This message and devotion to )esus as The Divine Mercy is "ased on the writings of *aint +austina owals'a, an unedu&cated -olish nun who, in o"edience to her spiritual director, wrote a diary of a"out // pages recording the revelationsshe received a"out God0s mercy. 1ven "efore her death in 2345, the devotion to The Divine Mercy had "egun tospread.

CANONICAL- LITURGICAL FORUMBY FR. GEM BANDIVAS, JCL, MBA, PhD

Dear Father Gem: When I was a kid, everyone wasrequired during Lent to make his “Easter Duty.” Every

arishioner re!eived a !ard "rom the arish. When wewent to !on"ession #e"ore Easter, we handed the !ardto the riest. $y Easter he had a huge sta!k o" !ards, showing whi!h arishioners had made their Easter Dutyand who hadn%t. $ut nowadays, eo &e hard&y ever goto !on"ession &ike they used to, and no#ody ever ta&ksa#out Easter Duty. 'as this requirement #een a#o&ished&ike so many other things(

    ) *nge&ina, +on!erned +atho&i!

Dear Angel na! You must have heard me say this ahundred times, but I say it again anyway, canon law isgrounded in theology. The most fundamental theological

teaching about the sacrament of penance — that receptionof the sacrament is necessary when we are conscious ofhaving committed grave sin (c. 988. ! — will never change, because as "atholics we believe that this sacrament wasinstituted for this very purpose by "hrist #imself. $hat canchange over time, however, are the disciplinary practices(what one might call %house&eeping details'! pertaining tothis sacrament, li&e the one you described earlier. et)s ta&ea loo& at what the current law says about confessing one)ssins at *aster time, and compare it to church law in the past.

+ost merican "atholics are at home with thetraditional notion that while we should go to confessionthroughout the year, it is particularly necessary during

dvent (leading to "hristmas! and ent (leading to *astertime!. The truth of the matter, however, is that there is nolegal re-uirement to receive the sacrament at theseparticular times. "anon 989 states merely that everyonewho has reached the age of discretion is re-uired to confesshis grave sins at least once a year. n the surface, it)s avery simple, straightforward canon, but let)s unpac& it to besure we understand e/actly what is re-uired of us.

The mention of the %age of discretion' refers to thefact that children who are too young to have made their 0irst"onfession are of course e/empt from this obligation. Theimplication, therefore, is that once a child has reached theage of reason and has received the sacrament of penancefor the first time, this annual re-uirement applies.

The canon notes specifically that a "atholic isre-uired to confess his grave (i.e., mortal! sins. Thus if he isnot conscious of having committed any such sins, there isno re-uirement to receive the sacrament. The precedingcanon does note that it is recommended that the faithful alsoconfess their venial sins (c. 988.1!2 but a recommendation is

not an obligation.bviously canon 989 does not contain any particularlystringent re-uirements, and to many "atholics may actuallyseem -uite la/3 $as the law more demanding in the past45ot at all. ur current canon 989 of the 986 "ode of"anon aw is virtually identical to canon 97 of the 9"ode of "anon aw. That canon, in turn, was based on thediscipline decreed by the "hurch during the "ouncil of Trent( :;:< : 6!, formulated in response to protestant claimsthat sacramental confession of one)s sins to a priest was notof divine origin and was unnecessary. $e can see that withregard to a "atholic)s obligation to confess his sins annually, nothing whatsoever has been changed for nearly :77 years3

    I" # $%&r"an" "& 'ee% n $ n( here "ha" "he )&(e# $an(a" ng "he a*#&l+"e $ n $+$ "ha" # a))e%"a*le&r a %ra)" ) ng Ca"h&l ). If one adheres to the minimum

    re-uirements, he is not violating the law — *+" "ha" (&e#n&" ne)e##ar l $ean "ha" (& ng &nl "he *are $ n $+$

    # a g&&( (ea. 5or is it a good idea to fall into the trap ofthin&ing that it is not worthwhile to confess sins that are%=ust' venial.

    >ope ?ohn >aul II, in his 98; postolic */hortationReconciliation and Penance , noted that venial sin %mustnever be underestimated, as though it were automaticallysomething that can be ignored or regarded as @a sin of littleimportance)' ( !. It is well &nown that the late pontiff himselfconfessed his sins every single day — and one mightreasonably assume that they were venial, rather than mortalsins3

$hat is most important for all of us is to appreciatethe spiritual intent behind the %*aster duty'. 0irst, the

precepts of the church are li&e the minimum standards for agood spiritual life. They see& to integrate the sacramentaland moral teachings, and provide a basic paradigm to help aperson grow in love of Aod and neighbor.

Becond, the *aster duty see&s to prevent a personfrom slipping either into scrupulosity, whereby he thin&s heis a total wretch and unworthy to receive ur ord in theholy *ucharist2 or into la/ity, whereby he thin&s he has nosin, has hit the plateau of holiness, and thereby has no needfor confession.

Too many people either do not &now the differencebetween right and wrong, relegating the Ten"ommandments to the Ten Buggestions. Too many peoplehave lost a consciousness of sin, particularly serious mortalsin. lso, too many people neither understand norappreciate the efficacy of the sacrament of penance.

dmittedly, part of the problem is that too many priests haveneglected to preach about the importance of the sacrament. In sum, there is little wonder why so many people receive#oly "ommunion yet a fraction avail themselves to thesacrament of penance.

?ust li&e an annual physical e/am with one)s physicianis a good, healthy practice, at least an annual (preferablymonthly! e/amination of conscience is a good, healthyspiritual practice. f course, this should not =ust be a cursorye/amination of conscience, but with the help of a guide(even an %app'! a thorough and sincere e/amination, whichthen leads to a good confession and sacramentalabsolution. $ith the soul renewed in grace, one can then bestrengthened through the #oly *ucharist.

0inally, this precept is the minimum standard. *venthough a person may not be in a state of mortal sin, regularconfession of venial sin helps the individual to form his

conscience better, fight against temptation, be aware of theoccasions of sin, and progress in the life of the #oly Bpirit(catechism, 5o. ;:8!. Cetired >ope Denedict taught, %In our"hristian life, we must always aspire to conversion and thatwhen we receive the sacrament of penance fre-uently thedesire for Aospel perfection is &ept alive in believers.'

To answer your -uestion, therefore, the lawconcerning mandatory reception of the sacrament ofpenance has certainly not changed in our lifetimes. Dut thedisciplinary practice at your childhood parish — which in anycase was never a universal custom — is not in forcethroughout the "atholic "hurch today. The methods that the"hurch may use to urge or encourage "atholics to fre-uentthe confessional can vary2 but the need for us all to receivethis sacrament regularly will always remain unchanged.
