WHATS NEW IN BRIARGATE

BRIARGATE COMMUNITY PRIDE Where Is It?

Do any of you remember Briargate in the 70s and 80s and how everyone wanted to move into this area? What happened? Homeowners moved out and into newer areas/communities leaving their homes to be rented out and purchased by investors. The same newer areas/communities are just like Briargate back-in-the-day. Where is Briargates PRIDE!

Lets identify Pride. What is Pride? Simply Pride is an emotion that carries two common meanings.

1. Negative connotation, Pride refers to an inflated sense of ones personal status or accomplishments which is often used synonymously with hubris (extreme pride).

2. Positive connotation refers to a satisfied sense of attachment toward ones own or anothers choices and actions, or toward a whole group of people.

Trash is thrown all over the neighborhood, TVs, mattresses, tires, windows are broken at vacant houses, lawns are not maintained, inoperable cars in streets and driveways, people hanging out on the corners and at corner stores.

Does anyone care anymore or are we subjective to the times? I believe we can make a difference by joining together as a community. UNITY is Briargates STRENGTH. Lets restore our PRIDE back! Lets take control of our NEIGHBORHOOD now, not LATER! Briargate depends on YOU (the homeowner) to make the DIFFERENCE! GET INVOLVED IN YOUR COMMUNITY!!

BRIARGATE HISTORY

Engineer-Turned-Lawyer Stimley

How many of you have heard or read about Sherman Stimley? An article was written by the Houston Chronicle on February 10, 2011 regarding Sherman Stimley. The article states the following:

Sherman Stimley was born in Chicago and raised in Jackson, Miss., a strong and tenacious mother had four children (all obtained a law degree), three of whom attended Harvard Law School simultaneously, and one child who attended University of Texas. Stimley started his professional life in Houston as a chemical engineer with Exxon after graduating from the University of Kansas in 1967.

A 1987 Chronicle profile of Stimleys mother describes how his sister encouraged him to enroll at Harvard Law School after she had been admitted in 1968. Stimley and his brother, Frank, were both admitted in 1971. For a year, they and their sister Pernila were at the prestigious school simultaneously. Another sister, Charlene, chose to study law at the University of Texas.

In 1974, Stimley joined Vinson & Elkins as the firms first African-American associate, according to a company history. Striking out on his own in 1985, he opened the citys first African-American firm consulting exclusively in tax-exempt bond law.

The Houston Public Library, knowing he was an advocate for libraries, named a branch for him after his death in 1997. The Sherman Stimley Blue Ridge Neighborhood Library is located at 7007 W. Fuqua, Missouri City, TX.

Briargates Leadership is in the process of obtaining a historical marker for Mr. Stimley as a memorial reminder of his contributions to Briargate. This will demonstrate Briargates Pride and History!

Our Community Garden

Briargate recently slated community land for use of a community garden at West Fuqua and Blueridge.

From the Desk of Houston City Council, Larry Green

The Houston City Council passed Council Member Greens initiative to establish a Tax Increment Reinvestment Zone (TIRZ #25) for Hiram Clarke/Fort Bend Houston Communities. The zone consists of approximately 4,533 acres 1,422 acres within Fort Bend Houston (Briargate, Ridgemont, Ridgegate, and Green Valley Estates). Tax increment financing is a tool used to finance public improvements within a defined area. The improvements should enhance the Fort Bend/ Houston area and attract new investors to our area as a result of improvements which include new street(s), water distribution facilities, wastewater collection facilities, storm drainage improvements, parks and recreational facilities, and economic development to enhance new and first-class business amenities to the Fort Bend Houston area. Funding will come from the additional tax dollars generated in the area as a result of growth in real property value in the zone. This is a significant achievement for our area and will greatly enhance our effort to improve the Briargate Community.

BYLAW UPDATES

Recently a meeting was held to begin the process of updating our community bylaws. This is a task that should involve the community and you are encouraged to note upcoming meetings on the marquis and attend these very important meetings updating our governing documents.

Fines Solid Waste Management Department (SWMD)

Many of the homeowners in Briargate are not adhering to the Solid Waste Fines.

Violations of any provisions of the Solid Waste ordinance is punishable upon first conviction by a fine of no less than $100.00 or no more than $2,000. Each subsequent conviction is punishable by a fine of no less than $250.00 or no more than $2,000.

Each day that any violation continues is punishable as a separate offense. To report violations or to file a complaint, call 713-837-0311 from your cell phone or 311 from your land line phone.

Fines are enforced and assessed by the City of Houston and Briargate Community Improvement Association.

Guess What Time It Is?

It is SUMMERTIME!! Time to open the swimming pool at Blue Ridge and Briargate!! Splash Day will start June 9, 2014 at 10:00 a.m. until 5:00 p.m.

Food and refreshments will be served from 12:00 p.m. until 2:00 p.m. Welcome to Summer !

Regular pool hours are Monday through Saturday, 10:00 a.m. until 12:00 p.m. and reopens at 2:00 until 5:00 p.m.

REMEMBER SAFETY SWIMMING RULES!!

1. Must be current on HOA Fees

2. Must have current pool tags

3. No food or drink in pool area.

4. No horseplay

5. No foul language

6. No running

7. No loud music of any kind

8. Children under 12 must be accompanied by an adult while at the pool

Backyard BBQs

Summertime everyone enjoys a backyard BBQ. Here are some safety tips to enjoy your summer without hazard.

Safety for Gas Grills.

1. Inspect cylinder of your propane tank for bulges, dents, gouges, leaks, corrosion or evidence of extreme rusting.

2. Be sure gas hoses are moved away from any dripping grease or hot surfaces.

3. Never bring your propane tank inside your home or garage.

4. Never dispose of your propane tank by throwing it in the trash.

5. Never use cigarettes, lighter, or matches near your gas grill.

6. Never bring propane tank(s) indoors, and never store spare gas container under or near your grill.

Safety for Charcoal Grills

1. Operate charcoal grills only outdoors, never inside an enclosed area.

2. Do no wear loose clothing, especially long sleeves, while grilling.

3. Charcoal grill tend to flare up, so keep a fire extinguisher handy.

4. Use charcoal lighter fluid to light new coals only; do not use it on coals that are already lit.

Remember: It is always best to BBQ in your BACKYARD to avoid these hazards.

Maintaining Lawns

Section 3.7 Lot and Building Maintenance

The Owner(s) and/or occupant(s) of all Lots shall at all times keep all trees, bushes and shrubs neatly trimmed; keep weeds and grass thereon cut and edged, which shall not be allowed to grow more than six inches (6) in height; otherwise, maintain, and use such lots in a sanitary, healthful and attractive manner.

Care-Giving Facilities

Section 3.2 No Lot shall be used for the operation of a boarding or rooming house, a residence for transients, half-way house, day-care center, treatment facility, or residence of unrelated individuals who are engaging in, undertaking, or participating in any group living for rehabilitation, treatment, therapy, or training with respect to previous or continuing criminal activities or convictions, alleged criminal activities, alcohol or drug dependency unless any such facility is otherwise allowed by the terms of state or

federal law negating the provision of restrictive covenant prohibiting the same.

Window Coverings

Section 3.13 Unless otherwise approved by the Architectural Committee, windows in Residential Dwellings shall not be covered with untraditional window coverings, including by way of illustration, but not limitation: foil; boards; bed sheets; newspaper; paper or cardboard.

Property Lines

Question: My neighbors tree hangs over my property line. What can I do?

First and foremost, you have a right to maintain your property. If that tree is threatening your house, landscaping or any other identifiable asset, you have legal right to maintain the tree to protect your property.

The key word here is maintaining the tree. If you compromise the life of the tree without just cause your neighbor will have a right to come after you.

One other important factor is that ownership of the tree is given to the person who owns the property where the trunk resides. If one of your neighbors trees has branches hanging on your side of fence, he can still remove the entire tree even through part of it is over yard. Trespassing is a whole different story; the tree would have to be removed without accessing your yard unless you give permission.

If the trunk spans the property line the tree is truly a shared tree and you both have equal ownership. Things might get ugly if you cant both agree on a solution. There is no written law regarding trees. Only legal precedent.

Ultimately, if your intentions are wholesome and you are just trying to take care of you property, then trim away. If things are getting ugly, you should get a written recommendation from a qualified professional arborist (Texas A&M Law).

Single Family Residential Use Only

There are several homeowners who are not adhering to deed violations. Briargate would like to stress to homeowners the severity of not adhering to deed restrictions. Therefore, Section 3.1 is being introduced again.

Owners shall use their Lots and Residential Dwellings and any other buildings on their Lot, if any, for single family residential purposes only. As used herein, the term single family residential purposes shall be deemed to specifically prohibit, by way of illustration but without limitation, the use of any Lot for a garage apartment or any other apartment or for any multi-family use or for any business, education, church, professional or other commercial activity of any type, except that an Owner may use his residence as a personal office for a profession or occupation, provided: the public is not invited, permitted, or allowed to enter the Residential Dwelling or any structure or improvement upon such Lot and conduct business therein; no signs advertising such profession or business are permitted; no on-site employees are permitted, other than domestic servants; no visible storage or display of materials, good, or products are permitted; frequent deliveries by delivery vehicles are not permitted; no offensive activity or condition, noise and/or odor permitted; and such use in all respects complies with the law of the State of Texas, and laws, rules, and regulation of any regulatory body or governmental agency having authority and jurisdiction over such matters.

Vehicles Parking On The Grass

Once again, Briargate has an issue with homeowners parking their vehicles on the grass. The City of Houston enforces parking on the grass by ticketing vehicles and Briargate also assesses fines for each car per day.

HPD/Fort Bend Constables

Fort Bend Constables and HPD should be commended on the great job they are performing. They are issuing tickets for speeding, running stop signs, and eliminating the loitering at the nearby service station and making drug busts. Keep up the great work!
