“Si no, es una ofensa ycreo que inclusive noshubieran sacado de lacomunidad”, agregó eltambién profesor de maya de

la Universidad de QuintanaRoo, quien ya había tenidouna experiencia previa enel cine como un asesor parala película “Apocalipto” deMel Gibson.

Cárcamo considera latelenovela, que se transmiteactualmente en latelevisión estatal deQuintana Roo, como unaherramienta para“empoderar” a la lenguamaya a través de los mediosmasivos, dijo, para “hacerque los mayas se puedanver en la pantalla”.

“La lengua maya no estáperdida, para nada estáperdida, está viva. Los queestán perdidos somos loshablantes. Hay muchoshablantes que no estánhablando maya”, señalóChi.

El maya, o la maya comola definen ellos, es unamezcla de lengua, cultura ytierra que los padresheredan a sus hijos. En latelenovela, Jacinto (Chi) lapierde y necesitareencontrarse con susraíces.

“This year’s HispanicAdvocacy Day will be re-markable,” said HLCOMChairman Gil Guzmán. “Ithink we will see large atten-dance by constituents andunprecedented access topolicymakers. Working to-

gether, Michigan Hispanicswill give voice to our per-spective and show howLatinos can contribute toMichigan’s future.”

RODOLFO “El Maestro” FLORESRodolfo V. Flores, 77, of Toledo, OH passed away on September 6, 2013, at Heartland

of Holly Glen. He was born in San Antonio, TX on March 10, 1936 to Genaro and María(née Ruiz) Flores. He worked for the Chrysler Jeep Company before retiring after 36 years.Rodolfo was a member of St. Peter & Paul Catholic Church. He married the love of hislife, Consuelo (née Campos) in 1954. Together they were the first mobile disc jockeysin Michigan with their station WGOR. Over the next 30 years they had several stationsthroughout the region where Roldofo became known as El Maestro. He loved Tejanomusic.

Surviving are his loving wife of 59 years, Consuelo; children, Christina (Roberto Jr.)Jaime, Rodolfo Jr. (Rosalinda), Rachel (Gilbert) Rosario, Linda Carter, Suzanne Flores,Consuelo II (Leonardo) Brown; brother, Tony (Sally); sisters, Beatrice, Angie, Elena,Peggy; 30+ grandchildren; many many great-grandchildren, and many nieces andnephews.

He was preceded in death by his parents; son, Johnny, and brothers, Rubén and Ernest.

JESSE GUTIÉRREZJesse Gutiérrez passed away peacefully Thursday, September 5, 2013 at The Renais-

sance in Olmsted Township, Ohio where he resided for the past year. He was born JesúsGutiérrez in Purisima de Bustos, México on November 24, 1921, the eldest son ofApolonia and Viviano Gutiérrez. He was a resident of Lorain from the time he arrivedin the US from México at the age of six. He graduated from Lorain High School in 1940.He married Gloria (née Alvarez) who was from New York City in 1952. He was a proudWorld War II veteran who served in the First Platoon of Troop D, 41st CavalryReconnaissance Squadron, Mechanized of the 11th Armored Division of GeneralGeorge Patton’s 3rd US Army from 1943 to 1946. He served in the Battle of the Bulgeand the liberation of the Mauthausen and Gusen concentration camps. The Purple Heartis among his many awards. He was an active member of the Disabled American VeteransLouis Paul Proy Chapter 20 in Lorain for over 50 years where he served as treasurer andcommander. He was also an active member and leader of the Mexican communityparticipating in groups such as the Mexican Mutual Society and Neighborhood House.He worked for Thew Shovel/Lorain Koehring as an inspector for 32 years.

He was preceded in death by his wife, Gloria; sister, Lucy Shaw; and brothers,Ancelmo Gutiérrez, Santiago Gutiérrez and baby José Gutiérrez. He is survived by hissisters, Mary Simpson and Linda Ridenour; brother, Joseph Gutiérrez; daughters, JessicaMalone (William), Mariann Christy (Joseph) and Cynthia Naiman (William); grand-daughters, Jennifer Christy, Kathleen Lea (Michael), and Nicole Naiman; and grand-sons, Charles Malone, Stephen Christy, and Chad Naiman.

JOSE A. ROSARIOJosé A. “Tony” Rosario, 72, of Lorain, passed away Tuesday, September 3, 2013 in

his home from natural causes. He was born July 9, 1941 in Barceloneta, Puerto Rico. Hecame to Lorain in 1957. Tony retired from The Elyria Foundry. He worked there for over20 years. Tony enjoyed dominoes, fishing and traveling. He loved spending time withhis family.

He will be dearly missed by his sons José A. Rosario, Jr. and Andrés Domínguez bothof Lorain, Israel Domínguez of Avon Lake and Alberto Rosario of Elyria; daughtersDiana Domínguez of Allentown, Pennsylvania and Marisa Jenkins, Maribel, María andBienvenida Domínguez all of Lorain; brothers Radames and Ariel Rosario both ofBarceloneta; 20 grandchildren and one great grandson.

1960s, he played a pivotal rolein forming and shaping TheFarm Labor Organizing Com-mittee (FLOC). Currently, hemanages the Campaign for Mi-grant Worker Justice (CMWJ)Worker Center and continuesto advocate for migrants andimmigrants.”

“Honored US Marine Vet-eran Arturo Quintero receivedthree Purple Hearts, the Presi-dential Unit Citation, the Com-bat Action Ribbon and manyassorted service ribbons for histwo tours in Vietnam. He thenwent on to earn a bachelor’sdegree in Latin American Stud-ies and a Juris Doctorate fromThe University of Toledo.Throughout his accomplishedcareer, he has served as Manag-ing Attorney for ABLE, Execu-tive Director for the Toledo Fam-ily Health Center, and Associ-ate CEO for Northwest Psychi-atric Hospital. He also served asExecutive Officer to the Mayor,Commissioner of SpecialProjects, and is currently Assis-tant Prosecutor for the City ofToledo. The Sofia Quintero Artsand Cultural Center is namedafter Arturo’s late first wife, SofiaAlfaro Quintero. Fue el momento cumbrede la segunda edición anualdel Festival People enEspañol que, producido porsu esposo Emilio Estefan Jr.,también contó con una sólidaactuación de AlejandroFernández y un cierre dePrince Royce como invitadosorpresa.

Si la primeraedición del festi-val en 2012 tuvom o m e n t o sbrillantes sobre elescenario (conOlga Tañón,3BallMTY y LuisMiguel, entreotros) y una pobre presenciade los fanáticos en lasbutacas, este año estuvo cercade ser exactamente al revés,si no fuera por elprofesionalismo de Estefan,Fernández y el jovenbachatero dominicano.

Al principio del show yase notaba que laconcurrencia sería muchomayor (al final de la noche,por lo menos el 75-80% delos 11.000 asientos estabanocupados, a diferencia de lamitad el año anterior), pero sibien Carla Mauri y JencarlosCanela podrían habercantado en vivo, era claroque sus músicos simulabantocar cuando en realidad loque sonaban eran pistas. Estofue prácticamenteconfirmado por Mauri yCanela.

“En partes (tocamos envivo)”, dijo Canela a TheAssociated Press cuando se

manifestaciones de más de 20,000 maestros desde el pasado18 de agosto han trastornadoen un principio las actividadesde la capital del país, pero pocoa poco se han ido replicandoen diferentes estados. Lo cualha paralizado por completolas escuelas de los Estados deOaxaca, Chiapas y Guerreroprincipalmente. Todo paramanifestar su rechazo a laReforma Educativa aprobadapor el Senado.

En respuesta a esto,alumnos y padres de familia deOaxaca salieron también a lascalles para manifestarse y pedirel regreso de los maestros a lasaulas. En una escuela primaria,los padres de familia obligarona los maestros a dar clases ymontaron guardia para vigilarque cumplieran con suresponsabilidad. “No vamos adejar que sigan pasando losdías y nuestros hijos noestudien. Los maestros nohacían nada, se la pasabanperdiendo el tiempo entreellos; por eso tuvimos quetomar justicia por nuestracuenta”, dijo uno de los padresafectados. La sociedad seencuentra bastante molesta portodos los daños que estasmovilizaciones han causado.

Por su parte, los maestros através de las redes sociales hanasegurado que con la ReformaEducativa se avecina una grancrisis económica porque hay

millones de maestros en el paísque han obtenidos sus casas,autos, y necesidades básicas através de créditos pero ahora¿Qué sucederá con estosempresarios que ya no tendrána esos millones de profesoresde clientes? ¿Qué maestro searriesgará a sacar un auto?Ninguno, si ahora cada 6 mesesserá evaluado para saber simantiene su puesto o no.Mucha gente dice junto con elGobierno ¡Los maestrosBuenos si podrán! ¿Quién selos garantiza?

Esto es en respuesta a lasevaluaciones que contemplala nueva Reforma, losprofesores de nuevo ingreso—aquellos que seancontratados después de que laley entre en vigor— yreprueben las evaluaciones,serán castigados con la pérdidade su plaza. En cambio, losdocentes que actualmenteestán en activo seránremovidos de los salones declase pero no serán despedidos,sino que se les reasignará enotra área del servicio público(en tareas administrativas, porejemplo) o las autoridades losexhortarán a jubilarse. Este esel tema que más molestia hacausado entre los integrantesde la Coordinadora Nacionalde Trabajadores de laEducación (CNTE), quienesconsideran que esas medidasatentan contra sus derechoslaborales porque les harán

perder estabilidad en elempleo. Los líderes de lacoordinadora afirman que nose oponen a la evaluación, sinoa que ésta implique castigos.

Cabe destacar que enMéxico, el sindicato de mae-stros es el que tiene el controlcasi total del personalacadémico; lo que incluye elcorrupto sistema de venta yherencia de plazasmagisteriales, al que se atribuyegran parte del mal desempeñode las escuelas mexicanas, lascuales tienen costosrelativamente más altos y lospeores resultados entre los 34países que conforman laOrganización para laCooperación y el DesarrolloEconómico (OCDE).

Para expresar su rechazo ala nueva Reforma, los mae-stros se han manifestado frentea la Cámara de Diputados,Senado de la República, en lastelevisoras Televisa y TVAzteca, el Auditorio Nacional,la residencia oficial de LosPinos y han bloqueadoavenidas de acceso alAeropuerto Internacional dela Ciudad de México; entreotros puntos. Asimismo, hanamenazado conmanifestaciones en todo elpaís, mantener el plantón en elZócalo capitalino, y parosescalonados de labores.

La aprobación de laReforma

Hace unos días, el Senadoavaló con 102 votos a favory 22 en contra, la Ley Gen-eral del Servicio Docente. Lasleyes secundarias indispens-ables para que funcione lareforma educativa quedaronaprobadas en su totalidad enel Congreso mexicano y, paraque entren en vigor, sólo falta

que las promulgue elpresidente Enrique Peña Nieto,lo que se prevé ocurra en lospróximos días, según informóel propio mandatario.

Peña Nieto aseguró que suGobierno agotará las vías deldiálogo con la CoordinadoraNacional de Trabajadores dela Educación (CNTE), pero“no hay marcha atrás”.

La Reforma Educativa fuepresentada el 11 de diciembredel 2012 por el titular delPoder Ejecutivo Federal,Enrique Peña Nieto, y el día 20del mismo mes, fue aprobadapor la Cámara de Diputados ypor el Senado de la República.En febrero de 2013, la reforma

fue declarada constitucionalpor el Poder Legislativo Fed-eral, promulgada por elEjecutivo el 25 de febrero de2013 y publicada al díasiguiente en el Diario Oficialde la Federación.

Entre los elementos quecontempla dicha Reforma,se encuentran:

Primero. Se pretende crearel Sistema de ServicioProfesional Docente, el cualestará integrado por concur-sos de ingresos para docentesy para la promoción a cargoscon funciones de dirección yde supervisión en la educaciónbásica y media superior. Con

dicha creación seestarían fijandolos términos parael ingreso, lapromoción y lapermanencia en elservicio. Loscriterios paradeterminar lapromoción o elsistema dereconocimientosc o r r e s p o n d e r á nexclusivamente al mérito y ala preparación de cada mae-stro. Este esquema hoy esmanejado por el SindicatoNacional de Trabajadores dela Educación (SNTE), mismoque determina plazas, salarios,

cargos, etcétera. ElInstituto Nacionalpara la Evaluación dela Educación (INEE)tendrá atribucionespara evaluar eldesempeño yresultados delSistema EducativoNacional. Para esto,la reforma buscadotarlo de autonomíaconstitucional y conello otorgarlefacultades paradiseñar y realizar loscambios necesariosque vaya requiriendoel sistema educativo.Se buscará que elINEE esté formadopor personas conr e c o n o c i d a

capacidad y que sea un cuerpocolegiado el que realice laselección de estas, aunque elpresidente de la junta degobierno del INEE serápropuesto ante el Senado de laRepública por el titular delPoder Ejecutivo nacional.

Segundo. Se busca que laevaluación magisterial, enprimer lugar, no seapotestativa o voluntaria, sinoobligatoria para todos losmaestros; segundo, que laevaluación no sea pactable; ytercero, que tengaconsecuencias jurídicas, esdecir, el maestro que repruebela evaluación se tendrá que ir.Hay que recordar que en laúltima evaluación nacionalreprobó el 75 por ciento de losmaestros.

Tercero. Se crean lasescuelas dignas y escuelas detiempo completo con criteriosde calidad, equidad yautonomía de gestión de lasescuelas, es decir, se buscadarle a cada escuela, los mediosnecesarios para que cada di-

rector haga las mejoras deinfraestructura, compre losmateriales didácticos, equipea las escuelas, etcétera.

Cuarto. Se crea el Sistemade Información y GestiónEducativa. Este tiene comopropósito realizar un censo deescuelas, profesores yalumnos, con el fin decorroborar datos, porque porincreíble que parezca no sesabe con exactitud cuántasescuelas, alumnos, o maestroshay en el sistema educativomexicano.

Y quinto. Se quiereimpulsar el suministro dealimentos nutritivos y prohibirla comida que no favorezca ala salud de los educandos. Losalimentos que se proveerántendrán que cumplir con lasnormas oficiales de laSecretaría de Salud. Además,por mandato constitucional sebusca prohibir la comida‘chatarra’. Sin duda, una vezaprobada, esta será una de lasmás grandes e históricasreformas en México.

All children, regardless ofimmigration status, can attend afree public school in the UnitedStates. This right is guaranteedby law. In 1982, the United StatesSupreme Court decided a casecalled Plyler v. Doe. This caseinvalidated a Texas statute thatdenied enrollment in the publicschools to children not “legallyadmitted” in the country.

The Supreme Court said thatdenial of education violates notonly our political and culturalhistory, but also the Equal Pro-tection clause of the U.S. Consti-tution. Justice Brennan, whowrote the Supreme Court opin-ion, said, “Education providesthe basic tools by which indi-viduals might lead economicallyproductive lives to the benefit ofus all.

In sum, education has a fun-damental role in maintaining thefabric of our society. We cannotignore the significant social costsborne by our Nation when selectgroups are denied the means toabsorb the values and skills uponwhich our social order rests.”

What does the Supreme Courtdecision in Plyler v. Doe mean toundocumented children? Itmeans that public schools maynot:

- Deny admission to a studentduring initial enrollment or atany other time on the basis ofundocumented status;

- Treat a student differently toverify residency;

- Engage in any practices that“chill” or hinder the right ofaccess to school;

- Make inquiries of studentsor parents that may expose theirundocumented status.

UNDOCUMENTED CHIL-DREN HAVE THE RIGHT TOENROLL IN SCHOOL- WHATSCHOOLS CAN AND CAN-NOT REQUIRE?

• Are schools allowed to re-quire Social Security Numbers?

NO – According to the Pri-vacy Act of 1974, social securitynumbers are not required for en-rollment. While a school mayask for a number, it must explainat the same time that it does notrequire the number and that itwill assign a unique identifier toany student who does not have asocial security number.

• Are schools allowed to re-quire Birth Certificates?

NO - Birth Certificates can-not be required for enrollment.The Michigan Revised SchoolCode (MCL 380.1135(1)) pro-vides that a person enrolling inschool can have either (1) a cer-tified copy of the birth certifi-cate; OR (2) other reliable proofof the student’s identity and ageAND an affidavit explaining theinability to produce a copy of thebirth certificate. The RevisedSchool Code is flexible as towhat constitutes other reliableproof that could serve as an alter-native to a birth certificate.

Examples of documents thatcould be accepted by schools inthe alternative are:

- Church Record (baptismaldocument – showing date, placeof child’s birth, names of child’sparents);

- School Record (informationshowing date of admission,child’s date of birth or age at thetime, the place of birth, the namesof the parents);

- Census Record (state or fed-eral census record showing thenames, place of birth, date ofbirth, or the age of the personlisted);

- Affidavits (written state-ments sworn to or affirmed bytwo persons who were living at

the time and who have personalknowledge of the child’s birth).

• Are schools allowed torequire Immunization Proof?

YES – Under the MichiganCode (MCL 333.9208,333.9215, 380.1177), immuni-zations may be required beforea child can be permitted to enteror attend school. School dis-tricts may require that parents orguardians present documenta-tion at the time of registration ornot later that the first day ofschool that: (1) their child hasreceived all required doses ofvaccines OR (2) that their childhas received at least one dose ofeach of the required vaccinesand is waiting to receive thesubsequent doses.

Vaccinations may bewaived if there is a valid medi-cal complication or the parentshave opposing religious con-victions. The key issue withrespect to immunizations is thatchildren should not be treateddifferently because of their na-tional origin, English profi-ciency, or migrant status. Allchildren should be treatedequally under the schooldistrict’s policy. School districtsmay not require additional ordifferent immunizations forimmigrant or migrant children.

UNDOCUMENTED CHIL-DREN HAVE THE RIGHT TOPARTICIPATE ON SCHOOLPROGRAMS

All U.S. citizens andeligible immigrantsshould be able to accessfood stamps and other ben-efits without fear of familyseparation. However,Michigan’s immigrantcommunities may haveheard rumors of a new De-partment of Human Ser-vices (DHS) policy thatwould require DHS em-ployees to report anyonewho they are told is anundocumented immigrantto homeland security.There is no new change toDHS policy regarding re-porting undocumentedaliens to homeland secu-rity.

This is what Happened:Earlier this year,

Michigan’s Department ofHuman Services (DHS)told their employees thatstarting October 1, 2011,when individuals came into apply for food stamps orState Emergency Relief(SER), “any time a clienttells DHS that the client oranyone else in their homeis an illegal alien, the ille-gal alien has to be reportedto homeland security.”

Fear of this new policyspread rapidly through im-migrant communities, andadvocates across the stateimmediately responded bypressuring DHS to clarify

“Not in Michigan!”“Yes, in Michigan.”I have this conversation

several times a week. It startswhen I tell a communitymember, a lawyer, a politi-cian, or just about anyone,that I represent victims ofhuman trafficking. They as-sume my clients were vic-timized in India or Mexico,or maybe New York City orLos Angeles.

The reality is that there ishuman trafficking in all thoseplaces, but it is also righthere in Michigan. We knowhuman trafficking has oc-curred in metro Detroit, theU.P., and in rural communi-ties in western Michigan.

So, what is human traf-ficking? Human Traffickingis a form of modern day sla-very. Under U.S. law, humantrafficking is divided intolabor and sex trafficking.Labor trafficking is the ex-ploitation of a person forlabor or services throughforce, fraud or coercion. Sextrafficking is when a personis compelled to engage in acommercial sex act by theuse of force, fraud or coer-cion. However, if the personengaging in the commercialsex act is under 18, thenforce, fraud or coercion isNOT required. Most impor-tantly, human trafficking ISA CRIME, and anyone canbe a victim of this crime.

What does force, fraud,or coercion look like? Forcecan take many forms such asrape, beatings, or being con-fined to a small space. Fraudis when the trafficker tellsthe victim lies in order topersuade the victim to dowhat the trafficker wants.Common lies include falseoffers of employment, mar-riage, an education, or just abetter life generally. Coer-cion is any plan or patternintended to make the victimbelieve that if they do not dowhat the trafficker says,something adverse will hap-pen to the victim or thevictim’s family, friends, orcommunity.

Traffickers frequentlythreaten the victim or theirloved ones with physicalharm; threaten to call thepolice or use the law againstthem; tell victims that whatis happening to them is legalin the U.S. or the police arecorrupt and involved in thecriminal activity; or deprivevictims of basic needs suchas medical care or nutrition.

Who would possibly dothis? I can’t draw a picture ofthe typical trafficker be-cause it does not exist. Traf-fickers are U.S. citizens andforeign nationals; strangers

publicly that this is not theirnew policy. In response tothis reaction, DHS informedadvocates that they sent anemail to DHS managers ex-plaining that the new policyrequiring DHS staff to re-port undocumented aliensto homeland security wasincorrect and should be dis-regarded by all DHS em-ployees.

DHS’s ACTUAL Policy:DHS only reports an un-

documented alien to home-land security if they haveclear knowledge of thatperson’s undocumentedstatus. Generally, thismeans that the DHS em-ployee must physically seea deportation order issuedby an immigration judge.DHS will not ask to see adeportation order, and youshould never bring a depor-tation order for anyone intoa DHS office.

DHS policy and the CivilRights Act of 1964 strictlylimit any questions regard-ing the immigration statusof non-applicants who arein the same household asapplicants for benefits.

Undocumented, non-ap-plicant household membersshould not tell DHS any in-formation about immigra-tion status. It is not true thatDHS’s computer system

needs the immi-gration status ofnon-applicants toprocess the appli-cation for house-hold memberswho are applying.

How It WorksLet’s say you are an un-

documented parent withU.S. citizen children andyour household income islow enough to qualify forfood stamps for your U.S.citizen children. Becausethey are children, you mustgo to the DHS office to ap-ply for them. Though youare actually the person fill-ing out the forms, you are a“non-applicant” becauseyou are not applying forany benefits for yourself.

• DHS can ask you aboutthe status of any applicantsfor benefits. In this case,your children.

• DHS cannot ask youabout the immigration sta-tus of any non-applicants.In this case, that means youand any other non-citizenin your house who is notapplying for benefits. If DHSdoes ask, simply state: “I amnot applying for benefits.”It is not true that DHS’s com-puter needs your immigra-tion status to process theapplication for benefits.

and loved ones; rich andpoor; male and female. Mosttraffickers prey on those thatare vulnerable – without themost basic resources or pro-tections. Thus, traffickersoften prey on the vulnerabili-ties of children because theylack the same knowledge andresources as adults. Simi-larly, foreign nationals areoften victims because of lan-guage barriers, lack of a com-munity support system, orbecause they are in the U.S.without status. All of thesefactors are then manipulatedby the trafficker.

For instance, traffickerswill hold identifying docu-ments such as passports orvisas, making the victimentirely reliant on the traf-ficker.

What happens to a victimthat does not have status inthe U.S.? Foreign nationalvictims of human traffick-ing may be eligible for immi-gration relief. The U.S. gov-ernment created the T Visato assist and protect victimsof human trafficking. In or-der to be granted a T Visa theforeign national must be avictim of human trafficking;must be in the U.S. becauseof the trafficking situation;if over the age of 18, mustassist law enforcement in pur-suing criminal chargesagainst the traffickers; andwill suffer severe hardship ifremoved from the U.S. Ifgranted a T Visa, the victimbecomes eligible for servicesand other forms of immigra-tion relief.

What can you do? In therare case, all this may soundvery familiar because of yourown situation or someoneyou know. However, moreoften human trafficking isnot easily seen.

Thus, the best thing thatyou can do is to be aware ofyour surroundings - the sur-prisingly youthful girl paint-ing your fingernails; the bus-boy or cook at your favoriterestaurant that is not allowedto speak to customers; yourfruit that manages to stay thesame price as gas prices goup; the young woman wholives and works for the fam-ily next door and neverseems to leave the house byherself; the rather large groupof people living in the smallapartment next door that arepicked up and dropped off atthe same time every day, bythe same car – these are allpossible signs of human traf-ficking and one phone callmay be the key to freeingvictims.
