WHEREAS, the Tompkins County Legislature first appropriated $4,000 to the Department of

County Administration in the 2015 Budget to fund a centrally administered master contract for language

translation and interpretation services for County Departments as a part of the County’s Limited English

Proficiency (LEP) Program, and

WHEREAS, when, in 2015, actual monthly costs in this program were on track to exceed the

amount budgeted, the Tompkins County Legislature appropriated an additional $8,000 for the program

from the Contingent Fund, and

WHEREAS, final costs for this program for 2015 totaled $8,295, and

WHEREAS, the 2016 appropriation for the program was again $4,000, and

WHEREAS, in 2016, the 1st quarter costs to date for this program already total $4,659, and

WHEREAS, the month-to-month volatility in these costs makes estimating the remaining 2016

costs with any precision very difficult, and the experience in 2016 to date suggests that quarterly costs

may reach as high as $5,000, now therefore be it

RESOLVED, on recommendation of the Government Operations and the Budget, Capital, and

Personnel Committees, That the Director of Finance is hereby authorized and directed to make the

following budget adjustment for 2016:

BUDGET APPROPRIATION:

FROM: 1990.54400 Contingent Fund $16,000.00

TO: 1230.54442 Professional Services $16,000.00

RESOLVED, further, That the Fiscal Target of the Department of County Administration be

increased by $16,000 to fund this program at $20,000 in 2016 and forward.

Library Board of Trustees

Resolution No. - Approval of Bylaws - Tompkins County Public Library (ID #6292)

Ms. Kiefer spoke of the process for approving vouchers and commented the bylaws state that can

only happen at a regular meeting and she questioned if there was a time when more immediate attention

was needed. Ms. Currie referenced the section pertaining to the Executive Committee and in certain

situations the Committee could meet and vote and prepare a report for the Board of Trustees at their next

regular meeting. She also commented that situation has not occurred. Following further discussion, it

was felt those sections could be revisited during the next review process as the bylaws are reviewed on an

annual basis.

Ms. Kiefer also believes the sections pertaining to the preparation of the budget are not clear and

following an explanation by Ms. Currie on the process she agreed to have these sections looked at during

the next review process.

Ms. Kiefer spoke about the Charter section pertaining to the Library and the reference to keep the

County informed. Ms. Currie said currently information including minutes, financial reports, etc., are

provided through the liaison, Chair Michael Lane, but she could send that information to the Chair of this

Committee to forward to Committee members electronically. The Committee agreed with that

suggestion.

Resolution No. - Statement of the Tompkins County Legislature Regarding New York State

Government Ethics Reform (ID #6293)

Discussion followed concerning the resolution with many suggestions being offered and accepted

as friendly. Those changes will be incorporated and reflected in the resolution being presented to the

Legislature.

RESULT: RECOMMENDED [UNANIMOUS]

WHEREAS, democratic, efficient, and effective government relies upon the citizens of New

York State having trust in the officials’ elected to represent them, and

WHEREAS, the former Senate and Assembly leaders of the New York State Legislature have

recently been criminally prosecuted and convicted for their misuse of the powers of their offices, and

WHEREAS, over 30 New York State legislators in the past 15 years have left office because of

criminal and/or ethics charges, and

WHEREAS, this systemic criminal misconduct provides the appearance of a pattern of corruption

within the legislative branch of New York State Government, and

WHEREAS, the violations of public confidence incident to the criminal activity of these many

Legislators creates cynicism and distrust in all of the Legislators, regardless of actual participation in

corrupt activities, and

WHEREAS, the further issue of effectively unlimited and undisclosed sourcing of campaign

contributions has created the presumption that “pay to play” is the normal method of Albany politics,

where the average citizen is left to bear the financial consequences of the special treatment accorded to

special interests who have bought privileges, and

WHEREAS, the failure of the New York State Legislature to effectively act to address the root

causes of the actual and perceived corruption with comprehensive and rigorous ethics reform creates the

appearance that the body tolerates the misuse of the powers of office by some Legislators, and is willing

to allow such corruption to continue unhindered, and

WHEREAS, the failure of the New York State Legislature to effectively act to address the root

causes of the actual and perceived corruption with comprehensive and rigorous ethics reform jeopardizes

the foundation of trust necessary for government to operate with the “consent of the governed” and

presents a fundamental challenge to the legitimacy of the Legislature, and

WHEREAS, the people of New York State need and deserve ethical and effective government,

now therefore be it

RESOLVED, on recommendation of the Government Operations Committee, That the Tompkins

County Legislature implores the New York State Legislature to legislate comprehensive and meaningful

ethics reforms to include:

- Amending the New York Constitution to allow denial of pension benefits related to legislative

service to legislators who are convicted of violating the public trust conferred by their membership

in the Legislature through misconduct in office.

- Providing public matching funds for elections by creating a system modeled on the New York City

voluntary small donors’ matching program for donations from individuals, together with a method

for a candidate to receive additional funds to address large outside funding from political action

committees.

- Transparency by requiring the disclosure of the names of individual donors to a candidate or

independent expenditure committee, even if made through a corporation or limited liability

company.

- Transparency in the budget process by requiring disclosure of earmarked funds at least three days

prior to voting on the New York State Budget together with identification of the member(s)

proposing the request, and also requiring records of earmarks be publicly maintained for five years

after the appropriation.

- Allowing proposed legislation to come to the floor for debate and a vote upon the request of two

thirds of the members of the Assembly or the Senate, even if such proposed legislation is opposed

by the majority leadership.

- The creation of term limits for the positions of Speaker of the Assembly and Majority Leader of the

Senate to provide the Legislature with leadership from a wider range of New York State citizens and

prevent the long term consolidation of power in specific individuals.

- Limiting total contributions from any individual to a candidate or political action committee to an

amount not to exceed $2,000 in any one campaign cycle.

- Restructuring the Joint Commission on Public Ethics by: (1) reducing the number of members; (2)

use of a non-partisan selection method of the Commissioners; (3) expanding representation on the

Commission through added appointments by New York State government watch-dog groups; (4)

elimination of the existing Legislative Ethics Commission, and; (5) granting clear authority to the

Commission to freely investigate and enforce ethical violations within the New York State

Legislature.

- Restructuring the New York State Board of Elections to remove the evenly divided two-party format

that results in inaction due to tie votes by expanding membership to include an odd number of

Commissioners with representation from at least the five largest political parties in New York State.

- Restrictions on the sources of Legislator’s outside income to reduce conflicts of interest.

- Adoption of a redistricting process through use of an independent nonpartisan commission modeled

on the Iowa State system that takes into account contiguity, compactness, existing municipal

boundaries, and an area’s commonality of interests.

RESOLVED, further, That this Resolution be forwarded to Governor Coumo, Speaker Heastie,

Majority Leader Flanagan, Senators Thomas O’Mara, Michael Nozzolio, James Seward, and

Assemblywoman Barbara Lifton, and the New York State Association of Counties,

RESOLVED, further, That the Tompkins County Legislature requests that the members of the

New York State Assembly and Senate that represent Tompkins County respond with their positions on

the above Resolutions, being: Senators Thomas O’Mara, Michael Nozzolio, James Seward, and

Assemblywoman Barbara Lifton.

Approval to withhold three (3) parcels from the 2016 foreclosure auction. Approval to add previous year’s Taughannock Road and Belle School Road parcels to 2016 auction. Approval to sell one parcel subject to easement and one parcel with deed restriction limiting

development and vegetation removal.

Background Prior to disposition of real property, the County Land Transactions Policy (01-07) requires staff review to determine the existence and significance of natural, cultural, and historic resources on the property, any significant concerns regarding zoning and local/regional strategic land use plans, and any significant economic or fiscal impacts due to the proposed transaction. This review is done annually for all properties being considered for foreclosure due to non-payment of taxes. The County Land Transactions Policy also requires annual reporting on parcels withheld from past auctions. 2016 Foreclosure Report The 2016 Foreclosure Report is attached. As of May 25th, this year’s list includes seventeen (17) parcels subject to foreclosure proceedings by Tompkins County. Parcels Recommended for Withholding from the 2016 Auction Brooklyn Road

Village of Freeville, 0.98 Acres, Tax Parcel No. 1.-2-1.2 This vacant parcel is located on Brooklyn Road and Freeville-Groton Road (Route 38) in the Village of Freeville on Fall Creek. The property lies directly on ~350’ of Fall Creek and is located across Route 38 from a 45-acre nature preserve owned by the Village subject to an easement held by the Finger Lakes Land Trust. The parcel subject to foreclosure is further located within the Fall Creek Natural Features Focus Area. We discussed this potential sale to the Village of Freeville’s mayor. He will discuss with this board this potential acquisition at their June 7th meeting. We recommend withholding the parcel from the 2016 auction to explore adding it to the Village of Freeville nature preserve.

• Cascadilla and West Court Street Parcels

City of Ithaca, 0.5 and 2 AC, Tax Parcel Nos. 43.-2-10 and 52.-3-1.12 The City is currently evaluating actions it would be interested in taking on these parcels located within their Waterfront area along Cayuga Inlet adjacent to the recently established Waterfront Trail. We recommend withholding this parcel from the auction provided that the City is willing to assume liability for unpaid taxes in order to advance redevelopment that supports the City’s vision for this district.

Parcels Recommended for Inclusion in the Auction with Conditions Buffalo Road

Town of Caroline, 47 Acres, Tax Parcel No. 8.-1-66.2 This vacant parcel with a small recreational structure is located on Buffalo Road in the Town of Caroline. The parcel is a very steep, heavily forested parcel which drains to a tributary that feeds Sixmile Creek, the City of Ithaca’s water supply. To help protect water quality and wildlife habitat we recommend selling the parcel at auction, subject to a conservation easement that limits future development to no more than two principal structures, buffers the stream and requires that timber harvest must be done according to a Forest Stewardship Plan.

Parcels Withheld from Previous Year’s Auctions Recommended for Inclusion in the 2016 Auction

Belle School Road

Town of Caroline, 20 Acres, Tax Parcel No. 24.-1-8 This is a vacant rural parcel on Belle School Road near intersection with White Church Road. The parcel boundaries include a DEC Wetland and the Belle School Road Fen UNA (UNA-177). This parcel additionally falls within The Forestlands Natural Features Focus Area and wholly includes a DEC regulated wetland. The EMC-UNA committee identified this parcel as an important component of the UNA which includes rich fens and an important nesting site for wetland birds. The EMC-UNA committee along with the Planning Department recommended withholding this parcel from auction last year to pursue a sale which supports the conservation of the site. An appropriate owner for the parcel has not been identified. Due to this and the protections afforded by DEC regulations related to the wetland on the site, we recommend inclusion in the auction.

1284 Taughannock Boulevard Town of Ulysses, 2.6 AC, Tax Parcel No. 27.-4-6 This vacant parcel is located between the Black Diamond Trail and Taughannock Boulevard (NYS Route 89) just north of Perry City Road. The parcel has the potential to provide added buffer opportunities to the developing Black Diamond Trail. It is located within the Lakeshore Natural Features Focus Area, the Maplewood Glen and Lakes Slopes UNA (UNA-62) and on the Cayuga Lake Scenic Byway. The parcel was withheld from the 2012 auction to pursue a sale to New York State Parks. Funding for acquisition by the State is in the 2013 Land Acquisition project list. State Parks has however now taken issue with the Title to the property and are unlikely to follow through with the purchase. The County continued in 2015 to pursue protection options with State Parks and the Town of Ulysses to advance the conservation of this parcel. Given that these discussions have not identified a receptive buyer and due to the fact that this parcel has been rezoned into the Town of Ulysses Conservation District, which offers added protections, we recommend including the parcel in this year’s auction subject to a deed restriction prohibiting any development or vegetation clearing within 100’ of New York State Park boundary.

Budget Implications Delaying sale of the Brooklyn Road parcel will result in removal of the land from the tax rolls for up to one year and could result in the following the delay in payment of approximately $170 in taxes over the year. The County would be responsible for paying the portion which is owed to the School District, Town and Village during this time period. We anticipate, however, that this property will be able to be transferred to the Village of Freeville in short order. Cost related to delaying sale of Cascadilla and West Court Street parcels is unknown and contingent on commitments from the City of Ithaca.

WHEREAS, Tompkins County has a long tradition of developing and complying with established policies and 3

procedures that underscore the importance of fair standards and stewardship in governmental operations, and 4

WHEREAS, in addition to following its own policies and procedures, Tompkins County is responsible for 6

complying with a growing multitude of federal and state laws, rules, and regulations in the delivery of a diverse array 7

of County services, and 8

9

WHEREAS, in August, 2011, the Tompkins County Legislature enacted a formal corporate compliance 10

program that integrates legal and internal compliance efforts throughout county government to mitigate risk, assure 11

quality, and improve the performance of internal monitoring systems, and 12

13

WHEREAS, federal and state regulatory authorities are applying increasingly stringent standards of 14

compliance in monitoring the performance of local governments and have liberally applied their power to impose 15

sanctions on local governments for technical, as well as substantive, breaches of compliance, and 16

17

WHEREAS, while the obligation to understand and comply with governing laws, rules, regulations, and 18

policies is vested with those departments that deliver services that are subject to such, the general County has an 19

interest in providing the tools necessary for departments to fulfill their responsibilities and in providing oversight over 20

departmental compliance efforts, and 21

22

WHEREAS, the County’s Department of Administration (“Department”) has assumed the lead role in 23

providing such central support and oversight, including the development, monitoring, and periodic updating of the 24

County Compliance Program, and 25

26

WHEREAS, the workload associated with a contemporary compliance program has steadily grown and now 27

exceeds the capacity of the current staff of the Department, and 28

29

WHEREAS, it is in the County’s interest to ensure a vigilant approach toward compliance, and 30

31

WHEREAS, upon consultation with the Department of Personnel, the Department has requested the creation 32

of the position of Compliance Program Coordinator in the Department to assist with the administration of the County’s 33

Compliance Program, particularly in development and delivery of training programs, monitoring systems, and policies 34

and procedures, now therefore be it 35

RESOLVED, on recommendation of the Government Operations and the Budget, Capital and Personnel 37

Committees, That one position of Compliance Program Coordinator is created effective immediately in the 38

competitive class as a full-time, 40 hour per week position at a Confidential employee labor grade of 61, 39

RESOLVED, further, That the Director of Finance be, and hereby is, directed to make the following budget 41

Local Law No. 2 of 2004 - Attendance Requirement for Advisory Boards

Section 1. This Local Law amends Article 2 of the Charter to add a new Section 2.20 regarding the creation of vacancies

upon failure of County appointed officials to attend meetings.

Section 2. Section 2.20 of the County Charter shall read as follows:

§C-2.20

When any member of a board, commission, committee, agency, or authority, holding office by appointment

of the County Legislature or the Chair of the County Legislature, fails to attend three consecutive regular

meetings of such board, commission, committee, agency, or authority, unless such absence is for good cause

and is excused by the chairman or other presiding officer thereof, or in the case of such chairman or other

presiding officer, by the Chair of the Legislature, the office may be deemed vacant by action of the appointing

authority for the purposes of the nomination and appointment of a successor.

Section 3. The provisions of this law shall supersede any inconsistent or less stringent attendance requirements

in existing bylaws.

Section 4. This Local Law shall take effect immediately upon filing with the Secretary of State.
