Notes for Prospective Applicants

This document contains information about ongoing / forthcoming recruitment exercises for magistrates in England and Wales.

Please note:

Magistrates are recruited by local advisory committees. Recruitment is based on the needs of the courts in each area. The need to recruit new magistrates is generally reviewed on an annual basis.

Applicants are expected to be living or working in, or reasonably close to, the area in which they wish to serve.

If you are interested in becoming a magistrate, you can use this document to find out if recruitment is taking place in your local area.

Advisory committees may close recruitment campaigns early if they receive a sufficient number of applications prior to the closing date. Contact the relevant committee if you have a query about their recruitment campaign.

Please do not submit an application if your local advisory committee is not currently recruiting.

Family Courts are ‘closed courts’ – they are not open to the public so it will not be possible for you to visit and observe a family court. Instead you are required to familiarise yourself with publicly available information about the family court to ensure that the role is right for you. There is a link within the guidance notes which will take you to the available material which can be viewed on the website at:

www.gov.uk/government/publications/become-a-magistrate-application-form-guidance-notes

Applicants are expected to be living or working in, or reasonably close to, the area in which they wish to serve as you will be required to demonstrate that you have a good knowledge and understanding of the social issues in the local area, in particular the causes and effects of crime for applications to the criminal court and the complexities

It is the applicant’s responsibility to ensure that their referees are willing and able to supply the necessary reference within the timeframe given.

Candidates invited for interview will be expected to demonstrate a good knowledge and understanding of social issues in the local area in which they wish to serve, in particular the causes and effects of crime. This would typically be gained by living or working there.

The Lord Chancellor’s expectation is that magistrates will aim to serve for a minimum of five years and be in a position to offer that commitment. Magistrates are expected to sit a minimum of 13 full days per year and to sit regularly throughout the year. The average sitting for the Bench is 15 days per year.

Applications are particularly welcome from members of groups currently under-represented amongst the magistracy. That includes members of Black and Minority Ethnic communities, people under the age of 50, people from non-managerial or professional occupations, and people with a disability who are able, either unassisted or with reasonable adjustments, to carry out the full range of a magistrate’s duties.

You will also be required to disclose all details of any court proceedings that you may have been subject to, including road traffic penalties and any spent convictions.

You will also be required to provide three references and these must be submitted to the Advisory Committee in advance of your interview. It is your responsibility to ensure that your referees are aware of your request and submit their reference within time. The Advisory Committee to which you apply WILL NOT chase outstanding references.

Family Courts are ‘closed courts’ – they are not open to the public so it will not be possible for you to visit and observe a court. London has a temporary pause on receiving applications. Following a change to the recruitment procedures, it has been necessary to pause the application process temporarily whilst existing applications under the previous system are processed.

Currently, across London, we are aiming to fill in excess of 300 vacancies and we are processing a large number of applications already received for these vacancies.

We expect that London will require a steady flow of new magistrates for the foreseeable future.   Alongside the current recruitment campaign, we are reviewing the future numbers of family and criminal court magistrates required.   Precise numbers in each of the London Local Justice Areas and in the Family court will be available on this website soon.   It is anticipated that a substantial number of new magistrates will be needed.   It is expected that details of the new recruitment campaign will be available on this page in the coming months. Thank you for your interest in the magistracy in London.   Please continue to check these webpages for future details of vacancies.

Additional Information:

Please refer to the Guidance for Prospective Applicants and pre-application checklist (see page 2 of the application form) before completing your application form. We would especially draw your attention to a) the requirement to observe a magistrates’ court before applying b) potential disqualifications from appointment and c) the requirement to disclose details of any court proceedings that you may have been subject to, including road traffic penalties.

Due to the current COVID-19 pandemic you only need to undertake ONE observation of a Magistrates court. Please contact the Advisory Support Team (see below).

You are advised that your application will be accepted and considered but it may be some time before this is processed. All applications are required to be sifted by the Advisory Committee. You will be notified if you are successful at this stage and if you are to be invited for interview. Please be advised that no face to face interviews will take place until we are advised that it is safe to do so, but “remote” interviewing may be possible.

Additional Information regarding Court Observations:

Page 80: Magistrates' advisory committee: recruitment information€¦  · Web viewCompleted application forms should be returned in word format by e-mail (preferred) to: CL-Advisory@justice.gov.uk.

COVID-19 – the requirement to attend a Magistrates’ Court twice in the twelve months prior to submitting an application to join the criminal panel is temporarily suspended.

Applicants to join the criminal panel are now required to:

attend a Magistrates Court once AND to find out more about the adult court, you must carry out the following

directed research.                                                                                            https://www.youtube.com/watch?v=fCybrBaKj8s

                                              https://www.youtube.com/watch?v=M4CIveEDtmk

https://www.judiciary.uk/about-the-judiciary/who-are-the-judiciary/judicial-roles/magistrates/

If you are invited to interview, the interview panel will ask you to talk about what you saw during your visit and what you understand from your research.

Visit reasonably close to the time that you intend to submit your application, preferably no more than six months before but definitely no more than twelve months before submitting your application.

Your visit must be in connection with your application. It will not be sufficient to have visited a magistrates’ court for a different reason.

Due to COVID-19 social distancing requirements court observations can be arranged virtually via the Cloud Video Platform (CVP). CVP is a secure digital network that creates a ‘Virtual Courtroom’ in which all parties can attend from any internet-connected video & audio capable computer, laptop, phone or tablet.

CVP allows all participants to engage within the virtual courtroom in a similar way to the physical courtroom.

Please email [email protected] to arrange a suitable date, if you need to do this to facilitate the court observation.

The offer of an interview is subject to three references being returned following receipt of the application form; your referees should have known you for a minimum of three years (with the exception of an employer) and know you well enough to be able to give their opinion on how you meet each of the key qualities.

This would typically be gained by living or working in that Local Justice Area.

Northumbria Recruitment Advisory Committee is recruiting magistrates for Family courts from 1 March 2020.

There is no closing date for receipt of applications, however if you wish to be included in the first intake your application must be received by 31 December 2020.

Applications received after 31 December will be considered in the first intake in 2021 and must be received by 30 April 2021.

That includes members of Black and Minority Ethnic communities, people under the age of 50, people from non-managerial or professional occupations, and people with a disability who are able, either unassisted or with reasonable adjustments, to carry out the full range of a magistrate’s duties.

Please refer to the applicant’s notes of guidance before completing your application form. We would especially draw your attention to potential disqualifications from appointment.

You will also be required to disclose details of any court proceedings that you may have been subject to, including road traffic penalties. You will also be required to provide three references and these must be submitted to the Advisory Committee in advance of your interview.

Please note:

Due to the present situation with COVID-19, we have been forced to make some changes to our current recruitment process.

Family recruitment – the current campaign has now closed. Those of you who were not able to apply at this present time, please be reassured that a further campaign for family applicants will be launched on the 1st January 2021.

Crime recruitment – the campaign opens on the 1st September. The requirement for court observations has temporarily been reduced to one, with additional digital research.

The Lord Chancellor’s expectation is that magistrates will aim to serve for a minimum of five years and be in a position to offer that commitment. Magistrates are expected to sit a minimum of 13 full days per year and to sit regularly throughout the year.

Page 128: Magistrates' advisory committee: recruitment information€¦  · Web viewCompleted application forms should be returned in word format by e-mail (preferred) to: CL-Advisory@justice.gov.uk.

Application Process

Applications are particularly welcome from members of groups currently under-represented amongst the magistracy. That includes members of Black and Minority Ethnic communities, people under the age of 50, people from non-managerial or professional occupations, and people with a disability who are able, either unassisted or with reasonable adjustments, to carry out the full range of a magistrate’s duties.

Please refer to the applicant’s notes of guidance before completing your application form. We would especially draw your attention to:

x) for family applications – the requirement to conduct the research signposted in the applicant guidance;

xi) for crime applications - the requirement to observe a magistrates’ court at least twice within the 12 months before applying; (See above)

xii) potential disqualifications from appointment.

Please note: you cannot apply to both family and crime.

No special arrangements need to be made in respect of visiting a magistrates’ court. You need simply go to a convenient courthouse, but it would be helpful if you identified yourself on arrival as a prospective magistrate so that you can be directed to an appropriate courtroom. To find the address of and directions to a magistrates’ court, please go to https://courttribunalfinder.service.gov.uk/search/

To assist with the type of sittings:

For crime applications, please contact the court to arrange an observation. You may be advised to observe remotely using videolink technology.

Applicants are expected to be living or working in, or reasonably close to, the area in which they wish to serve as you will be required to demonstrate that you have a good knowledge and understanding of the social issues in the local area, in particular the causes and effects of crime for applications to the criminal court and the complexities and diversity of modern family relationships for applications to the family court.

Selection Process

Application forms will not be accepted until the official opening date announced above. Any applications received before this date will not be returned and will be disregarded.

Applications will be sifted on receipt. If you are unsuccessful at sift stage you may reapply in the next round of recruitment. Please read the Guidance Notes for Applicants carefully to assist you to complete your application form in preparation for a sift.

Page 129: Magistrates' advisory committee: recruitment information€¦  · Web viewCompleted application forms should be returned in word format by e-mail (preferred) to: CL-Advisory@justice.gov.uk.

The offer of an interview is subject to three references being returned following receipt of the application form; your referees should know you well enough to be able to give their opinion on how you meet each of the key qualities.  It is the applicant’s responsibility to ensure that their referees are willing and able to supply the necessary reference within the timeframe given.

Applicants may not be invited to interview where: -

Application forms are incomplete; Criminal court observations/Family court digital research has not been undertaken; Applicants are disqualified from being appointed a Magistrate (please refer to

guidelines); References from the applicant’s referees have not been received by the required date,

reasonable efforts having been made to obtain them; The applicant in question applied in a previous recruitment campaign within the last 2

years and did not demonstrate the key qualities at that time.

The selection process involves two interviews on the same day which are scheduled to take place on dates to be advised. Remote digital interviews may be offered in order to comply with social distancing measures. Appointments are made by the Senior Presiding Judge.
