The EU ‘Mortgage CreditDirective’ comes into force in
March 2016 but can be backdatedby six months. The directive,which is in effect an extension ofthe mortgage affordability criteriathat was introduced last year, hasstringent rules to check whetherborrowers can afford theirmortgage deal not just now but ifinterest rates are to rise. Currentlylenders can bypass these checkswhen an existing homeowner isremortgaging but under the newEU rules, they won't be able to do so.

FEES TEMPLATES READY FOR DOWNLOADIN RESPONSE TO CONSUMER RIGHTS ACT
Aset of ‘fees templates’ havebeen created for lettingagents to download aheadof the legal requirement
to display details of all charges on websites and in offices fromMay 27 2015.
The Association of ResidentialLetting Agents has created thetemplates in response to TheConsumer Rights Act which makesthe requirement legal fromWednesday.
Official guidance, which hasbeen drawn up by the Departmentof Communities and LocalGovernment with input from theAdvertising Standards Authority,says what must be displayed areas follows:
“All fees, charges or penalties(however expressed) which are
payable to the agent by a landlordor tenant in respect of lettingagency work and propertymanagement work carried out bythe agent in connection with anassured tenancy. This includesfees, charges or penalties in
connection with an assuredtenancy of a property or aproperty that is, has been or isproposed to be let under anassured tenancy.”
However, an agent does notneed to publicise the rent payableto a landlord, the tenancy depositwhich is taken as security againstdamage or violation of thetenancy agreement, and any fees,charges or penalties which theletting agent receives from alandlord under a tenancy onbehalf of another person.
For example should a lettingagent recommend a gardener for aproperty and arrange to pass thefee from the landlord to thegardener without taking a cut oradding a fee for this service therewould be no requirement to
publicise the fee charged by thegardener.
The fees which should bedisplayed must be on show at theagent’s office in such as way as itwill be seen by customers. “Ideallysomeone walking into an agent’soffice should be able to see the listwithout having to ask for it and ifsomeone does ask it should beclearly on view and not hidden forexample in a drawer” says theguidelines.
The advice also emphasisesthat “the list of fees must becomprehensive and clearlydefined; there is no scope forsurcharges or hidden fees. Illdefined terms such asadministration cost must not beused. All costs must include tax.”www.arla.co.uk

Visitors to Brighton &Hove may be forgivenfor thinking that wehaven’t yet had a
chance to tidy up after lastmonth’s Artists Open Housesevent. Modern art around thecity has been imaginativelydecorated since around theyear 2000 by seagulls, rustingbalconies, and blockedhoppers. Promoted on GrandDesigns and by idealisticplanning officers and over-optimistic developers, onceplain facades, originallyblank canvasses, could easilybe mistaken for exhibits inthe Tate Modern.
Whether it be themansions of Tongdean andWithdean, or new homes inlittle industrial pockets inbuilt-up areas, propertiescontinue to receive thewhite render treatment.This goes for renovation,conversion and new-builds.In most cases, white renderis highly inappropriate.Many a decent house inTongdean and Withdean hasbeen spoilt in fact by acresof added render that isalready showing signs ofdeterioration.
The 1980s and 90s saw a resurgence of brick as the building materialof choice. This may well have been in response to the concrete of the1960s and 70s. Accordingly, the 2000s saw, and the current decadecontinues to see, white render as the standard finish – a seeminglymodern answer to the pastiche of the previous two decades.
In the right environment, white render is bright and clean. Theproblem is that our often harsh weather is not conducive to such anenvironment. Whereas brick, stone, glass, slate and zinc require littlemaintenance, white render requires painting every five years. Not all ofus have the time, money or inclination to do this.
The Regency period saw render promoted as a direct response to thecost andavailability ofstone.However, theirproduct wasfar superiorand thebuildingowners farwealthier.

With the general election behind us and a clearer directionahead for the housing industry, property specialist Leaders isurging the government to improve standards for the millionsof landlords and tenants in the
private rented sector (PRS) by bringing informal regulation of letting agents.
Leaders’ Chief Executive, Paul Weller,said: “More people and families than everbefore now use the PRS and the servicesof letting agents. Yet the vast majority areunaware that letting agents are notregulated by the government and thatanyone can set up a letting agency, withno experience, knowledge of lettings lawor client money protection in place.
“Letting agents can hold hundreds ofthousands of pounds in rent which theyare supposed to protect. But withoutregulation, there is no way to enforce thisand there have been countless cases ofletting firms losing their clients’ money,using it for their own ends, or completelydisappearing with it, leaving landlords and tenants badly out of pocket.Too many people have suffered at the hands of agents like this, as well asincompetent and unscrupulous agents who fail to provide a decentstandard of service.
“This needs to be tackled urgently,” Mr Weller argues, “and the onlyway to do so is to make it mandatory for agents to abide by an agreed
code of conduct, be professionally qualified with a sound knowledge ofthe laws governing lettings and to have client money protection andprofessional indemnity insurance in place.”
As it stands, only agents that are members of self-regulatingprofessional bodies, such as the Association of Residential Letting Agents(ARLA) and the Royal Institute of Chartered Surveyors (RICS), sign up to acode of conduct which protects consumers from bad practice. The rest can get away with cutting corners and as a result, can often afford toundercut good quality agents on fees to attract unwitting tenants andlandlords.
“The new Conservativegovernment has put forwardsome promising policies onhousing which we believe will begood for the market,” continuedMr Weller. “These include thepromise to build 200,000 newhomes which will be available ata 20 per cent discount to first-time buyers under the age of 40;and the launch of a new Help toBuy ISA for first-time buyerswhich will enable them to saveup a subsidised deposit to buytheir own home.
“There is now a goldenopportunity to make a positive difference to those renting and letting.Proper regulation is essential to stop rogue agents taking advantage ofthe thriving rental market. Good agents have been crying out for this foryears and, as the numbers of those renting and letting continues to rise,the need for it grows ever stronger.”www.leaders.co.uk
LH LETTINGS NEWSNEWLY ELECTED GOVERNMENT SHOULD MAKEREGULATION OF LETTING AGENTS A PRIORITY
As from last Thursday it is now a statutory duty for letting agentsto fully publicise the fees they charge to landlords and tenants.Under the Consumer Rights Act 2015, agents must prominentlydisplay a list of their fees at each of their offices as well as on
their website.Guidance for the new requirements has been issued by the
Department for Communities and Local Government with input from theAdvertising Standards Authority.
The guidelines state that: “All fees, charges or penalties (howeverexpressed) which are payable to the agent by a landlord or tenant inrespect of letting agency work and property management work carriedout by the agent in connection with an assured tenancy. This includesfees, charges or penalties in connection with an assured tenancy of aproperty or a property that is, has been or is proposed to be let under anassured tenancy.”
All fees must be shown inclusive of VAT but agents do not need topublicise the rent payable to a landlord or the tenancy deposit which istaken as security against damage or violation of the tenancy agreement.
The requirements will be enforced by Trading Standards and any agentthat does not comply could be fined up to £5,000.
“Lower penalties will only be applied in extenuating circumstancewhich will not include ‘I did not know about the law’ or ‘I did not knowwhat to do,’” said Sean Hooker, head of redress at the Property RedressScheme. “The fees should be clear and specific without surcharges orhidden costs. Generic terms such as ‘administration fee’ are no longeracceptable and all charges should be displayed inclusive of tax.”
Letting agents are now also required to display which of the threeredress schemes they have joined (The Property Ombudsman, TheProperty Redress Scheme or Ombudsman Services: Property) andwhether they have Client Money Protection (CMP).
