ACTION ITEMS

Performance Related Pay for Teachers Teachers’ pay in maintained schools and some academies is governed by the School Teachers’ Pay and Conditions Document (STP&CD), which is a statutory document produced annually. Over the past decade or so there has been a move towards the introduction of Performance Related Pay (PRP). Currently teachers are appointed on a main pay scale of six spinal column points and normally progress up the scale every September. There is the opportunity to move to an upper pay scale (three further points) once time has been served on the main scale, and following acceptable performance management reviews. Headteachers and deputies are appointed on to a leadership scale and for many years their progression has been subject to a review of objectives which have previously been set by the governing body. Progression is not automatic, but can be up to two points at a time. September 2013 will be the last time that annual pay increments are awarded to teachers based on their length of service. In the future all decisions about teachers’ pay progression will be linked to performance, with their first annual PRP increases being made in September 2014. The revised arrangements are intended to provide greater flexibility for schools to develop pay policies that are tailored to their particular needs. So each school will have its own unique pay policy. It is believed that it will enable schools to recognise and reward a teacher’s performance through an increase in pay and can act as an incentive for continuous improvement. What Schools will need to do Schools will need to review their pay policies to set out how appraisal outcomes are linked to pay decisions, particularly as the new document allows schools to increase one teacher’s pay at a faster rate then another’s. The policy should also address how pay will be determined when teachers are absent for any reason, for example on maternity or long-term sick leave. The council’s model appraisal procedure currently includes descriptors which were intended to be used to determine pay progression where it was appropriate. What the LA will do The LA will review its model Pay and Appraisal policies for schools to ensure that they are fit for purpose, although schools will have to exercise their discretion and tailor any policy to their own needs. At time of writing the LA model policy is being consulted on with the Trade Unions and HR are awaiting clarification from the DfE on several points regarding pay ranges

etc. It is anticipated that the model policies will be available to schools subscribing to Bristol TwS HR Services by the end of Term 6. Keeping Children Safe in Education; Consultation The purpose of this consultation is to gather views on the Government’s proposals to reform safeguarding requirements and guidance in schools and further education colleges by: - issuing new safeguarding guidance to schools and further education colleges to replace the current Safeguarding Children and Safer Recruitment in Education and - removing the regulation which makes it a requirement for at least one member of a recruitment panel in a school to have undertaken training in safer recruitment approved by the Secretary of State. Attn: All Governors, Clerk/Head 5. DfE Governor Handbook replaces Guide to the Law The Department for Education (DfE) has released their new Governor Handbook. The Handbook is the successor to the Governors' Guide to the Law, which will not be updated. The Governors’ Handbook provides information about the role and legal duties of governing bodies in maintained schools and academies (including free schools). Section 1 of the Handbook outlines the core role and functions of school governing bodies. All governors should read this section. Sections 2 to 8 of the Handbook summarise all of the specific legal duties on governing bodies, providing a first point of reference for those with a specific area of interest. Further reading is signposted from within each section for those who would like more detailed information. Links are provided to relevant regulations, guidance and resources. The National Governors’ Association was particularly pleased to see the DfE confirm in the Handbook that: “While it may be helpful to see classes at work, governors are not inspectors and it is not their role to assess the quality or method of teaching. They are not school managers and should make sure they do not interfere in the day-to-day running of the school. Both are the role of the headteacher”.

The Handbook confirms that the government is encouraging governors to “focus on three core strategic functions:
• Setting vision, ethos and strategic direction; • Holding headteachers to account for the educational performance of the school
and its pupils; and • Overseeing the financial performance of the school and making sure its money
is well spent.”

Attn: Nursery School Chair /Head/Clerk 6. Governor’s Annual Report to Parents (maintained nursery schools) The following message has been posted on the DfE Website; ‘ Governor’s annual report to parents (maintained nursery schools) - It has come to light that the removal of the requirement for maintained schools to prepare a Governors’ Annual Report to Parents in The Education Act 2005, and Commencement Order No 1 to that Act, has resulted in an anomaly in the legislation. We can confirm that governing bodies of maintained nursery schools are no longer required to prepare a report’ Contact: Governor Development Service, 0117 903 1396: [email protected]

Disclosure and Barring Scheme; Update Some old and minor offences removed from criminal record certificate Following a change in legislation, the DBS will be removing certain specified old and minor offences from criminal record certificates issued from 29 May 2013. The filtering rules, together with the list of offences that will never be filtered, are available from www.gov.uk/dbs. To ensure the law is followed correctly, schools are asked to bring the following change to the applicants attention when completing the form: Question e55 asks the applicant: 'have you ever been convicted of a criminal offence or received a caution, reprimand or warning?' Applicants should now ignore this question and instead treat this question as if they were being asked: 'do you have any unspent convictions, cautions, reprimands or warnings?'

Updated DBS application forms will be provided in due course. New Update Service Available From 17 June 2013, anyone who applies for their next criminal record check can choose to subscribe to the Update Service for £13 per year (this is in addition to the usual cost of the check itself). This will allow them to keep their criminal record certificate up to date, so that they can take it with them from role to role, within the same workforce. Employers benefit because, provided an individual has subscribed to the Update Service, they can carry out free, instant online checks of an individual's certificate (with their consent), to check that it is up to date. When someone is subscribing to this service, you would only have to seek a new criminal record check if the system tells you something has changed. For this reason, it is recommended that schools encourage anyone who will benefit to join Update Service when they next apply for their criminal record check. New description of ‘Position Applied For’ From 17 June 2013 the Police will now use a broader definition of 'workforce' to assess the relevance of any information that they may consider for release, in place of the specific 'position applied for'. This means that the phrase ‘Child Workforce' should be entered on the form for any position that involves working/volunteering with children rather than the specific job role. DBS Certificates no longer sent to Employers Another important change to the DBS process is that a copy of the applicant's DBS certificate will no longer be sent to the Registered Body (Bristol City Council’s DBS Team in the case of School staff). It will only be sent to the applicant. For new checks after 17 June School’s will need to ask the applicant to show them their DBS certificate. This change in process is part of the Government's aim to put the individual in greater control of their own data. Individuals will now be able to challenge the information the DBS release, before it is seen by their current or prospective employer. Checks for Governors At the time of writing, we are awaiting confirmation of how these changes to the Disclosure and Barring Scheme introduced in May and June 2013 will affect checks required for governors. Keep a look out in the school’s online bulletin and the Bristol Governor’s Bulletin for further information. In the meantime, please continue with the usual process. More information about the new Update Service and these other changes is now available from the DBS website www.gov.uk/dbs. The Bristol DBS Team pages on The Source (Bristol City Council intranet) provide detailed information about the changes, in particular the new process for ensuring

Attn: Clerk/ Chair 8. Proposed Changes to Governing Body procedures
Draft regulations are currently progressing through parliament to make a number of changes to governing body procedures for maintained schools. The changes are intended to simplify procedures and give maintained schools some of the increased flexibility already available to academies. It is anticipated that the main changes will be as follows:
• The governing body will be able to agree to the use of telephone or video conferencing to enable governors to participate and vote in meetings.
• Regulations will no longer set out a minimum or maximum term of office for the chair and vice-chair.
• The proceedings of a governing body will no longer be invalidated by any person not having received written notice of the meeting or a copy of the agenda.
• A number of restrictions on a governing body delegating its functions will be removed.
• There are changes around how expenses are to be paid to governors and associate members
The draft regulations define, in reduced form, the roles of the governing body and headteacher as follows;
• The governing body must exercise its functions with a view to fulfilling a largely strategic role in the running of the school
• The governing body must have regard to advice from the clerk to the governing body in regards to the exercise of the governing body’s functions
• The headteacher is responsible for the internal organisation, management and control of the school
