Page 2: Chapters 31 and 34

• Steps you have to take to get married:

Page 3: Chapters 31 and 34

• Some states require a blood test (not Missouri).

Page 4: Chapters 31 and 34

• All states require a marriage license.

Page 5: Chapters 31 and 34

• Most states require a waiting period between getting the

license and having the wedding.

Page 6: Chapters 31 and 34

• A marriage ceremony is required by all states.

Page 7: Chapters 31 and 34

• Reasons to annul a marriage:

Page 8: Chapters 31 and 34

• One or both spouses are too young (18 in Missouri).

Page 9: Chapters 31 and 34

• The spouses are too closely related.

Page 10: Chapters 31 and 34

• One or both spouses was already married.

Page 11: Chapters 31 and 34

• One or both spouses did not freely give their consent.

Page 12: Chapters 31 and 34

• The marriage was based on some sort of fraud.

Page 13: Chapters 31 and 34

• Non-traditional relationships:

Page 14: Chapters 31 and 34

• A common law marriage is created when people act as if

they are married, but do not go through the proper procedures.

Page 15: Chapters 31 and 34

• Unmarried couples can enter into contractual arrangements while cohabiting, which may

be enforced.

Page 16: Chapters 31 and 34

• Same-sex couples have limited rights to marry in some states.

Page 17: Chapters 31 and 34

• What is needed to get a divorce?

Page 18: Chapters 31 and 34

• Most states require a separation period – not

Missouri, necessarily.

Page 19: Chapters 31 and 34

• If both spouses agree that the marriage is

“irretrievably broken,” then a divorce is granted.

Page 20: Chapters 31 and 34

• If both parties do not agree, then one of them needs to show fault.

Page 21: Chapters 31 and 34

• Fault is shown by:• Adultery

• Unreasonable Behavior• Abandonment for 6 months

• Voluntary separation for 12 months• Separation for 24 months

Page 22: Chapters 31 and 34

• How are things divided in a divorce?

Page 23: Chapters 31 and 34

• Property you have before the marriage is separate property.

Page 24: Chapters 31 and 34

• Everything else is marital property – owned equally.

Page 25: Chapters 31 and 34

• In a divorce, separate property is kept by its owner, and everything

else is divided equitably.

Page 26: Chapters 31 and 34

• In community property states, separate property is kept by its owner, and everything else is

split in half.

Page 27: Chapters 31 and 34

• One spouse may be required to make alimony payments.

Page 28: Chapters 31 and 34

• Custody of children is decided based on the best interests of the

child.

Page 29: Chapters 31 and 34

• This may include joint custody arrangements or sole custody

arrangements.
