    It’s no secret that settling disputes withyour ex afer you’ve split can be difficult.And where children are involved, you can’t

     just walk away rom each other, as you’llboth want to be involved in the kids’ lives.

    Going to court to sort things out is notalways the best. And with accusations yingback and orth and the adversarial nature othe whole exercise, it can result in increasedbitterness and poison an already broken

    relationship urther, no matter who “wins.”

    But there’s some good news. Te newamily law that’s been around or a coupleo years now is rereshing. It encouragesother preerred ways o dealing with amilylaw disputes, with court as only a last resort.Tese other options offer a wide spectrumo approaches or sorting things out sothere’s a better chance you each get what’smost important to you and the childrencome out ahead.

    Here’s a quick rundown.

     Mediation: Te two o you agree toengage a neutral individual, who must beproperly qualied and trained as a mediator,to help you negotiate compromise solutionsto thorny issues. She will help you seewhat’s key to each o you, so that you cansettle on a solution that works or you both.Unlike a judge or an arbitrator, a mediatordoesn’t hand down a decision or award,

    so there is no imposed solution. Mediatedsolutions, perhaps because mutuallyagreed, thereore tend to stick. Mediation isrelatively inormal, and can be surprisinglysuccessul.

    Arbitration: You both agree to engagea neutral individual, who is a properlyqualied and trained arbitrator, to listen

    to both sides. Te arbitrator then makes adecision, called an “award,” deciding thetough issues beore her, like a private judge.Tis is a more ormal process, though lessso than court, and the arbitrator’s decisionis binding on both o you.

     Mediation/Arbitration: Tis is a combi-nation o mediation and arbitration. Tetwo o you agree to try, with the help o theneutral mediator/arbitrator, to work out a

    compromise solution. But should that ail,the two o you also agree that the mediator/arbitrator can make an arbitration award,which is binding on both o you. So unlikemediation, there can’t be a deadlock, andunlike arbitration, there’s a better chance ata negotiated compromise up ront.

    Parenting Coordination: Tis can comeinto play where there’s a separation agree-ment or court order which covers parent-ing arrangements, but the two o you havecontinuing conict about how to carrythem out. Pick-ups and drop-offs, suitablerecreational activities, birthday parties onthe other parent’s time, play dates, the startand end dates o holidays like spring break(Friday or Monday?), are just some o themore requent ashpoints. A properly qual-ied and trained parenting coordinator, ap-pointed by mutual agreement or the court,acts as a mediator/arbitrator to try andwork out a mutually acceptable solution or,i that ails, makes a “determination” that isbinding on both o you.
