INTRODUCTION: The Board of Trustees (BOT) is asked to consider an amendment to certain sections of the Mahomet Village Code dealing with the Code Review and Appeals Board. The proposed amendment would change the Cornbelt Fire Chief from an ex-officio non-voting member to a regular voting member appointed by reference to title.

BACKGROUND: November 2017 the BOT provided staff direction to proceed towards establishment of a building code review and appeals board. The Code Review and Appeals Board was established by the BOT February 27, 2018 Ord. 18-02-04

PRIOR BOARD ACTION: Ord.18-02-04 – An ordinance creating a Code Review and Appeals Board.

COMMUNITY INPUT: NONE

BUDGET IMPACT: NONE

STAFF IMPACT: NONE

SUMMARY: The Board is asked to amend the appointment composition of the CRA Board. The attached ordinance amendment makes a minor adjustment moving the Cornbelt Fire Chief or designee from a non-voting member of the CRA Board to a voting member. The existing ordinance establishing the CRA Board was modeled from a similar board established by the City of Champaign. The Champaign Fire Chief has a direct role in Building Code enforcement and therefore cannot be a voting member. The Cornbelt Fire Chief has an advisory role related to building code enforcement within the Village. Therefore, Staff recommends the ordinance amendment to change the voting composition of the CRA Board.

RECOMMENDED ACTION: Staff recommends approving the attached ordinance to amend the CRA Board.

ORDINANCE NO. 18-02-04

AN ORDINANCE CREATING A CODE REVIEW AND APPEALS BOARD

Adopted by the

President and Board of Trustees

Of

The Village of Mahomet

Champaign County, Illinois

WHEREAS, state law allows municipalities to adopt building codes consistent with state law and

community input;

WHEREAS, the Village of Mahomet, Illinois, desires to seek community input on the issue of building

codes and the input of professionals in the subject matter;

WHEREAS, The President and the Board of Trustees of the Village of Mahomet, Champaign County,

Illinois have determined that it is necessary to adopt an ordinance to create a Code Review and Appeals Board;

and

NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Mahomet,

Champaign County, Illinois, as follows :

Section 1. There is added to Chapter 153 of the Mahomet Village Code, entitled "Minimum Housing

Standards" , sections 153.04 through 153.09, inclusive, as supplemented and amended, to read as follows:

Section 153.04 - Created.

(a) There is hereby created a Code Review and Appeals Board.

Section 153.05 - Composition, appointment.

(a) The Code Review and Appeals Board shall have seven (7) members and two (2) nonvoting ex officio

members. The members of the Committee shall be appointed by the Mayor with the consent of the

Trustees.

(b) The Village Adm inistrator of the Village and the Fire Chief of the Corn belt Fire Protection District or their

respective designee shall be the two (2) nonvoting ex officio members.

(c) Although not mandatory, the composition of the Code Review and Appeals Board shall strive to include

persons with the following expertise by experience, training or education: architect, structural engineer,

electrician, mechan ical technician, residential homebu ilder, commercial builder/developer. At least one

member shall be a Village resident. A member shall not vote or otherwise rule on any appeal in which

the member is engaged as a contractor or material dealer, or in the preparation of plans or

specifications, or in which the member has any personal interest.

Section 153.06 - Terms and qualifications.

a) The terms of the seven (7) regular members of the Code Review and Appeals Board shall expire as

follows : Nos. 1, and 2 in Section 153.05 in 2019: Nos. 3, 4 and 5 in 2020; and Nos. 6, 7 in 2021.

Thereafter all appointments shall be for terms of three (3) years. All terms shall expire on May 30th

in their final year.

Section 153.07 - Chair and Vice Chair.

a) The Code Review and Appeals Board shall elect from its members a Chair and Vice Chair. The Vice

Chair shall perform the duties of the Chair when the Chair is absent or otherwise unable to perform

those duties. The term of the position of Chair and Vice Chair shall be limited to three (3) years and

no Chair or Vice Chair shall serve consecutive terms.

Section 153.08 - Rules and by-laws.

a) The Code Review and Appeals Board may adopt additional rules and by-laws consistent with other

provisions of th is Code.

Section 153.09 - Duties.

a) The Code Review and Appeals Board shall:

(1) Carry on a continuing review of and shall advise the Board of Trustees regarding all

construction and maintenance codes adopted and enforced by the Village.

(2) Hear appeals by persons or entities directly or materially affected by a code violation or

decisions involving codes as it applies to construction or maintenance activities to which an

adopted code is in place.

(3) Perform such other duties as may from time to time be assigned by the Board of Trustees.

Section 2. Invalidity. Should any section or provision of this Ordinance be declared to be invalid, that

decision shall not affect the validity of this Ordinance as a whole or any part thereof, other than the part so

declared to be invalid .

Section 3. Effective Date. The prov1s1ons of this Ordinance shall become effective immediately

following its passage, approval and publication as required by law.

Section 4. Conflict. All other ordinances or parts of ordinances which are in conflict with the provisions

of this Ordinance are, to the extent of such conflict, hereby superseded.

Section 5. Publication. The Village Clerk is hereby authorized and directed to cause this Ordinance to

be published in pamphlet form immediately after passage.

A RESOLUTION APPOINTING MEMBERS

TO THE VILLAGE OF MAHOMET CODE REVIEW AND APPEALS BOARD

WHEREAS, Village President, Sean Widener hereby affirms the following individual to the Village of Mahomet Code Review and Appeals Board: APPOINTEE TERM EXPIRATION John Koller May 31, 2022 NOW THEREFORE BE IT RESOLVED BY THE VILLAGE BOARD OF TRUSTEES OF THE VILLAGE OF MAHOMET, ILLINOIS, that:

Section 1. That this Resolution is passed and approved pursuant to legislation establishing the Village of Mahomet, Code Review and Appeals Board, said legislation detailing the membership thereof and stating the duration of the term of office for the previously appointees designated herein.

Section 2: That the affirmation of the previous appointments presented by the Village President to the Board hereinabove in the preamble is incorporated by reference as set out herein. INTRODUCTION: Staff is seeking authorization from the Board of Trustees to declare one 2006 Ford Expedition as surplus equipment. This is a vehicle that was purchased from the Police Department by the Community Development Department.

BACKGROUND: This vehicle was an internally purchased vehicle in late 2015 from the Police Department. They were purchasing a new Police vehicle and we needed an enclosed vehicle for building and subdivision inspection purposes.

The vehicle we wish to declare surplus has been in service since 2006 and is now worth less than what it will take to repair. See attached Kelly Blue Book value sheet and the Estimate to repair from Bulldog automotive.

At this time, staff intends to sell the vehicle as partial payment for a new truck.

DISCUSSION OF ALTERNATIVES: The alternatives are to approve the vehicle as surplus or keep repairing at a cost greater than the value.

AUTHORIZING ITS DISPOSAL

VILLAGE OF MAHOMET, CHAMPAIGN COUNTY, ILLINOIS

WHEREAS, Paragraph 11-76-4 of the Illinois Municipal Code (65 ILCS 5/11-76-4) controls the disposition of surplus Village of Mahomet personal property; and,

WHEREAS, The Village will purchase a new vehicle to be used by the Community

Development Department through a State of Illinois Bid program. NOW, THEREFORE, BE IT RESOLVED this 26th day of June 2018 by the Board of Trustees of the Village of Mahomet that: 1. That the 2006 Ford Expedition is declared surplus Village personal property is no

longer useful to, or for the best interests of the Village.

2. That the Village Administrator is hereby authorized to dispose of said personal property referred to in Section (1) in such a manner as deemed to be in the best interest of the Village.

I believe it is mostly the variable timing and timing chain we had an estimate to repair thatwas about the same value of expedition. The rear wiper motor relay stuck open causing adrain on the battery so we pulled the fuse to disable it.

INTRODUCTION: The Community Development Department is seeking to purchase a 2018 Ford F150 through State of Illinois Bid under the vehicle replacement policy.

BACKGROUND: The Community Development Department has in the Fiscal Year 2018/2019 budgeted money to purchase a new vehicle for Community Development office use. The last vehicle was a former surplus police vehicle already past our vehicle replacement policy, but served the village well during the time of Community Development use. However, concerns about reliability and other issues, we feel it is time to replace the vehicle with a new one.

We budgeted $29,000 to purchase a new vehicle and estimated a trade-in or auction value of for our 2006 Ford Expedition of around $650.00. So, we expect overall not to exceed $28,100 (see attached quote) after dispose of our current 2006 Ford and applying those funds to the purchase. The additional $1900.00 budgeted for upfitting the truck with needed equipment to store tools and plans to more efficiently perform the duties of departmental staff.

Ordering through the State Bid saves of time and the price is very competitive and we can get a higher resale value vehicle in the process.

DISCUSSION OF ALTERNATIVES: Alternative 1: Purchase the vehicle through the State of Illinois Bid program. Alternative 2: Solicit and open bid process for a similar vehicle.

STAFF IMPACT: Staff will order the vehicle through the State of Illinois Bid contract which is easier than advertising and soliciting bids. Staff will also determine best option for disposing of the 2006 Ford Expedition.

INTRODUCTION: Staff requests consideration of an annexation policy that has been developed at the request of the board. BACKGROUND: The Village’s policy on annexation is essentially that it follows the State law and that annexation decisions rest solely with the board of trustees. However, State law enables annexation under certain conditions but does not prescribe or guide when a municipality should annex. The 2016 Comprehensive Plan specifically identifies a need for an annexation policy to enable functionality of the Plan and the fulfillment of its broader goals. The Plan cites the disparity between the actual and effective Village population. It notes that lands meeting the letter of law for continguity are in fact highly variable in the functional contiguity for service extensions. The presence of a river, a railroad, an interstate, a non-Village water and sanitary sewer district, and IDOT roadways often significantly impede efficient service extensions. Contiguous properties have very different costs and benefits requiring more analysis than any State law can provide. It is highly probable that it is not always in the village’s best interest to annex property. The proposed annexation policy acknowledges that thoughtful analysis ensue for any lands that do meet the state law criteria for annexation. It reiterates the eligibility concepts in State law with added details on how those apply to Mahomet. It establishes some evaluation criteria as a guide. One component of the policy is there are several factors for consideration by the board to help provide clarity and transparency to the complex decision making of individual annexations. These are NOT required but available to the Board for consideration. The simple inclusion of the statements in the policy suggests and reiterates the complexity of annexation decisions. A RESOLUTION ADOPTING AN ANNEXATION POLICY FOR THE VILLAGE OF MAHOMET, ILLINOIS

WHEREAS, the Illinois Municipal Code (65 ILCS 5/7-1 et seq.) clearly delineates the requirements and process for voluntary and involuntary annexations of land into the corporate boundaries of a municipality; and

WHEREAS, pursuant to this Public Act, the Illinois Legislature has entrusted to the

corporate authorities of municipalities the absolute right to determine the boundaries of their communities and the rate at which development will take place, consistent with the Illinois Municipal Code; and

WHEREAS, all prior existing annexation policies of the Village of Mahomet shall be superseded by the Annexation Policy adopted by this Resolution; and,

WHEREAS, this annexation policy document does not supplant, supplement or add additional legal requirements or factors to the Illinois Municipal Code regarding annexations and the ultimate authority given to the Corporate Authorities (i.e. Village President and Board of Trustees) pursuant to the Illinois Municipal Code.

NOW, THEREFORE, BE IT RESOLVED this 26th day of June 2018, by the Board of Trustees of the Village of Mahomet that:

1. The Village of Mahomet Board of Trustees does hereby adopt the Annexation Policy.

ANNEXATION POLICY

PURPOSE

The community of Mahomet is much larger than the Village Corporate Limits. This disparity is indicative of the challenges of annexation in decades past. There is a need for an annexation policy to help promote smart logical growth and enable functionality of the Comprehensive Plan and fulfillment of its broader goals.

Illinois statutes and case law control annexations of land into the corporate limits of a municipality. This annexation policy document does not supplant, supplement or add additional legal requirements or factors to Illinois statutes regarding annexations. Annexation decisions require guidance and support of a policy that can transcend politics, immediate pressures, temporary fiscal constraints, and current market conditions. But given each parcel of real estate is unique, no one policy factor shall dictate a decision to annex or not annex a particular parcel.

Therefore, it shall be the policy of the Village of Mahomet to review and consider annexations individually according to Illinois statutes, the terms and conditions of this policy and the uniqueness of each parcel of real estate. The Board of Trustees may consider many factors when considering annexation of a parcel, including the circumstances, benefits, costs, and existing conditions.

All decisions to annex shall be at the discretion of the Board of Trustees of the Village of Mahomet and any decision regarding annexation does not set a precedent for future consideration of any other annexations.

ELIGIBILITY

State Statute affords the Village options to annex land under various scenarios all related to the relativity of the Village boundaries to the particular parcel. The annexation policy shall be based on such conditions as a guide.

1. Parcels contiguous to municipal boundary a. It is the policy of the Village of Mahomet to consider most favorably the

voluntary annexation of parcels that are contiguous to Village infrastructure such as roads, storm, sanitary, water and other services where existing systems and services can be extended to the property.

b. It is the policy of the Village of Mahomet to review carefully any parcel that is physically contiguous to the Village Corporate Limits, but due to geographical or jurisdictional reasons is not functionally contiguous for transportation system and utility service extensions.

2. Non-Contiguous Parcels within the extraterritorial jurisdiction (ETJ) and subdividing a. If the property is not contiguous to the municipal limits of the Village, the

property owners may be required to enter into a binding written agreement concurrent with or prior to the subdivision of property as requested by the Village, unless other factors do not support annexation. This can be in one of two forms as authorized by the Village.

i. The Village shall entertain the request for an annexation agreement between the parcel and the Village provided the property is anticipated to be likely for contiguity within 20 years; contains frontage along roadways and streets in the major street plan of the Comprehensive Plan; or, is located such that it’s annexation would result in contiguity for another parcel that is obligated to or has requested annexation.

ii. A subdivider may be required to include a clause in the subdivision owner’s certificate and subdivision covenants that indicates the landowner shall deliver a petition to annex at such time as the property become contiguous to the Village.

iii. A subdivider of agricultural lands remaining in agricultural production may not be required to record a clause for future annexation until such time as the land is divided for development.

3. Parcels Within Sangamon Valley Public Water District (SVPWD) Boundary a. It is the policy of the Village of Mahomet that the annexation of lands

within the SVPWD, and SVPWD’s necessity and intent to deliver water and or sanitary sewer services, shall not factor into the decision to annex property within the context of the ability to extend public water supply and /or sanitary sewers to the site.

a. The policy and regulations contained in Village Ordinances and regulations regarding water and wastewater utilities shall control, but generally, it is the policy of the Village of Mahomet to match the existing and future utility service extensions with the Village’s municipal boundaries. Therefore, new applicants for utility services shall be required to voluntarily annex to the town for delivery of those services. If those properties are not contiguous and eligible for immediate annexation, the owners of said property may be required to enter into a binding agreement that the present or future owners will voluntarily petition for annexation at the time of any of the following occurrences:

i. The property becomes contiguous or otherwise eligible for annexation

ii. At the convenience of the Village of Mahomet 5. Parcels within a “wholly bounded” area

a. Property that is less than 60 acres and surrounded by the Village Corporate Limits is eligible for annexation per State statutes. It is the policy of the Village of Mahomet to carefully consider and evaluate the benefits and the costs to the Village of Mahomet and its taxpayers prior to initiating the process of annexation of surrounded property.

EVALUATION CRITERIA

1. It is the policy of the Village of Mahomet that long term land use plan consistency is heavily weighted in the decision of when to annex a parcel.

2. It is the policy of the Village of Mahomet that present use, compliance status in the County regulations, and non-conformities with annexation are lightly considered during evaluation as all are considered short term conditions.

3. It is the policy of the Village of Mahomet that land enabling the annexation of other land that is deemed desirable to annex shall be strongly considered for annexation.

4. Although not required, the Board of Trustees may consider factors that include fiscal review, planning and land use, eligibility, affected government entities, and operational and service impacts as identified in this policy. These factors may include statements relating to the variables the Board considers, but those variables are by no means weighted, ranked, or require a specific response to support the Board’s position to pursue annexation. However, the Board of Trustees may consider factors beyond these variables prior to action. Village staff are to identify unique circumstances to each property being considered for annexation that may be pertinent to the intent of this policy.

FACTORS FOR CONSIDERATION

Although not required, factors for consideration pertinent to the unique situation of the property may be analyzed by staff for the Board of Trustees evaluation. Factors include:

FISCAL REVIEW

· Annexation WILL/WILL NOT increase the Village’s revenue in the form of EAV and real estate tax receipts, local share of state income tax and MFT funds, retailer’s occupation tax, video-gaming, and other sources.

· Annexation WILL/WILL NOT increase the Village’s eligibility for grant monies. · The current land use is one which IS/IS NOT needed within the boundaries of the

Village for purposes of a balanced economy.

PLANNING & LAND USE

· Annexation of the parcel WILL/WILL NOT provide a strategic benefit to facilitate smart growth.

· The application of Village zoning requirements WILL/WILL NOT be beneficial to the properties in the area or WILL/WILL NOT prevent development or use in a manner that is inconsistent with the Comprehensive Plan maps and policies.

· The property IS/IS NOT in a use that would be compliant with Village zoning ordinances when annexed to the ‘similar zoning’ as set forth in the Municipal Code (65 ILCS 5/7-1 et seq.).

· The property IS/IS NOT compliant with County zoning ordinances. · The property HAS/HAS NOT been legally subdivided according to Village

requirements. · Annexation WILL/WILL NOT result in more logical boundaries for the Village.

ELIGIBILITY

· The property IS/IS NOT eligible for immediate annexation. · The owner HAS/HAS NOT delivered an executed petition for annexation to the

Village. · The property HAS/HAS NOT been contiguous to the Village limits for a lengthy

INTRODUCTION:

At the Village’s request, Ehlers conducted a Feasibility Analysis to determine the presence of any Tax Increment Financing (TIF) qualifying factors in two areas of properties identified by the Village as areas around the downtown Main Street business district and the area around Eastwood drive including the businesses on Rt. 47. The purpose of the analysis was to conclude if one or both areas qualifies either separately or as a combined area to be a TIF District. In Ehlers’ professional opinion, they found the combined areas would qualify to be designated as a new TIF district. The next steps and scope of services are identified in the agreement. Other taxing bodies are aware the Village is pursuing a TIF in this area. BACKGROUND:

Ehlers applies a three-phase approach to designating or amending a TIF District. Phase I had been completed and is the Feasibility Analysis. Ehlers has submitted a proposal to assist with the remaining steps. Initially before beginning Phase II, Ehlers will update the Feasibility Analysis since it has been one year since completion. Phase II includes preparation of the Redevelopment Plan, which documents the findings of the Feasibility Analysis and serves as the basis of the ordinances the Village Board would approve to adopt the TIF District Redevelopment Plan. Upon completion of the Redevelopment Plan for the TIF, Ehlers will assist the Village with Phase III, the process for approving the TIF. The Act requires a specific adoption process, which includes a meeting of the Joint Review Board (the “JRB”), composed of certain representatives from impacted taxing districts. After reviewing the evidence presented on the eligibility factors described earlier, the JRB shall make a non-binding recommendation to the Village Board. A public hearing is then held to take public comment. At a minimum of two weeks after the public hearing, the Village Board can then consider the adoption of the ordinances designating the TIF District and adopting the use of tax increment financing.

Ehlers will also have to complete a Housing Impact Statement/Study. In addition to the work that Ehlers will be completing for the establishment of a TIF district, the Village will also be using another professional services firm to complete a Downtown Master Plan. The downtown master plan will identify a significant list of recommended improvements that can be made to infrastructure, aesthetics, landscaping, lighting, and streetscapes. This list will be costly and the goal is to be able to gradually fund the recommended improvements using the TIF funds generated in that district. The TIF is necessary to be a funding mechanism for these projects. DISCUSSION OF ALTERNATIVES:

The alternative is for the board to decide they do not want to pursue a TIF designation for this area. Without the designation it will be unlikely needed infrastructure and other improvements that will be identified in the separate Downtown Master Plan can be made to this critical business district in the near future. PRIOR BOARD ACTION:

No prior board action except approval of payment for the initial Feasibility Analysis. COMMUNITY INPUT:

BUDGET IMPACT:

$33,000 for the services outline in the service agreement with Ehlers. The Village has already spent approximately $11,000 on the initial feasibility analysis to determine if the area qualifies for TIF designation. STAFF IMPACT:

The Planning & Development staff will have the most impact since they will have to provide information to Ehlers. SUMMARY:

Ehlers completed Phase I last July which was the Feasibility Analysis. The next two phases include Phase II which is Preparation of Redevelopment Plan, Phase III which is Adoption of Project, and the addition of a Housing Impact Statement/Study. All of these tasks are necessary in order to create a new TIF district. RECOMMENDED ACTION:

We recommend approving the Professional Services Agreement with Ehlers in the amount of $33,000. DEPARTMENT HEAD APPROVAL:

A RESOLUTION AUTHORIZING AN AGREEMENT WITH EHLERS & ASSOCIATES, INC FOR SERVICES ASSOCIATED WITH TAX INCREMENT FINANCING IN THE

AMOUNT OF $33,000.

WHEREAS, Ehlers previously completed the initial Feasibility Analysis for the

establishment of a TIF District for the downtown area in July 2017; and WHEREAS, Village Staff and the Board Trustees approved the FY 2018-2019 Budget

which included $33,000 for these services; and, WHEREAS, Ehlers is an independent municipal advisory firm and currently serves as

financial advisor to the Village for matters related to issuance of bonds and tax increment financing districts (TIF); and,

Ehlers is an independent municipal advisory firm. Ehlers’ staff has had the pleasure of providing service to local governments throughout Illinois and the Midwest since 1955. Project Personnel and Availability

Ehlers uses a team approach with advisors assisted by research analysts. One advisor will have primary responsibility for our work with the Village and will be assisted by several staff members. This approach affixes responsibility and assures continuity of service for the client from initial submittal through any follow-up work. This also allows a better match of Ehlers' staff expertise to the needs of the Village. Maureen Barry, Senior Municipal Advisor/Vice President will serve as lead advisor for the Village. As such, all of the project work will either be completed by or directly overseen by Maureen, and she will attend all scheduled meetings. Tricia Marino Ruffolo, Economic Development Advisor, will serve as the second advisor for the Village. She will assist with field studies, reviewing qualifications of the TIF District, and document production. Scope of Services: TIF District Establishment

Ehlers will provide the following services to assist in the creation of a proposed Tax Increment Financing District (the “Project”), pursuant to the criteria set forth in the Illinois Tax Increment Allocation Redevelopment Act, 65 ILCS 5/11-74.4-1 et seq. (the “Act”), to include certain properties as identified by the Village (the “Study Area”) for the potential TIF District (also referred to as “Redevelopment Project Area”), as shown below in Map 1.

All services will be performed in conjunction with designated municipal officials and the municipality’s designated TIF attorney. Ehlers recommends that an attorney with specific experience in the development, qualification, adoption and amendment of TIF Districts within Illinois be engaged by the municipality to provide legal counsel related to this project. The steps for creating a new TIF District are outlined in the scope of services below.

Phase I – Feasibility Analysis Under a separate contract, Ehlers had completed a Feasibility Analysis of the proposed Redevelopment Project Area. The findings were submitted to the Village on July 21, 2017, which determined the Project is a statutorily and economically feasible to achieve the Village’s objectives.

Now that the Village is prepared to move forward in the TIF Designation process, there are a few items that were examined as part of the Phase I Feasibility Analysis that will need to be updated with more current information.

• Review of previous documented findings related to all eligibility criteria to verify the findings and data are still accurate.

• Research the Equalized Assessed Valuation for Tax Year 2017 of each PIN within the proposed boundary. (The Feasibility Memorandum referenced Tax Years 2011-2016).

Phase II – Preparation of the Redevelopment Plan The Phase I – Feasibility Analysis prepared in July 2017 indicated the Study Area qualifies as a TIF District according to the Act. When and if the Village elects to proceed with the process, the Project will move to Phase II. This phase includes preparation of the Redevelopment Plan for the Project, which includes the formal eligibility analysis. This phase begins after receiving notification from the Village to proceed, and ends after the Village has approved the draft Redevelopment Plan, including any necessary revisions. As part of Phase II services, Ehlers will:

• Based on the goals and objectives identified in Phase I, prepare a draft Redevelopment Plan that includes all statutorily required components.

• Coordinate with Village’s staff, engineer, planner or other designated party to obtain a legal description of the boundaries of the proposed redevelopment project area.

• Submit to the Village an electronic version of the draft Redevelopment Plan for initial review and comment. The Redevelopment Plan will include a map of the TIF District, the findings of the Phase I Feasibility Analysis which identifies the qualifying factors for the district, redevelopment goals and objectives that are consistent with the Village’s Comprehensive Plan (if applicable), redevelopment project costs, incremental revenue estimates for Plan purposes, and other language and certifications required by the Act.

• Revise the Redevelopment Plan as needed in response to comments from the Village Staff and TIF Attorney. Submit a final draft version to be filed with the Village Clerk and provided by the Village to other parties according to the requirements of the Act in conjunction with Phase III services.

Phase III - Adoption of Project The Act requires a specific adoption process, which includes a meeting of the Joint Review Board (composed of representatives from certain impacted taxing districts) and a public hearing. This phase begins after receiving notification from the Village to proceed following Phase II and ends after the adoption ordinances have been considered by the governing body, or the time allotted by the Act for that consideration has expired. In Phase III, Ehlers will:

• Coordinate with Village staff to confirm dates and times for required public meetings. Ehlers will work with the Village’s attorney to ensure that selected dates meet all

statutory timing requirements.

• Provide guidance to the Village regarding the public participation process. The Village will be responsible for all notices to the public, residents, property owners, and publications. (Sample copies of notices and advertisements can be furnished upon request.)

• Attend and make a presentation at Joint Review Board Meeting (see “Meetings” section).

• Attend and make presentation(s) at appropriate Village Board meetings and other meetings (see “Meetings” section).

• Provide any Project Plan amendments required as a result of the Joint Review Board meeting or public participation process.

• Upon approval by the governing body, assist the Village with the submission of required information to the County.

Phase IV - Prepare Housing Impact Statement/Study During the Phase I feasibility analysis, it was estimated that ten (10) or more inhabited residential units are reasonably expected to be displaced and there may be seventy-five (75) or more occupied residential units in the redevelopment project area. Based on the initial proposed boundary area, a Housing Impact Statement/Study will be

required. Ehlers will:

• Prepare a Housing Impact Study, per the Act, to include the following: number of residents, number of residents to be relocated, number of low and moderate income residents, and where applicable, a relocation plan.

Because ten (10) or more inhabited residential units are reasonably expected to be displaced and there may be seventy-five (75) or more occupied residential units in the proposed redevelopment project area, a public information meeting is also required. Ehlers will:

• Prepare a presentation, attend, and present at a community meeting (included in Phase III services).

This phase begins after receiving notification from the Village to proceed following the completion of Phase I and ends after the Village has approved the draft Housing Impact Statement/Study (following any necessary revisions). Meetings Ehlers participation in the following meetings is included in the flat fee for the applicable phase of this Project:

1. Project initiation conference call with representatives of the Village to launch the Project and coordinate various process steps (Phase I).

2. Conference call to discuss the proposed Redevelopment Plan with the Village’s staff (Phase II).

3. Public information meeting, as required related to the number of units of occupied residence and units expected to be displaced (Phase III).

4. Meeting with representatives of certain impacted local taxing districts (the Joint Review Board) to review the Redevelopment Project Area eligibility and scope of the proposed redevelopment project (Phase III).

5. Public hearing on the proposed Project (Phase III). 6. One additional progress meeting with Village staff at the discretion of the Client

(any phase).

All services will be performed in conjunction with designated staff of the Village and its designated attorney.

If requested by the Village, Ehlers will participate in additional meetings beyond this scope to discuss the proposed TIF District with various parties, such as the Village Board, members of the business community, etc. Any additional meeting requested or required related to the development, qualification, and adoption of the proposed TIF District will be submitted to the Village for authorization prior to its completion and will be subject to Ehlers’ Hourly Billing Rates. Village Responsibilities The following items are not included in our Scope of Services:

• Legal Description of Redevelopment Project Area.

• Distribution of notices and mailings related to the adoption of the TIF District to the public, residents, property owners, and publications.

• Other consulting services. Services rendered by Village’s engineers, planners, surveyors, appraisers, assessors, attorneys, auditors, and others that may be called on by the Village to provide information related to completion of the Project. If a certified Engineer's statement is necessary to determine chronic flooding, the Village will be responsible for obtaining and providing that statement.

• Legal review. Ehlers recommends that the Village contract with an attorney with direct experience in the establishment of TIF Districts for consultation during this Project. All attorney expenses are to be assumed by the Village.

Ehlers charges a flat fee for TIF District development, qualification, and adoption services. The Project will be completed for the costs provided below, which includes all time, materials, and expenses associated with two iterations of the documents.

Appendix B: Project Team

Ehlers offers a group of individuals with an exceptional combination of expertise and experience to act as the TIF Consulting Team for the Village. Below is information about the Project team and staff of the firm, which has completed hundreds of TIF and other special district redevelopment plans for Midwest communities. Ehlers’ staff has worked in municipal management, administration, and financial management, school district administration, regional planning, economic development, and state legislative support. This team serves or has recently served as advisor to many Illinois local governments, including the Village of Mahomet. Other clients include the Village of Bradley, Village of Clarendon Hills, Village of Oak Park, Village of Oakwood, City of Peoria, Village of Richton Park, Village of River Forest, Village of Rockton, Village of Tinley Park, City of Watseka, Village of Westmont, City of Wheaton, and the Village of Wheeling, among others. Prior to that time, she worked in local government for over 15 years, most recently as the Assistant Village Manager in Wilmette, and before that, for the City of Evanston and the City of Glendale, Arizona. In these roles, she worked with local government leaders and other key players in planning and managing a wide variety of governmental operations and projects. Mindy Barrett, TIF Coordinator Mindy has been with Ehlers since 2006 and serves as a Tax Increment Financing Coordinator in our Chicago office. Village of Tinley Park The Village of Tinley Park undertook the development of two TIF Districts in 2003. The focus of these TIFs was to redevelop key projects as identified by a downtown strategic plan. Ehlers was hired to assist the Village with TIF District qualification and adoption, redevelopment implementation and management, developer RFP, developer negotiations, pro forma analysis, and TIF increment projections. During the TIF District qualification process, the exact boundaries of the TIF Districts became an issue. The Village had made the decision to minimize the number of properties in the TIF Districts, believing that this would be beneficial to the local School District. However, in negotiations the School District indicated it was desirous of adding parcels not initially identified for the TIF. Ehlers assisted with the creation of TIF boundaries that would not only increase the EAV of the parcels for the School District at the end of the TIF, but encourage a large enough redevelopment effort to stimulate additional redevelopment and increase EAV in areas surrounding the TIF.

This work has resulted in Tinley Park becoming a major retail, restaurant, and hospitality hub for the southern suburbs. Additionally, the School District’s belief that activity in the TIFs would result in redevelopment outside the TIF areas has become reality, as significant rehabilitation and renewal of properties in this area has occurred.

More recently, Ehlers worked with the Village to develop and adopt two new TIF Districts, the Legacy TIF and the Mental Health Center TIF, which includes a 280-acre property which was formerly owned and operated by the State of Illinois. The site is the single-largest master planning and development opportunity within the Village and in the southwest suburban area. Ehlers also provides TIF increment projections on redevelopment proposals and other TIF Consulting and Administration services on an ongoing basis for the Village.

City of Peoria The City of Peoria is the oldest community in Illinois with a population of 115,007 (2010 Census). It is the second largest metropolitan area in Illinois, and boasts the second most densely developed downtown. In 2013, Ehlers assisted the City with the creation of one new TIF District and the amendment of an existing TIF District to spur investment in its Downtown. An amendment was first made to the Central Business District (CBD) TIF (in Downtown Peoria) to remove parcels from the original redevelopment project area (RPA). Prior to the adoption of the amendment, a study of the amended RPA was performed to confirm that the area would have achieved TIF qualification at the time of the original study without those parcels. The CBD TIF Redevelopment Plan was then updated to incorporate a new budget, goals, and other items. The amendment also added language to bring the Amended TIF Redevelopment Plan into compliance with current TIF Act requirements. The parcels that were removed from the CBD TIF were then included in the new Downtown Conservation TIF. The Downtown Conservation TIF is the home of Caterpillar, Inc.’s world headquarters. Caterpillar is the world's leading manufacturer of construction and mining equipment and diesel and natural gas engines. The Downtown area has many of the elements that attract residents to live in a central business district – historic architecture, proximity to the workplace, pedestrian friendly areas, public gathering spaces, and recreational opportunities. Yet, while some residential development and redevelopment had taken place, the downtown lacks some of the retail amenities residents desire, in addition to other problems to overcome in its redevelopment, such as deteriorated buildings and paved areas, building vacancies, and needed renovation and demolition of older facilities, which would be too costly to undertake without public funding assistance. The City is in the early stages of using tax increment to help make improvements and induce private investment into the area.

City of Wheaton- Downtown Capital Plan Financing Strategy In August 2014, Ehlers was engaged to provide financing analysis and consulting services for the implementation of the Downtown Wheaton Strategic and Streetscape Plan. The project area is comprised of approximately 115 acres located in and on the edges of downtown. Projects include streetscape, water and sewer, French Market structure, a public park, signage and wayfinding, and traffic signal improvements. The work is projected to be completed over a 20-year period and has an estimated total project cost of approximately $53,000,000. In addition, there are about $750,000 in annual operating costs associated with parking enforcement, annual plantings, business recruitment and marketing. The analysis focused on two key tasks:

• Identify revenue generating options that can support the level of General Obligation debt needed to cover the cost of the capital projects

• Produce an initial funding scenario that is consistent with the City’s debt guidelines.

Approach. Ehlers prepared a financial model and graphic summary “menu” of revenue source options that would be available to the City for funding various public infrastructure and redevelopment projects the City would like to see completed within the downtown area. Ehlers financing model assumed 100% G.O. Bonds and revenue projections for non-G.O. Bond revenue sources that could potentially defray a portion of the project costs, thereby reducing the dependence on the G.O. debt. Our research included the potential applicability and funding levels from sources which may benefit the project area according to the provisions of Illinois law as it applies to the sources being considered, specifically a Special Service Area (SSA), Business District (BD), a tax increment financing (TIF) District, expansion of the Home Rule sales and other local taxes and other funding mechanisms as they may apply. We made assumptions on funding levels and prepared a financial model illustrating how the projects could be financed using General Obligation debt serviced by other revenue sources.

Results. The results indicated that the revenues exceeded the amount of debt service each year for all the anticipated projects. In consultation with the City’s Finance Director, we recommended issuing longer term debt (15 years) to maintain a healthy cash balance and take advantage of low long-term interest rates on the bonds, which is also consistent with the City’s debt guidelines. Under these assumptions, the City has the option to look at reducing the level of revenue sources, or implementing additional revenue tools later in the project funding cycle. The initial financing scenario was presented to the City Council in April 2015. The City prioritized the projects and is in the process of determining an approach for financing utilizing Ehlers analysis of debt financing and other revenue sources. Village of Wheeling The Village of Wheeling is a suburban community located in northwestern Cook County. The Village has experienced tremendous growth, but growth is slowing as the Village becomes built out. Its older developments are starting to experience decline. Like other communities located on the far edges of Cook County, Wheeling’s commercial and industrial development is at a disadvantage when more favorable tax rates are in place in close proximity to the community, such as in Lake County.

Ehlers has provided the Village with TIF Eligibility and Adoption, as well as TIF Amendment services in a number of areas. In 2008, Ehlers assisted the Village with the creation of its Southeast (Industrial Lane) TIF, which encompasses the Chicago Executive Airport, including a number of vacant parcels surrounding the airport. Although there has been limited development in the TIF District and the need for tax increment financing still exists, the economic recession that began almost immediately after the TIF was adopted caused the equalized assessed value (EAV) of the area as a whole to decrease significantly below the base values that were established when the TIF was adopted in September, 2008. This led to a substantial diminishment in the TIF revenues generated since that time. With Ehlers’ assistance, the Village determined that its best option was to terminate the TIF and re-establish a new TIF in largely the same area, which allowed the Village to re-set the base equalized assessed values at the lower levels. This new TIF, the Southeast-II TIF, was adopted by the Village in July, 2014.

The Village intends that the new TIF will help redevelop the area around and including the airport with airport-related uses, as well as retail and office development. The TIF will also help the community improve existing residential areas. Ehlers continues to assist the Village by performing various TIF and economic development studies as needed.

Appendix D: Economic Development Services

Ehlers offers sophisticated analysis of revenue projections, financial feasibility, and the potential impacts of development to the Village and other taxing districts. Ehlers is available to assist the Village with the items described below or other services as needed by the Village: Business Districts In Illinois, the Business District designation is an important municipal economic development tool that provides strategic planning and sales tax financing for both development and redevelopment areas. Ehlers provides a complete range of services for business district adoption and implementation. Key services include: analysis of business district eligibility, documentation of eligibility findings, preparing the legally required business district plan, analysis of financial feasibility, estimating sales tax revenue potential and facilitating the public hearing and review process. TIF Financial Feasibility Study Ehlers can provide the necessary financial feasibility study for the construction of Developers Notes or for the issuance of bonds. Review of Taxing District Impact As part of negotiations with the overlapping taxing districts on the creation, expansion, or extension of a TIF district, the Village may need to provide fiscal impact information to the school or other taxing district. Ehlers can prepare this information on behalf of the Village. Ehlers would be prepared to discuss findings with both the Village and the taxing districts to assist the Village in its final strategy. TIF Reports Ehlers is available to prepare annual TIF reports or to assist staff in the preparation of these reports. As part of this activity, Ehlers will attend and present reports at the Joint Review Board meeting. Tax Revenue Projections Ehlers can provide projections that estimate the impact of new development to the equalized assessed value of properties and the expected level of tax revenue. These projections are used to help determine the amount of tax revenue that may be generated by certain development and the overall amount that may be available to fund development projects. Developer Pro forma Analysis Municipalities are often approached by developers seeking funding to support a proposed project. One of the biggest challenges communities face when working with developers is determining the appropriate level of assistance. Ehlers Municipal Advisors regularly conduct Pro forma Analyses for communities pursuing redevelopment, helping them assess the appropriate level of need and developer assistance. This includes determining whether there may

be a gap in funding that precludes private parties from earning a reasonable rate of return on their investment to market standards. If the answer is no, Ehlers will advise that public assistance is not required. If the answer is yes, Ehlers quantifies the public assistance and recommends limits. This further confirms the “but for” clause of the TIF Act.

Note: The Developer Pro forma Analysis fee may be reimbursed to the Village by the developer. Developer Identification, Selection, Negotiation and Agreement Implementation Developer Identification and Selection Ehlers assists communities in the identification of potential commercial tenants and retail development options through a defined process. The first step in the process is to conduct meetings with developers and real estate professionals in an informal setting. There are several advantages to these types of meetings. First, this is an opportunity to spread the word about the site’s potential to the development community. The Village would gain insight into the current real estate market without being pressured by a developer or broker. In today’s uncertain market, the meetings would offer insight into the type of tenants that are looking to expand and those tenants’ needs for certain site attributes. The Village would also gain an understanding of how any changes to the infrastructure may help spur development. These meetings provide a solid understanding of what the market will support and the type and number of tenants that would be interested in the location. If necessary, the Village may wish to have a market study completed by a real estate professional at this time. Ehlers may then prepare a Request for Proposal (RFP) based on information gathered. The RFP is sent to a list of qualified developers with whom Ehlers has experience or knowledge, as well as those identified by the Village. Ehlers assists the community in the interview of the developers and evaluates their proposals, providing information to the community as the basis for their selection of the developer. Developer Negotiation and Agreement Implementation Ehlers has extensive experience in negotiating development agreements for a wide range of commercial, residential, and mixed-used projects. Just as critical as experience in this area, is the need for a consultant that is independent. When Ehlers works in a municipality, it works for the municipality – not the developer. Ehlers has taken a lead role in many development negotiations, as well as provided feedback on redevelopment agreements negotiated by others. The final agreement is subject to attorney approval. Examples of recommendations Ehlers has made include:

• Amount, type, and timing of incentives or assistance to developers. o Receipt of incentives geared toward performance. o Incentives based on goals of municipality.

During and after construction, Ehlers can manage development agreements by determining eligible expenses and calculating reimbursements. Debt Issuance Ehlers can assist the community in the issuance of debt to support the project, including:

• Exploration of type of debt that best serves the community. • Preparation of Feasibility Study to support the project. • Negotiation of debt.

Note: Ehlers can assist with the issuance of debt, subject to a separate service agreement. Fees would depend upon the size and complexity of issue and form of debt.
