH WHO IS HIRED LESS THAN ONE WEEK PRIOR TO THE START OF THE SPORT SEASON OR AFTER THE FIRST DAY OF SCHOOL (WHICHEVER IS EARLIER) MUST COMPLETE THE CCP WITHIN THIRTY (30) DAYS OF BEING HIRED.

This amendment would require teams to trade all game videos leading up to their scheduled playoff game. C. Proposed Recommendation Section 1250(o) of the UIL Constitution and Contest Rules would be amended as follows, effective August 1, 2020, pending approval by the Commissioner of Education:

(o) Playoff teams are required to exchange two game videos ALL VIDEOS LEADING UP TO THE PLAYOFF GAME TO INCLUDE REGULAR SEASON AND POST-SEASON GAMES. University Interscholastic League Contest Procedures

A. Brief Explanation of Proposed Recommendation

This amendment would alter the language in the UIL Track & Field Manual concerning Area Meets. The new language would require the Area Meet to be held, with an exception possible for corresponding districts with schools located over 150 miles apart.

B. Factual and Policy Justifications

The area meet allows for the top four qualifiers to advance from district to area, thus giving more student-athletes the opportunity for a post season event. In the event no area meet is held, only the top two qualifiers in each event at a district meet would qualify from district to regionals.

C. Proposed Recommendation

The Track & Field Coaches Manual would be amended as follows, effective August 1, 2020, pending approval by the Commissioner of Education: Area Meets Area sites will be facilitated by mutual agreement between the two designated districts. Schools should contact the DEC chair for district information.

• With approval of the majority of schools in that area (corresponding districts), the area meet can be cancelled. In this scenario, each district would hold their district meet and advance the top two finishers in each event to the regional meet.

• With approval of the majority of schools in that area (corresponding districts), district meets can be skipped and the corresponding districts could elect to go straight to the Area Meet (with no district meet). In this scenario, the top four finishers in each event would advance to the Regional Meet

• UNLESS MUTUALLY AGREED OTHERWISE (CORRESPONDING DISTRICTS GETTING ONE VOTE EACH), DISTRICTS LOCATED MORE THAN 150 MILES APART MAY CONDUCT A VOTE BETWEEN ALL SCHOOLS INVOLVED TO CANCEL THE AREA MEET. • DISTANCE SHALL BE CALCULATED BY USING THE FURTHEST SCHOOL IN EACH

CORESPONDING DISTRICT.

Proposed Amendment to the University Interscholastic League Constitution and Contest Rules

A. Brief Explanation of Proposed Amendment This amendment to Section 442, Residence in School District and Attendance Zone, would make the rule pertaining to separated parents consistent with guardianship rules. B. Factual and Policy Justifications Currently, a student may establish residency with a guardian after one year if the guardian was appointed by appropriate authority and filed in the county clerk’s office. If no legal guardianship has been taken out, three years’ residence with and support of a contestant may establish guardianship. However, there is no time frame for a student to establish residency with a separated parent. This amendment would make the separated parents rule consistent with the guardianship rule. C. Proposed Amendment

Section 442(g) of the UIL Constitution and Contest Rules would be amended as follows, pending approval by the Commissioner of Education:

Section 442: RESIDENCE IN SCHOOL DISTRICT AND ATTENDANCE ZONE (g) SEPARATED PARENTS.

(1) If a student’s parents separate (and are not divorced), and if one parent remains in the attendance zone where the student has been attending school, the student’s residence is presumed to be that of the parent who did not move.

(2) If a student transfers to a new school with a separated (but not divorced) parent, the student is ineligible for one calendar year, but may apply for a waiver.

(3) PARENTS WHO HAVE BEEN SEPARATED FOR AT LEAST THE PREVIOUS THREE CONSECUTIVE

YEARS WOULD BE CONSIDERED AS ‘DIVORCED’ FOR PURPOSES OF THIS RULE. D. Potential Fiscal Impact of the Proposed Rule to Member Schools This proposed amendment should have no fiscal impact on member schools. E. Legislative Council Consideration; Effective Date

Proposed University Interscholastic League Contest Pilot Program A. Brief Explanation of Proposed Pilot This proposal would authorize development of water polo as a pilot program for the 2021-2022 school year. B. Factual and Policy Justifications

This pilot proposal gives UIL staff authority to develop the rules and guidelines for the competition and to evaluate water polo as a pilot event. Sections 1205 (a)(2), (6), and (7) of the UIL Constitution and Contest Rules (all student safety related) will apply to students participating in this pilot. A student who meets the requirements of Section 400 of the UIL Constitution and Contest Rules is eligible to participate in this pilot contest. The pilot will consist of a state championship event by conference with district, regional, or other qualifying events.

C. Proposed Amendment Water Polo would be added as a pilot program pending approval by the Commission of Education. D. Potential Fiscal Impact of the Proposed Rule to Member Schools School districts would choose whether to participate. For those that participate, there would be costs for equipment, as well as travel to a qualifying event and to the state event for teams that qualify. E. Legislative Council Consideration; Effective Date

This pilot proposal gives UIL staff authority to collaborate with Special Olympics Texas to develop the rules and guidelines for the competition and to evaluate Unified Activities as a pilot event. Sections 1205 (a)(2), (6), and (7) of the UIL Constitution and Contest Rules (all student safety related) will apply to students participating in this pilot. A student who meets the requirements of Section 400 of the UIL Constitution and Contest Rules is eligible to participate in this pilot contest.
