Background

Marion County Environmental Services is required to perform annual environmental monitoring at the

AMENDMENT 2 to the CONTRACT FOR SERVICES

between MARION COUNTY and SCS ENGINEERS

PW-1139-14 This Amendment No. 2 to the Contract for Services (as amended from time to time, the “Contract”), dated April 9, 2014 between Marion County, a political subdivision of the State of Oregon, hereafter called County, and SCS Engineers, hereafter called Contractor. The Contract is hereby amended as follows (new language is indicated by underlining and deleted language is indicated by brackets): 1. INTRODUCTION This Contract is between Marion County (a political subdivision of the State of Oregon) hereinafter called County, and SCS Engineers hereinafter called Contractor. The Contractor agrees to provide the services as specified in Part II of this contract, for the period Execution through June 30, [2020]2021. Upon the expiration of the [original] term, this contract may be renewed for up to [two (2)] one (1) additional one-year terms at the rates provided in the original contract. Upon the first renewal period the rates may, upon written request from the Contractor, be adjusted based on the latest [Portland] Western Consumer Price Index available at the beginning of each option year, but the increase shall not exceed 3% of the previous year’s rate. It is understood that this contract between the County and the Contractor is subject to the availability of local, state, and federal funds. 3. PAYMENT OF CONTRACT a. Contract amount The sum of [$610,497.80] $713,914.00 is the maximum payment obligated by the county under this contract, of which $85,252.80 is to be held as contingency reserve. Beginning July 1, 2020, The COUNTY agrees to pay the CONTRACTOR in accordance with the Exhibit E - Table 1 [Table 3] – Breakdown of Estimated Project Costs and Fee Schedule, contained in the CONTRACTOR’s proposal, which is attached to and herby made part of this Contract as Exhibit E, 2020-2021 Contract Extension for Environmental Monitoring and Reporting Services for the North Marion County Disposal Facility and Brown’s Island Landfill, dated March 30, 2020. Use of the contingency reserve shall be at the discretion of the County and shall only be valid for work not identified in Exhibits [B or C] B, C, D or E. The Contractor shall not perform any work that would require payment from the contingency reserve without prior written authorization from the County.

Except as expressly amended above, all other terms and conditions of the original contract are still in full force and effect. Subject: 2020-2021 Contract Extension, Marion County Contract for Services Part I, Environmental Monitoring and Reporting Services for the North Marion County Disposal Facility and Brown’s Island Landfill

Dear Mr. Johnson,

This letter presents SCS Engineers’ scope of work and costs in support of a 1-year contract extension to perform environmental monitoring and reporting services in 2020 and 2021 for North Marion County Disposal Facility (NMCDF) and Brown’s Island Landfill (BIL). SCS Engineers (SCS) currently conducts these services pursuant to Marion County Contract for Services Part I (Contract), executed on April 9, 2014, expired June 30, 2019. The Contract allows the option for 1- year extensions up to a maximum of 3 additional years. Marion County (County) authorized Amendment 1 as the first-year extension of the Contract for the 2019-2020 monitoring year services. This submittal is related to the second-year Contract amendment for the 2020-2021 monitoring year services.

This letter and attachments are similar to what were provided to the County for authorization of Amendment 1 of the Contract. Attachments include Table 1 that summarizes costs by task for 2020-2021 monitoring year services, and an updated Certificate of Liability Insurance. The following sections describe (1) contract extension modifications, (2) scope of work, and (3) estimated fees.

Contract Extension Modifications The execution period for the second-year Contract amendment, covered in this letter, will be July 1, 2020, through June 30, 2021. The County requested the following additions to the second-year amendment scope and budget to align with the execution period ending June 30, 2021.

• The spring 2020 monitoring events for both sites performed from March to June 2020should be included with no consumer price index (CPI) cost increase.

• For work required between July 1, 2020 and June 30, 2021, the fall 2020 and spring 2021monitoring events for both sites should be included with a CPI cost increase.

These modifications will result in a higher total cost increase for the second-year amendment above strictly a CPI cost increase. The third and final Contract amendment will include the 2021 fall and 2022 spring monitoring events.

The following are additional considerations that affect the scope and cost for the second-year contract amendment.

• Fieldwork for the spring 2021 (and spring 2022) monitoring event for NMCDF must be performed during April or May. The monitoring event includes not only the fieldwork activities, but also analytical testing, potential reanalysis or resampling, quality control review of analytical data, and data evaluation. Consequently, this schedule may result in not fully completing the monitoring event activites before the end of the execution period of June 30, 2021. If this situation occurs, SCS will coordinate with the County to determine the funding mechanism to complete the monitoring event activities in a timely manner to meet, if needed, regulatory deadlines for resampling and reporting.

• The fall 2020 monitoring event for both sites includes analyzing environmental samples for a comprehensive list of parameters (referred to as Permit Parameters) that is required during even-year fall events. The first-year Contract amendment (Amendment 1) did not include this requirement and therefore the analytical costs were lower during the Amendment 1 execution period. Therefore, additional costs are included for the fall 2020 monitoring events for added analytical testing and data evaluation.

SCOPE OF WORK The scope of work presented in SCS’s proposal to Marion County (the County) dated November 20, 2013 (Proposal), prepared in response to the County’s public request for proposal, will remain essentially unchanged for the second-year Contract amendment. The scope of work is divided into two tasks and associated subtasks as follows: Task 1 for the NMCDF with associated subtasks 1.1 to 1.6, and Task 2 for the BIL with associated subtasks 2.1 through 2.6. The subtasks summarized below for each landfill facility are similar in nature but specific to their respective sites.

Task 1 – North Marion County Disposal Facility Monitoring and Reporting Subtask 1.1 – Spring and Fall Field Sampling Events

The scope of work presented below addresses semiannual groundwater, surface water and leachate management system (LMS) liquids monitoring at the NMCDF.

• Provide written notification to the Oregon Department of Environmental Quality (DEQ) at least 10 days before starting each monitoring event.

• Coordinate with the contract laboratory (ALS Environmental [ALS]).

• Measure groundwater levels in all monitoring wells and piezometers at the NMCDF, the former Land Application Area, and the 1973 Landfill Site.

• Collect environmental samples (groundwater, surface water, and leachate management system liquids) at the locations and frequencies specified in the EMP (Table 2 of the Sampling and Analysis Plan).

• Submit the groundwater samples (and quality control [QC] samples) to ALS for analyses consistent with the requirements specified in the EMP.

Subtask 1.2 – Data Management, Review, and Regulatory Evaluation

SCS will implement the field and laboratory data review and tracking process it has successfully used previously for the NMCDF and BIL monitoring as described below.

• Coordinate with ALS to ensure testing requirements are met and the analytical data meet QC objections. If necessary, based on preliminary results, a data quality review (DQR) will be requested of ALS to formally review results that differ from historical results or that exceed certain regulatory requirements or quality assurance/quality control (QA/QC) criteria.

• Maintain records of field and laboratory documentation and quality assurance/quality control (QA/QC) activities. SCS will receive from ALS electronic data deliverables (EDDs) of laboratory data that will be directly downloaded to the existing Microsoft Access database. The database will be maintained and updated by SCS after each monitoring event.

• Perform QA/QC review and regulatory evaluation of analytical data in accordance with Section 5 (Review and Reporting of Water Quality Results) of the Water Quality Monitoring Plan.

• Provide an email summary to the County presenting results of the data review and regulatory evaluation, including recommendations for resampling if warranted.

Subtask 1.3 – DEQ Split Sampling and Reporting

A DEQ-split sampling event is scheduled to be performed during the fall 2020 monitoring event. This task includes additional field coordination with DEQ (with 45-day notification) and ALS that are not part of the routine field monitoring events, and preparation of a DEQ-required report documenting the split sampling field activities and laboratory analytical results. The report will be prepared in accordance with the requirements of the SWDP and submitted to DEQ within 90 days after the split sampling event is completed, as required by the SWDP.

Subtask 1.4 – Annual Environmental Monitoring Report Prepare the 2020 annual environmental monitoring report (AEMR) for submittal to DEQ by February 1, 2021. The AEMR will include, at a minimum, those elements described in Section 5 of the Water Quality Monitoring Plan and Sections 18.4 and 18.5 of the SWDP, including a statement of compliance. A draft copy of the AEMR will be submitted to the County for internal review and comment. After incorporating the County’s review comments, four final report copies and an electronic copy will be submitted to the County.

Subtask 1.5 – Environmental Monitoring Plan Update

The facility’s Solid Waste Disposal Site Permit indicates that the existing Environmental Monitoring Plan (EMP) will be updated when requested. Given that the existing EMP for the NMCDF was last updated in 2013, it is possible that DEQ will require an update EMP in the near future. Therefore, this task is retained for the 1-year contract extension; however, funds for this task will not be expended if DEQ does not require an EMP update during the monitoring year.

This task assumes that an updated EMP will retain the basic structure, format, and content of the existing EMP, with only minor revisions required by DEQ to reflect any monitoring program modifications. A draft copy of the EMP will be submitted to the County for internal review and comment. After incorporating the County’s review comments, final copies of the EMP will be submitted to the County and DEQ.

Subtask 1.6 – Project Management and Meetings

This task involves coordinating and managing project activities and performing project administrative services. Tasks include scheduling and overseeing monitoring, non-routine client or regulatory correspondence, maintaining communications with the County, DEQ, and ALS, preparing and reviewing invoices, and reviewing laboratory invoices. This task also includes funds for providing technical assistance and recommendations to the County as needed to address monitoring or reporting issues that may arise (as requested in RFP Addendum 1), and for conducting two project meetings during the 5-year contract period with County staff in Salem.

Task 2 – Brown’s Island Landfill Monitoring and Reporting Subtasks 2.1 – Spring and Fall Field Sampling Events

The scope of work consists of groundwater monitoring only. The following tasks will be performed.

• Provide written notification to DEQ at least 10 days before starting each monitoring event.

• Coordinate with the ALS.

• Measure groundwater levels in all monitoring wells and piezometers at BIL, and at three surface water measurement points within the nearby slough and the Willamette River.

• Collect groundwater samples at the locations and frequencies specified in the EMP (Table 3 of the EMP) and detailed in the attached Table 2.

• Collect QC samples consisting of field duplicate samples (1 per day of sampling) and trip blanks (1 per day of sampling if VOC containers are collected), consistent with the EMP.

• Submit the groundwater samples (and quality control [QC] samples) to ALS for analyses consistent with the requirements specified in the EMP.

Subtask 2.2 – Data Management, Review, and Regulatory Evaluation

This subtask will be performed as described above under Subtask 1.2.

Subtask 2.3 – DEQ Split Sampling and Reporting

A DEQ-split sampling event is scheduled to be performed during the fall 2020 monitoring event. This subtask will be performed as described above under Subtask 1.3.

Subtask 2.4 – Annual Water Quality Monitoring Report

This subtask will be performed as described above under Subtask 1.4.

Subtask 2.5 – Environmental Monitoring Plan Update

The existing EMP was updated in March 2013, and DEQ may request an updated EMP be submitted in the near future because the facility’s closure permit was renewed in 2015. Therefore, this task is retained for the 1-year contract extension. The scope of work and costing assumptions for this subtask will be consistent with those previously described above under Subtask 1.5. Funds for this task will not be expended if DEQ does not require an EMP update during the monitoring year.

Subtask 2.6 – Project Management and Meetings

This subtask will be performed as described above under Subtask 1.6.

ESTIMATED COSTS The Contract specifies that fees for the 1-year extensions can be adjusted based on the latest Portland Consumer Price Index available at the beginning of each option year, but the increase shall not exceed 3.0 percent of the previous year’s rate. Publication of a CPI for Portland was discontinued by the U.S. Bureau of Labor and Statistics (BLS) in 2018. Using data available from BLS for the western region for population less than 2.5 million, a CPI of 2.8 was used to develop the 2020-2021 monitoring year budget. Table 1 presents a summary of task budgets for the 2020-2021 monitoring year based on a 2.8 percent increase from the 2019-2020 monitoring year task budgets.

The original scope of work included two DEQ split sampling events during the 5-year monitoring period. The 1-year budgets assume one DEQ split sampling event per site at one-half of the original budget. Funds will not be expended if the DEQ does not require split sampling during the monitoring year.The original scope of work assumed this task would be performed once during the 5-year monitoring period; therefore, no change in the 1-year budget is needed. Funds will not be expended if the DEQ does not require an updated EMP during the monitoring year.

Duties In The Event Of Occurrence, Offense, Claim Or Suit of Section IV – Commercial General Liability Conditions: The additional insured must see to it that: 1.
