A Refresher
One of the challenges I face on injury cases is managing client expectations. Meaning, keeping the client grounded and focused on his/her case, rather than spending money they haven’t won yet.
Sometimes it’s hard for clients to understand, but every good personal injury case MUST HAVE the following components: 1. Liability- did the other guy cause the accident/incident and is the client blameless? 2. Damages- has the client been hurt badly enough under the law to sue, and 3. Insurance Coverage/Assets- is there money available from the defendants to pay the client? Like it or not, even a horrible injury or death from an accident, without good insurance coverage or an excellent chance of recovery from the defendant, makes for a bad case that most injury attorneys will not be interested. And as unfair as it is, a defendant can escape paying you what he/she owes you by filing for bankruptcy!
If a client’s case is missing any one of three parts above (or has a weakness in any part), the case is probably not worth what the client hopes to get out of it. If all three parts are present and strong, the case may be worth several million dollars.
