CRIMINAL COMPLAINT:

I, Ricardo Beas, a complainant in the instant matter, declare that the following is true and correct to the

best of my knowledge, beliefs and upon information. I further declare that the above named persons,

individuals, institutions, fictitious entities and governmental agencies, hereinafter referred to as

“Criminal Participants,” are acting contrary and against my God-given, Natural, Common Law, California

State and U.S. Constitutional, and International rights, as well as such rights of thousands of other

residents and citizens of this country, by meticulously promoting and forcing through an elaborate

conspiracy of corrupt acts the changing, modification and revision of state and federal laws, while at the

same time misleading the general public through propaganda,2 in order to make vaccination mandatory

for the following human beings:

(1) Pregnant mothers manipulated, encouraged and convinced to receive vaccines while pregnant

(2) Children upon birth

(3) Children in order to attend pre-school, elementary school and high school

(4) Teenagers and adults entering college and higher education

(5) Teenagers and adults in order to obtain and/or main certain types of employment,

(6) Adults in order to receive certain government benefits, such as veterans’ medical benefits3

(7) Parents or guardians of children receiving government financial assistance

(8) Military personnel in order to serve, with those serving facing court martial for refusing to vaccinate

(9) Children and Adults moving from state to state or entering the country4

(10) All human beings immigrating into the United States

SPECIFIC CRIMINAL ACTS

I hereby request that the U.S. Departments of Justice, Health and Human Services, Education and its

associated governmental agencies and branches investigate the above named Criminal Participants, who

through conspiratorial practices, individually between and among some or all of the Criminal

Participants, are together promoting and forcing economically, commercially and politically an agenda

to carry out and accomplish the following goals:

(1) Make certain vaccines recommended for children by the Centers for Disease Control (CDC) in

their vaccine schedule mandatory for such children in a timely fashion in order to attend school,

from preschool and kindergarten to high school, throughout the United States.5

(2) Manipulate and bribe6 legislators of all states, in particular the State of California, to create laws

that make vaccines mandatory as noted in (1) above.

(3) Move legislators of all states, in particular the State of California, to eliminate the religious

exemption to vaccination, even though such exemption is based on God-given, Natural,

Common Law, and U.S. and State Constitutional Rights and cannot be taken away by mere

legislation or supposed law, and even though such religious exemption is not even mentioned in

California’s AB 2109 and SB 277.

(4) Move legislators of all states, in particular the State of California, to eliminate the personal

beliefs exemption to vaccination that is based on U.S. Constitutional rights, noted in the 9th

Amendment, which reads, “The enumeration in the Constitution, of certain rights, shall not be

construed to deny or disparage others retained by the people”.

(5) Violate our rights, as recognized by the U.S. Supreme Court, to refuse unwanted medical

interventions and the rights of parents to decide what is in their child’s best interest.7

(6) Force vaccination upon adults by making certain jobs and employment in certain industries

conditional on complying with CDC and company vaccination requirements.8

(7) Create federal and state legislation that penalizes parents for not vaccinating their children, up

to and including the removal of affected children from their homes and possible civil penalties

and criminal charges for child neglect and similar accusations against such parents, and/or

refusal of medical services.9

State.” [Parham v. J.R., (1979) 422 U.S. 584].

(8) Force parents of unvaccinated children to pay for costs associated with possible outbreaks of

vaccine related diseases,10 even when the evidence shows that vaccinated children have a

higher chance of infecting others than non-vaccinated children.11

(9) Hide the true dangers of vaccines,12 by manipulating analytical reports, tests, trials, reports, as

well as by following a campaign of (a) misinformation to the public about vaccines and their

dangers, including fraudulent medical literature that hides the dangers of vaccines,13 and (b)

attacking any person, institution or entity that attempts to shed light on the truth about vaccine

dangers, in particular vaccine danger to babies and children related to autism.14

(10) Hide the fact that vaccinated children are the ones that are putting other children, vaccinated

and not, in danger of infection to the disease such vaccines are intended to avoid.

(11) Remove all liability to all persons and institutions associated with the manufacturing,

distribution, promotion and administrations of such vaccines as noted above, in particular

manipulating the U.S. government into creating a special vaccine court that gives total immunity

to such manufactures and others noted above.15

(12) Promote vaccination through unreliable providers, such as the flu vaccine in pharmacies and

optometrist’s offices,16 noting that such locations do not have the vaccine manufacturer’s

recommended medical staff and equipment to deal with immediate severe vaccine reactions.17

(13) Create monetary incentive programs for politicians, county health department representatives,

school representatives, doctors and medical institutions to bribe them into (a) promoting

vaccination and (b) avoiding reporting any adverse effects related to the administration of such

vaccines,18 (c) convincing parents not to report such adverse effect, and (d) intimidating,

ridiculing, getting upset at and threatening parents with some sort of action (such as psychiatric

treatment) for believing vaccines may be harmful in any way and for not vaccinating their

children.

(14) Through false advertising and commercial sponsorship using the published, internet and

televised media, and commercials or the media news organizations, to (a) promote vaccines,

and (b) negatively question and attack those opposed to mandatory vaccines or who call into

question the efficiency and safety of any and/or all vaccines.19

A CRIME AGAINST HUMANITY IS BEING COMMITED:

A PREPONDERANCE OF THE EVIDENCE – AN INHUMANE CRIME BEYOND A REASONABLE DOUBT

THE JUSTIFICATION FOR CIVIL AND CRIMINAL PROSECUTION AGAINST THE CRIMINAL PARTICIPANTS

Sufficient information from reliable personal, experienced, professional, scientific and scholarly sources

exists that proves that vaccines20 in some or in many cases can be detrimental in a smaller, larger or

deadlier degree to the physical, biological and mental state of their recipients.

I, being a layman and non-expert in the fields of biology, immunology, immunization, inoculation,

vaccination, corporate greed, corruption, abuse of governmental authority or violation of oath of office,

cannot produce my own empirical evidence to prove why vaccines can be unsafe and why individuals

and parents should have a right, defined in whichever manner, to decide when and if vaccination is a

better choice for such individuals or their family members and whether to vaccinate or not. I can only

come to my own conclusion using true mental openness to consider all the available and relevant

information at my disposal using real, objective, unobstructed, unbiased and non-partisan critical

thinking21 to come to a conclusion as to whether vaccines, in any form, degree or recurrence should be

allowed to be injected into me and my family members. And I have concluded that vaccines have an

actual risk of injury that is not worth taking, as they can be detrimental to our overall health as

described herein.

Therefore, I defer to the experts in the field of vaccination theory and reality, in particular those without

financial or other interests in the promotion of vaccines and mandatory vaccination, to show proof of

such dangers of vaccines by citing such sources in the text and footnotes of this complaint as my proof

that (a) vaccines are not safe, (b) vaccination should not be mandatory and/or compulsory, and that (c)

coordinated and speedy legal action should and must be taken against all involved Criminal Participants.

I adopt herein all footnotes, exhibits, noted internet articles and videos by reference and incorporation.

I limit myself through this formal complaint to point to the quoted sources for scientific purposes and to

my observations as relates to obvious conclusions that anyone can reach by simply defining this issue in

the least complex way possible, to wit:

PROOF OF VACCINE DANGERS

When it comes to whether vaccines can have a harmful effect on any person of any age, there are only

three things that need to be taken in consideration:

1. What is the actual and scientific data allegedly proving that vaccines are not harmful to its

recipients in any way, shape or form.

2. What is the actual and scientific data allegedly proving that some or all vaccines, based on each

of them individually, in combination with other vaccines, and/or in frequency, can be harmful or

deadly to certain individuals.22

3. As to claimed vaccine related injuries, what are certain parents of physically and/or mentally ill

children reporting as regards to the circumstances of each individual incident and the proximity

of such onset episodes with such person’s vaccination, where no medical history exists to justify

the onset of such disease and injury.

The difference between number 1 and 2 above compared with number 3 can be clearly defined: The

first two are based on studies written by certain scholars and scientists based on statistical information

that can be manipulated or challenged in multiple ways, while number 3 is based on the observations of

individuals, such as parents, that have seen a child from birth develop in a normal way and then

suffering a minimal or serious disability soon after vaccination, sometimes within minutes. In thousands

of cases parents have concluded that the injury to their children is directly related to vaccination and

can find no other logical explanation for it.23

To add to such parents’ observations, in many such infant/child injury cases, parents visit their

pediatrician to have their children go through a routine scheduled medical physical examination and

after the physician conclusively states that the child is fine, then the pediatrician recommends

vaccination to conclude the visit, after which vaccination such detrimental reactions happen, within

minutes, hours or days.

In other words, in the above cases the doctors are saying, “your child is fine, no sort of disease is

detected in him/her nor are any diseases and symptoms expected at this time based on my professional

medical opinion,” only for the parents to see soon after vaccination such reactions and physical and/or

mental disabilities occur, from minor tics to very high temperature to seizures, encephalitis and autism,

even death, like SIDS,24 all such possible reactions well documented in the vaccine manufacturers’ own

vaccine inserts.25

To determine if vaccines are harmful to some individuals or to the U.S. population to a lesser or higher

degree, one need only apply the law of Parsimony. The Parsimony principle is basic to all science and

tells us to choose the simplest scientific explanation that fits the evidence. In the case of vaccination, the

following basic facts apply:

(1) A CHILD OR PERSON HAS PERFECT HEALTH

(2) IMMEDIATE AND SERIOUS INJURY HAPPENS AFTER VACCINATION

(3) NO EXPLANATION FOR INJURY OTHER THAN VACCINATION IS LOGICAL OR PLAUSIBLE26

While a physician’s conclusion of a child’s life and circumstances and his/her physical and mental state

may be based on a few doctor’s visits, some tests and some comments from the parents, parents’

knowledge and observations are based on life long, minute, hourly and daily observation and evaluation

of their child to be able to determine conclusively whether a vaccine just administered could be the

culprit for a completely unexpected turn of events negatively affecting their child; as obvious as when a

child trips and falls, and the parent see them tripping, as well as the obstacle in the floor, that

conclusively and by logic made him trip based on his trajectory.

The logical conclusion that one can reach in the above instance is that, if one body of literature says

vaccines are safe and the other says that vaccines are not always safe and could even be deadly, and the

actual physical (not hypothetical and/or statistical) evidence shows that indeed such physical and/or

mental disabilities are happening soon after vaccinations – this proves that the body of evidence against

vaccines, no matter how small, is much more likely (if not definitely) to be correct in linking the effects

of vaccination to such serious injuries as described above. Add the injuries mentioned in vaccine inserts

and the conclusion of a relationship between vaccines and common serious injury like autism is nothing

less than inevitable.

DEFINING RELIGIOUS RIGHTS

Our country, what we can call herein the United States of America or USA, was born/created on paper

almost 250 years ago. Our country is internationally and legally simply a corporate entity, our articles of

incorporation being the “Constitution for the United States of America”, our territorial country’s legal

Charter, hereinafter the US Constitution.

The assumption is that we, the residents of the land mass known as the United States of America, have

allowed this fictitious entity known as the USA and all its officers and employees to represent us and

represent our interests. Misleadingly people believe that our rights as human being residents of this

territorial USA come from the US Constitution, but they do not - the law is today because of what it was

yesterday.

The USA Constitutional government must recognize all previous agreements and legal/lawful precepts

preceding our constitution, as noted in Article 6 of the US Constitution, which states:

“All Debts contracted and Engagements entered into, before the Adoption of this Constitution, shall be

as valid against the United States under this Constitution, as under the Confederation.”

The USA’s legal history and authority is based on legal precedent which comes from the English

Common Law, as may be confirmed or implied by the United States Articles of Confederation and the

Declaration of Independence. The Common Law itself comes from well-established human Natural

Rights.

The Declaration of Independence, being a legally precedent binding document states the following facts

and acknowledges our presently existing legal rights:

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by

their Creator with certain UNALIENABLE RIGHTS, that among these are LIFE, liberty and the pursuit of

Happiness. That to secure these rights, Governments are instituted among Men, deriving their just

powers from the consent of the governed.”

Based on the above, our natural rights come from God, and not from human governmental or other

institutions who could, according to the government, at will approve some and deny other of our true

rights. Consequently, the U.S. Constitution, does not grant us any natural rights, but simply

acknowledges some of them, leaving those rights not mentioned outside of the US government’s control

or regulation, as noted in the Ninth Amendment to the US Constitution.

One of these unalienable rights include our religious rights, express as the first and most important right

in the US Constitution’s Bill of Rights, which states:

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise

thereof.”27

When it comes to vaccines and vaccination, a person’s right not to vaccinate personally or to allow any

of that persons’ children to be vaccinated is protected by this religious right as expressed in the First

Amendment.

Some individuals, such as Criminal Participant conspirator Dorit Rubinstein Reiss, will argue that when a

person claims a right to avoid vaccination claiming constitutionally protected religious rights that such

proclamations are being abused by such parents and are lies, thus deceitful, and that in fact such

religious exemptions should not exist.28 Yet Reiss is wrong. So long as a person believes in God, it is easy

to see, and therefore to prove why such person would not use vaccination from a religious standpoint if

a belief or doubt existed in such person’s minds that vaccines could be dangerous, as conclusively

summarized here:

1. A person believes in God

2. God Creates Life, and therefore that person believes God created him or her and all other humans.

3. Humans are ordered to prosper and multiply (Genesis 9:7 – “And you, be ye fruitful, and multiply; bring forth abundantly in the earth, and multiply therein.”)

4. God orders humans to protect their body, God's temple.29

5. God orders parents to protect their children and to care for them, as they are a heritage from God.30

6. If such person believes that vaccines are harmful, such person has a God-commanded responsibility to protect himself and his children, by not allowing any of them to be vaccinated to avoid possible adverse effects to their physical and/or mental state.

7. Therefore, if a person believes a vaccine can cause injury, such person has a God ordained responsibility to avoid vaccination. That is to say -- His/her religious beliefs are sincerely, logically and without question against vaccination as a matter of religious principle and the preservation of life.

MANDATORY VACCINES FOR SCHOOL CHILDREN IN CALIFORNIA – AB 2109 and SB 277

DESCRIMINATION AGAINST A GROUP IDENTIFIED AS ANTI-VAXXERS

EQUAL PROTECTION OF THE LAW DENIED

Since 1961 as a result of California Assembly Bill 1940, by DeLotto and Rumford, elementary and

secondary schools in California have required its students to be vaccinated with certain types of vaccines

as recommended by the U.S. Centers for Disease Control (CDC) in order to attend school.31 Even though

vaccines were required by this bill, there was an exemption for refusing to vaccinate based on personal

beliefs.

While the original intent was to note a religious exemption by wording the text of the regulation as

requiring a “letter stating that such immunization is contrary to his or her religious beliefs,” the final text

noted that “Immunization shall not be required for admission to a public or private elementary or

secondary school if the parent or guardian ... files ... a letter stating that such immunization is contrary

to his or her beliefs.” 32

Thus, while such AB 1940 legislation provided a “personal” exemption, it did not mention or address a

“religious” exemption, and I contend that it is not required in the text of the regulation because it is

already clearly reflected, stated and protected in both the U.S. and the California constitutions.33

In 2012 then Assembly Member Richard Pan promoted and helped pass Assembly Bill 2109, which

required parents of unvaccinated children to speak with a physician before their children would be

allowed to attend elementary and secondary school. According to Pan prior to the passing of AB 2109 he

said in a nutshell that he did not have a problem with parents not vaccinating their children as long as

they had made an informed choice based on them discussing vaccination and immunization with their

pediatricians.34

Because vaccines were already mandatory absent the written refusal to vaccinate, the only purpose of

AB 2109 was to target unvaccinated children and their parents35 to force them to see a physician in

order to use the supposed “personal exemption.” This action created a “Class of Person” that we can call

the “Unvaccinated” and the intent of such AB 2109 was to affect specifically this class of unvaccinated

persons.

AB 2109 modified section 120365 of the California Health and Safety Code not only to state that parents

of unvaccinated children would speak to a physician about vaccine safety, but it also committed the

physicians/pediatricians to provide such parents with “information regarding the benefits and risks of

the immunization.” Yet my experience with two pediatricians and hospital staff (as discussed below), as

well as the experience of most anti-vaccination parents was that physicians were only discussing the

alleged positive benefits of vaccines and did not discuss all the knows possible negative health effects as

noted at a minimum in those vaccines’ inserts and studies.36 Such negligent or purposeful refusal to

provide all information regarding such inserts and possible vaccine injuries is in direct violation of

my/our legal right to Informed Consent, and failure to provide Informed Consent regarding vaccines and

their dangers results in medical malpractice .37

To everyone’s surprise, in particular Senator Pan, the CDC and the vaccine industry, Gov. Gerry Brown Jr.

did sign AB 2109 as acceptable legislation,38 but in his signing statement ordered the California Dept. of

Education and Dept. of Health to create a form that parents of unvaccinated children could use to avoid

seeing a physician altogether by simply noting that vaccination was against their religious beliefs.39

As a result of this, now Senator Pan and other Criminal Participants again conspired to change the law

and attacked specifically the parents of unvaccinated children by promoting and achieving the passing of

vaccination, are against the amount of vaccines being presently required, prefer a different schedule for vaccination and/or wants to avoid certain specific vaccines due to medical, personal and/or religious reasons. When referring to “me” or “my” and the like it includes all other complainants that join this class action criminal complaint and those that may not be aware of it that might join in the future, as well as those that are against mandatory vaccination government policies, rules and regulations. 36 See emails of August 2016 from one of my child’s Sharp Rees-Stealy Pediatrician, Dr. Layla Dipp stating, “We would follow the CDC and American Academy of Pediatrics recommendations. SB 277, which completely removed the personal exemption to mandatory vaccination, noting that a

“religious exemption” was again not mentioned in the text of the bill, just like in AB 2109 and AB 1040.

To make matters worse, according to Pan and Senator Allen, SB 277 would give doctors full and

unchallenged discretion to issue medical exemptions,40 but as will be noted below, doctors who issue

vaccine medical exemptions are being scrutinized, challenged and attacked, their medical license

threatened for issuing such medical exemptions.41 Now, to get a medical exemption to vaccination, a

parent needs to show that their child has been previously injured by a vaccine in order to avoid future

ones. In other words, you have to be injured to avoid further injury; that is, if they will give a medical

exemption at all. Also, Pan et al are introducing multiple Assembly and Senate bills to expand the

vaccine program, while penalizing those that do not fall in step.42

Now the State of California, including the Department of Education and the Department of Health are

stating that SB 277 removed both the “personal exemption” and the “religious exemption,” when the

religious exemption is not addressed in SB 277, and even though in his signing statement for SB 277

Governor Brown did not remove or revoke the religious exemption he acknowledged, approved and

ordered of the above agencies in his signing statement related to AB 2109.43 This was confirmed by the

Office of the Governor, Legal Affairs Department, in their letter to me of August 5, 2015, regarding my

Public Records Act request, where I requested the following:

“1. Provide a copy of any and all documents (orders, directives, emails, etc. ad infinitum) written or issued by Gov. Brown to any department, agency or the like which indicate that Gov. Brown’s 2012 signing statement as to the use of the Religious Exemption and form CDPH 8262 for that purpose is no longer available to parents of unvaccinated children, that it is null and void, rescinded and/or in any way no longer in force. 2. If no such order or instruction as noted in number 1 above exists, please advise of the following:

a. Confirm in writing that no such order or directive exists.”

The response I received states:

“We have located no records that are responsive to your request. Sincerely, Legal Affairs.”44

If the religious exemption in Gov. Brown’s 2012 signing statement was no longer valid, Legal Affairs

could have easily and clearly pointed to Gov. Brown’s signing statement of 2015, which the Dept. of

Education, the Dept. of Health and elementary and secondary schools are claiming nullifies Brown’s

prior religious exemption and their obligation to continue using a form similar to CDPH 8262 which

included the religious exemption for parents to use in order to attend school.45

Therefore, persons against forced vaccination have been classified into a separate group for purposes of

AB 2109 and SB 277, a certain “Class of Persons,” which is being attack and discriminated against by SB

277 and all involved Criminal Participants, violating my/our rights to equal protection of the law as

contemplated by the Fourteenth Amendment to the U.S. Constitution. See also 42 USC 1981(a),

Further, California unvaccinated children are being threatened with removal from school if they don’t

vaccinate, in violation of California Constitution Article 9 sections (1) and (5), the right to public

education. These and other related actions are also a violation of our medical privacy rights.46

The State of California Dept. of Education, Dept. of Health and elementary and secondary school

districts are acting in a discriminatory manner as has been shows above,47 their actions have been

intentional and purposeful to negatively affect and impact unvaccinated persons,48 which have now

been turned into a “suspect class” for Fourteenth Amendment equal protection purposes. Such actions

are in violation of unvaccinated persons’ U.S. and California constitutional rights.

APPLICATION OF US SUPREME COURT CASES TO SB 277

There have been several challenges to SB 277, three in federal court and one in California State Court, as

follows:

1. Ana Whitlow, et al vs. State of California, et al; U.S. District Court, Southern District of California,

Case No. 3:16-cv-01715-DMS-BGS.

2. Travis Middleton, et al vs. Richard Pan, et al; U.S. District Court, Central District of California,

Case No. LA-CV16-05224-SVW-AGR.

3. Torrey-Love, et al vs. State of California Department of Education, et al; U.S. District Court,

Central District of California, Case No. ED CV 16-2410-DMG(DTBx); now in California state court:

Superior Court, County of Placer, Case No. SCV 0039311.

4. Tamara Buck, et al vs. The State of California, et al; Superior Court of the State of California,

County of Los Angeles, Central District, Case No. BC617766.

In the above cases where the Plaintiffs have claimed that SB 277 violates their personal and/or religious

beliefs and their constitutional rights not to vaccinate their children, fully or partially, the Courts have

focused and used Jacobson v. Commonwealth of Massachusetts, 197 U.S. 11, 27–29 (1905), to declare

that such case eliminates such right to not vaccinate; but that is incorrect, wrongly applied and contrary

to such Plaintiffs and my God-given, natural, common law, US and California Constitutional, and my

International rights.49

Jacobson states that a “community has the right to protect itself against an epidemic of disease which

threatens the safety of its members . . . and not permit the interests of the many to be subordinated to

the wishes or convenience of the few.” While this may be true, there is no present epidemic that SB 277

is addressing, as none of the vaccines in the CDC vaccine schedule are presently of any public or

community outbreaks of epidemic proportions. Further, some of the vaccines are not associated with

airborne communicable diseases. In fact, the Hepatitis B vaccine is recommended for children at birth,

even though such disease is associated with sexual intercourse and drug use, as well as direct contact

with blood or other contaminated bodily fluids.50

Jacobson is not binding on the above SB 277 courts and where such courts have made a decision and

issued an order stating that Jacobson is binding, such judges are violating their Oath of Office to protect

and defend my and other unvaccinated parents’ constitutional rights without justified findings of fact

and conclusions of law, all under duress and coercion and threat of loss of our California constitutional

right to public education for our children.

The Jacobson case is distinguishable from the above cases and not binding on any present day court for

the following reasons:

1. There are no present epidemics that threaten our country or communities.

2. At the time of Jacobson, the court addressed the use of one particular vaccine, while SB 277

mandates of total of more than 70 vaccines from childhood through high school.51

3. In Jacobson it involved only one vaccine for smallpox, while the new schedule and the

procedures followed by medical institutions is to give multiple vaccines at the same time, which

vaccines have never been tested for synergistic effects when these are combined.52

4. The penalty for not vaccinating in Jacobson was $5 dollars, while in the case of SB 277 it

includes,

(a) The loss of public and private elementary and secondary education.

(b) The need for parents to homeschool their children.

(c) Affecting non-vaccinated parents financially in order to homeschool, in some cases having to

leave their employment in order to do so.

(d) Forcing parents to move to another state where the personal and/or religious exemptions

are accepted.

5. Vaccines presently contain among other things neurotoxic substances such as mercury,

aluminum, formaldehyde, glyphosate, GMOs, peanut oil, other viruses, bovine extract,

polysorbate 80, monkey kidney tissue, fetal tissue, Thimerosal, and other ingredients that can

and have been proven to be detrimental to a person’s health; and from a religious standpoint,

some if not all of these vaccines contain human fetal tissue and future vaccines will continue to

promote its use.53

6. There is now proof that unvaccinated children are healthier than vaccinated children.54

The other case law noted in the above cases, such as Zucht v. King, 260 U.S. 174, 176 (1922); Boone v.

Boozman, 217 F. Supp. 2d 938, 956 (E.D. Ark. 2002); Pickup v. Brown, 740 F.3d 1208, 1235 (9th Cir.

2014); and Prince v. Massachusetts, 321 U.S. 158 (1944), are also basing their decisions on Jacobson; and

thus similarly as in the case of Jacobson, the four lawsuits against SB 277 are distinguishable from

Jacobson, and the more recent cases such as Bone and Pickup do not consider the following findings of

fact to reach the proper conclusion of law.

In Prince v. Massachusetts, 321 U.S. 158 (1944), the Court stated: “The right to practice religion freely

does not include liberty to expose the community or the child to communicable disease or the latter to ill

health or death.” Id. at 166-67. While this conclusion of law can be considered to be correct, it is only

based on the presumptions that (1) vaccines work and are effective in preventing the diseases they are

intended to prevent, (2) that vaccines don’t expose the community or an individual to a communicable

disease, (3) that vaccines cannot and do not pose any risk of ill health or death to their recipients,55 (4)

that unvaccinated children are the ones causing the outbreaks, (5) that only by vaccinating the

unvaccinated can you protect vaccinated children, (6) that an unvaccinated child has a higher risk of

infection and serious injury than a vaccinated child against any particular disease the vaccine is

supposed to prevent, and (7) that none of the vaccine ingredients are neurotoxins.56

The reality, as proven by all the evidence provided and referenced herein, is the opposite, to wit:

(1) Vaccines have been proven to be ineffective in stopping a vaccinated person from getting the

related disease in some or many cases.57

(2) Some vaccines are made with live viruses and the recently vaccinated person can shed the virus

and pass the virus to other vaccinated and unvaccinated children, causing the spread of such

disease in the community.58

(3) Vaccines can cause serious injury as noted in the vaccines’ own information insert and all the

documentation submitted herein.

(4) In many cases it is the vaccinated persons who are causing the outbreaks and are infecting

others, and the majority of the infected have previously been vaccinated and are up-to-date on

their vaccination.59

(5) Vaccinating a child does not help another vaccinated person in any way to avoid getting infected

as noted in number 4 above; there is no such thing as vaccine herd immunity as a way to protect

a community from a viral disease; on the contrary, the more vaccinated persons you have, the

bigger the chances some diseases will continue to affect communities as proven herein.60

(6) If both a vaccinated child and an unvaccinated child catch a preventable disease in their school,

the unvaccinated person has a greater chance of having a lesser reaction and impact on his/her

health, and a greater chance of getting better sooner than a vaccinated person; or at a minimum

the unvaccinated person has the same probability of seriousness of the disease’s impact on

his/her health as the vaccinated child.

(7) Many of the ingredients in the vaccines are toxic, neurotoxic; and when combined with other

vaccines and in increased amounts, are synergistically more harmful to its recipient.

(8) The CDC’s vaccine schedule includes vaccines for diseases that are not airborne communicable

diseases, like HPV, Hepatitis B, Tetanus and Diphtheria vaccines, making it unnecessary to make

these vaccines mandatory upon the unvaccinated in order to attend school.

(9) A whistleblower from the CDC, Dr. William Thompson, has confessed that he and others at the

CDC and other related participants in vaccine studies manipulated, hid, eliminated and

destroyed information and documents that prove that the MMR vaccine causes autism.61 Dr.

Thompson has confessed to a conspiracy between the CDC, the vaccine manufacturers and

other interested parties to hide the dangers of certain if not all vaccines, leaving the statements

from courts such as that of Jacobson, which stated that the court can depend on “facts of

common knowledge” that vaccines are safe inapplicable because of the implications of Dr.

Thompson’s declarations and confessions to fraud.

(10) Such type of CDC fraud was made evident in the 1976 fictitious Swine Flu (H1N1) epidemic

which resulted in the vaccination of millions and the disability of thousands, as well as about 300

fatalities. This CDC/government action and vaccine public promotion was done even though

there was not even one confirmed case globally. 62 If we add to this the Avian, H1N1, Ebola and

now the Zika virus CDC scaremongering and even worse the Tuskegee syphilis study conspiracy

and criminal activity,63 one can only conclude that when it comes to the CDC’s credibility, Falsus

in uno, falsus in omnibus (false in one thing, false in everything), and thus cannot be

trusted in any matters pertaining to vaccine safety.

These “facts of common knowledge” have to always be regarded in passing upon the constitutionality of

a statute, as noted in Jacobson.

In this case, Mr. Henning Jacobson, did not provide any expert witnesses and the court stated that even

if he had, that “facts of common knowledge” show that vaccines are safe. Justice Harland wrote:

“Assuming that medical experts could have been found who would have testified in support of these

propositions, and that it had become the duty of the judge, in accordance with the law as stated in Com.

v. Anthes, 5 Gray, 185, to instruct the jury as to whether or not the statute is constitutional, he would

have been obliged to consider the evidence in connection with facts of common knowledge, which the

court will always regard in passing upon the constitutionality of a statute.”64

Then the Jacobson Court proceeded to admit that vaccines can have harmful effects, writing:

“He would have considered this testimony of experts in connection with the facts that for nearly a

century most of the members of the medical profession have regarded vaccination, repeated after

intervals, as a preventive of smallpox; that, while they have recognized the possibility of injury to an

individual from carelessness in the performance of it, or even in a conceivable case without

carelessness, they generally have considered the risk of such an injury too small to be seriously weighed

as against the benefits coming from the discreet and proper use of the preventive.”

The key words here are “generally” and “injury too small to be seriously weighed,” as Dr. Thompson,

when giving his confession to Dr. Brian Hooker, who has a son with a serious case of autism, told Hooker

that he Thompson and the CDC through malfeasance and fraud were responsible for Hooker’s son’s

injury due to their collusion in hiding the truth, that among many other serious injuries, some or all

vaccines can cause autism.

With Dr. Thompson’s testimony, all the medical evidence of vaccine injury,65 all the vaccine injured

children parents’ stories and all other information provided and referenced herein, the evidence

conclusively shows that (a) today’s vaccines are not generally safe, and that (b) such vaccine injuries as

seen today are not too small to be seriously considered; but to the contrary, they seem to be

responsible for the autism epidemic that has hit the United States since the 80’s when the CDC vaccine

schedule started increasing to its present outrageous requirements.66

This is something that the SB 277 courts above are ignoring or avoiding purposefully, and I contend in

conjunction with those cases’ Plaintiffs, in order to use Jacobson and similar cases in denying the

challenges to SB 277. If this is correct, those judges are also Criminal Participants, worthy of R.I.C.O.

prosecution, such as that of the Travis Middleton case challenging SB 277 and those vaccines’ toxic

ingredients.

Also, today’s vaccines now have ingredients like glyphosate and aluminum that are very toxic and

dangerous, which they did not contain in the days of Jacobson and Prince, something also ignored by the

SB 277 courts.67

A CRIME AGAINST HUMANITY

As has been noted above, vaccines can have life altering and possible severe consequences to their

recipients’ health, from minimal tics, to systemic lupus erythematosus (SLE); Guillain-Barre syndrome;

multiple sclerosis; exacerbation of multiple sclerosis; seizure; febrile seizure; herpes zoster, encephalitis,

Brachial Neuritis; Cardiac disorders Cyanosis; Anaphylaxis; Bronchiolitis; acute gastroenteritis; asthma;

aspiration; breath holding; influenza; congestive heart failure; shock; pneumonia; autism; sudden infant

death syndrome; and death – all clearly noted in the vaccines own inserts. 68

The named and unidentified Criminal Participants have done all they can to hide the dangers of

vaccines, to convince the public that vaccines are always safe, to criticize anyone going against their

country and global mandatory vaccine program plans, and to penalize in whichever way possible any

such persons criticizing and opposing their plans, which criminal actions could include murder.69 These

corrupt individuals, regardless of the reasoning for their action, must be (1) investigated, (2) stopped, (3)

jailed, (4) prosecuted, (5) convicted, (6) incarcerated, and where the law requires it, (7) executed70 for

such crimes against me, unvaccinated person and all persons of this world where the same fraudulent

impetus on selling, administering and forcing vaccination is taking place. In other words, forced

vaccination, or simply vaccination in general considering the now existing rate of autism and obvious

connection to vaccination, is a Crime Against Humanity.71

The implications of the validity of the claims in this complaint point to individuals, corporate and

fictitious entities having infiltrated our government, through direct placement of their minions, or

through bribes in order to push this agenda of forced vaccination by affecting local, state and federal

regulations in order to achieve their goals, and as such are involved in criminal activity that I will

describe herein as best I can.

ASSERTIONS AND ACCUSSATIONS REGARDING

THE ILLEGAL ACTIVITY OF THE CRIMINAL PARTICIPANTS

Following is the manner in which I believe and the evidence suggests that the Criminal Participants have

colluded among themselves to violate all my/our rights as noted herein. All of the above exposed

activities of the Criminal Participants could only take place if some, most or all of the following activities

by each Criminal Participant took place.

INDIVIDUAL CRIMINAL PARTICIPANTS AND THEIR ACTIONS

- California Gov. Jerry Brown

Governor Brown had been given ample information and is well aware of the existing dangers of vaccines

and how the imposition of mandatory vaccination in order to attend school violated non-vaccinated

parent’s rights to exercise their religious beliefs and practices since the introduction of AB 2109.72 This is

made obvious by Gov. Brown’s signing statement regarding AB 2109 where regardless of the wording

and requirements of AB 2109 the Governor allowed the religious exemption to be used by parents.

Once SB 277 came to his desk the Governor violated his oath of office to uphold the Constitution by

allowing SB 277 to violate our 1st Amendment right to exercise our religious reliefs, while at the same

time endangering our children from possible harm by forcing them to be vaccinated in order to attend

school.73

Further, Governor Brown was sent a letter requesting he clarify if his religious exemption from 2012 was

still applicable, as he never rescind it in his SB 277 signing statement, but the Governor refused to reply

or take action.74

By signing SB 277 as legislation and not clarifying if his 2012 religious exemption was still valid, Gov.

Brown is colluding with others and/or all named Criminal Participants to make it appear that the

religious exemption is no longer applicable as regards avoiding vaccination in order to attend school.

- Sen. Richard Pan, Sen. Ben Allen, Assembly Member Lorena Gonzalez Fletcher, Their Staffs and

Associates, et al

Senators Richard Pan and Ben Allen and Assembly Member Lorena Gonzalez Fletcher, together with

their staffs and associates, colluded with drug company manufacturers and their lobbyist to try to force

vaccination upon the California elementary schools’ children.75 The first Pan attempt was through AB

2109 and when Gov. Brown’s 2012 signing statement provided a religious exemption he came back with

SB 277.

Further, Senator Pan is a pediatrician and directly gains monetarily from mandatory vaccination, both

from the majority of patient visits being related to the administration of scheduled vaccines and also

from bonuses provided by health providers and medical insurance companies.76

- Tom Frieden, Julie L. Gerberding, Paul A. Offit, William Thompson, Other CDC Employees, et al

Through its direct contact with the pharma industry, whose key employees take work sabbaticals to go

work for the CDC, the named CDC employees have colluded with the vaccine manufacturers to hide all

evidence of vaccine injury from their reports, studies and the like; to promote mandatory vaccination

and to attack all persons that are a threat to the vaccine industry.

The CDC is financing organizations whose intent is to push the mandatory vaccine agenda on schools,

such as their financial support of the National Association of County and City Health Officials

(NACCHO).77

Even though human disease generally affects persons that have a depressed immune system, the CDC

only focuses on three things when it comes to ways to avoid diseases such as measles or the flu: (1)

primarily vaccination, (2) washing your hands and (3) covering your mouth when sneezing. In a flyer

titled Preventing the Flu, they list eating nutritious foods as the last option to fight airborne diseases.78

There are ample studies that prove nutrition, natural and wholesome, is the best antidote to fight

disease and yet the CDC pushes the vaccine manufacturer agenda of perpetual vaccination with toxic

substances that are resulting in the healthcare crisis we are facing in our country.

Further, people associated with the CDC, have a conflict of interest when approving vaccines where

some of them are reaping the benefits of approving some vaccines, as did Paul Offit, who voted to add a

vaccine to the CDC schedule, even though he was involved in its development.79

- Dorit Rubinstein Reiss and U.C. Hastings College of Law Board of Directors, staff, et al

Dorit Rubinstein Reiss and U.C. Hastings staff have colluded together with vaccine manufacturers, the

CDC, Paul Offit and other persons and institutions to legitimize the illegal forced vaccination program,

writing and publishing articles by Reiss encouraging the violation of anti-vaccination persons and their

families’ God-given, natural, common law, U.S. and California constitutional and international rights not

to vaccinate for medical, personal and/or religious reasons.80

Aside from her and/or her family’s ties to the vaccine manufacturing industry,81 Mrs. Reiss has written

articles and papers intended to intimate non-vaccinated individuals into submission, such as her paper

titled “Compensating the Victims of Failure to Vaccinate: What are the Options?”82

She is also encouraging hospitals and other business to implement mandatory vaccination programs for

their employees and to exclude from their policies any personal or religious belief exemptions, finding a

way around their employees’ legal and constitutional protections.83

Reiss further blatantly tries to convince all her followers that any person who says they are against

vaccination for religious purposes is a liar and opportunist with no religious principles to justify such.84

In her attempt to promote mandatory vaccination and to create opposition for exemptions, Reiss

consistently writes articles in multiple social media forums like Facebook, where she harshly criticizes

any person against mandatory vaccination and immediately attacks any existing or new evidence of

vaccine related injury.85 In some of her posts she has harshly criticized President Trump’s consideration

of creating a vaccine safety committee headed by Robert F. Kennedy, Jr., claiming that all the research

done by Kennedy is bogus and that President Trump is misguided for even considering creating such a

commission.

In my personal email correspondence with Reiss she admits that vaccines can cause physical and mental

harm. In one study we discussed that claimed thimerosal caused a risk of autism, “A two-phase study

evaluating the relationship between Thimerosal-containing vaccine administration and the risk for an

autism spectrum disorder diagnosis in the United States,” by David A. Geier and Brian S. Hooker et al,

she claims the study was flawed, noting in particular that “they also only look at one vaccine, without

controlling for thimerosal exposure from others … this approach will introduce errors as other vaccines

administered (or not) will have a profound effect on thiomersal (sic) exposure from vaccines” This is

significant because Reiss admits here that the quantity of thimerosal is relevant, that at some point it

can cause autism or serious mental disability. This is an even bigger concern when one considers that

vaccines are now given in multiple doses.86

As to why vaccines are not tested to see if they are carcinogen, Reiss replied, “Why aren't vaccines

tested for carcinogenicity, etc.? Because there's no biologic basis to think they cause any of those.” Then

I mentioned that vaccines contained glyphosate a known carcinogen, and she replied, “No, I don't

consider that just the presence of glyphosate would show the vaccine can cause cancer. That would

depend on amount, and require some support.” This statement means that Reiss (1) admits that

glyphosate is a carcinogen, (2) that in certain amounts in vaccines [or combined vaccines] it can cause

cancer, and (3) that indeed, if for no other reason, this would justify the testing of vaccines to see if they

can cause cancer, regardless of what substance or substances in vaccines can cause such cancer.87

- Merck Group, Merck, Merck and Co., Inc., Other Vaccine Manufacturers, et al

Through their bribery of and infiltration into government agencies, such as the CDC and the FDA, Merck

and other vaccine manufacturers et al have gained approval to sell their vaccines regardless of the risks

known by the vaccine manufacturers and cited in their vaccine inserts, have encouraged or forced such

agencies to heavily promote mandatory vaccination for children and adults, and had the CDC manipulate

vaccine studies’ data to eliminate any evidence of vaccine injury, in particular Autism.88

Through their Board of Directors, majority stock holders, top operating management officers, heads of

Sales and Marketing departments and their salesman, and through their lobbying representatives, these

vaccine manufacturers have promoted their mandatory vaccine agenda, creating incentive programs of

various type to get their agents to push vaccines, from doctors to hospitals and county health

departments, in order to achieve their goals, always hiding the dangers of vaccines, as has now been

exposed by whistleblowers from Merck89 and CDC’s Dr. Thompson. Merck also omitted data concerning

ovarian failure related to the Gardasil vaccine.90 Even when there is an obvious connection between an

injury and vaccination, like fever-related seizures immediately following vaccination, these vaccine

manufactures are fast to state that the vaccines are not the culprit.91

- Blue Cross, Blue Shield, Blue Care Network, Blue Cross/Blue Shield Association, et al

Blue Cross et all have created incentive programs to promote vaccines by bribing pediatricians in the

form of bonuses for accomplishing their child patients’ complete compliance with the CDC immunization

schedule, an amount equal to $400 per child. Such program goes further and creates a disincentive

requirement for doctors to avoid reporting any child apparent vaccine injury in the Vaccine Adverse

Event Reporting System (VAERS) and an incentive for doctors to convince their patients’ parents that the

injury is not vaccine related and that it should not be reported. In one of their plans it states that doctors

cannot get such bonus if there is a VAERS vaccine injury report and while this is written in a manner to

appear that such injured children are not counted when calculating the acceptable percentage of

compliance, the result is the same: if the child has a vaccine injury report on file, the $400 bonus will not

be awarded for that child, even if the doctor convinces the family to continue vaccination regardless of

injury.92

- Takashi Wada MD, Director, California Department of Public Health, Santa Barbara, et al; and All

California County Departments of Health, Management personnel, et al

After the passing of SB 277, Dr. Wada et al conspired with other governmental agencies, including the

California Department of Public Health, to intimidate doctors issuing medical exemption by attempting

to require local schools to provide records of any doctor-issued medical exemption so it could be

scrutinized by them, even though SB 277 does not give any authority for any department of health or

school district to do so, against that child’s medical privacy and such doctor’s right to use his

professional medical opinion to decide if a medical exemption should be issued or not, including

whether or not vaccines are potentially dangerous to some or all children.93 This was clearly done to

intimidate any doctor from issuing any sort of medical exemptions, which as noted above, has resulted

in some physicians being threaten with losing their medical license.94

- National Association of County and City Health Officials (NACCHO) management personnel, et al

The National Association of County and City Health Officials (NACCHO) urges the federal government to

support the creation of a comprehensive national immunization program that addresses all stages of life

(cradle to grave) with the intention of achieving the Healthy People 2020 immunization goals and

standards.

Through extensive funding by the CDC, NACCHO has infiltrated state and county health and education

agency officials and has promoted a mandatory vaccination agenda. One example is their heavy lobbying

for Oregon’s SB 442, another bill that makes the CDC schedule vaccines mandatory in order to receive

primary education.95

Further, NACCHO is encouraging school districts to eliminate the personal and religious exemptions for

vaccination, as well as directing the local health departments to monitor all child vaccination history. In

their 2011 Statement of Policy they write in part:

“The National Association of County and City Health Officials (NACCHO) urges that personal belief

exemptions be removed from state immunization laws and regulations. NACCHO acknowledges that

there are states that may not be in a position to eliminate personal belief exemptions immediately.

States that easily permit personal belief exemptions to immunizations have significantly higher rates of

exemption than states that have more complex procedures. These states should begin a process to limit

the availability of personal belief exemptions to the greatest degree possible. An initial step might be

to review the process of applying for and receiving exemptions: the more educational and demanding

the process, the lower will be the rate of exemptions. There should be more involved in the application

process than simply signing a form.

A function of many state and local health departments is to collect vaccination data and maintain

immunization registries. These registries are often used to help ensure children and adolescents have up-

to-date immunizations. Low levels of vaccine coverage among adults underscores the need to expand

these systems to include adults and for providers to develop systems to minimize missed

opportunities.”

NACCHO developed and promotes policies to discourage parents from using personal or religious

exemptions. In their November 2006 Statement of Policy they write:

“To discourage casual use of personal belief exemptions, NACCHO supports the following courses of

action:

Federal support for conducting routine surveillance of school immunization records to identify

gaps in immunization coverage related to personal belief exemptions.

Federal support and guidance to assist in developing exemption procedures that encourage

parents to comply with vaccination requirements rather than claim exemption as a means of

convenience.

Federal support and guidance regarding effective ways to implement procedures and

administrative controls that limit nonmedical, nonreligious exemptions.

Federal support to primary care providers, local health departments, school nurses, and/or the

state/local immunization coalition to conduct mandatory sessions that provide education about

immunizations’ impact on public and personal health and integrate information about the

responsibilities associated with exercising the parental right to a personal belief exemption.

School systems and childcare facilities (where appropriate) should use an exemption application

form that requires a parental signature acknowledging their understanding that their decision

not to immunize places their child and other children at risk for diseases and ensuing

complications. The form should also state that in the event of an exposure to a vaccine-

preventable illness, their child would be removed from school and all school-related activities for

the appropriate two incubation periods beyond the date of onset of the last case, which is

standard public health practice.

School systems and child care facilities (where appropriate) should require annual renewal of

exemption forms. This process would provide multiple opportunities for education regarding the

value of vaccinations and the responsibilities inherent in choosing not to be vaccinated. The

parents would thus be required to make an informed decision annually rather than just once.

Federal support to ensure compliance with exemption reporting by all schools, monitor

exemption rates, and provide public reports of exemption rates over time in order to help define

the vaccine-preventable disease risk related to the exemption rate at the school and community

level.”96

- Dr. David Reynaldo, Dr. Martha Layla Dipp, Sharp, Sharp Healthcare, Sharp Rees-Stealy, et al

Pediatricians have an obligation to look out for the wellbeing of their patients above their own financial

interests, yet in the case of vaccination, doctor’s are not doing their due diligence investigation when it

comes to the serious issue of vaccines and vaccine safety, and are pushing vaccines on their patients

even though such vaccination is resulting in injuries they are seeing in their patients and their

hospitals.97

Further, these pediatricians are receiving bonuses from their hospitals, insurance companies and

vaccines manufacturers (directly or indirectly), for ensuring that their child patients get all their CDC

vaccines, are failing to report obvious vaccine related reactions in the VAERS system and are

discouraging parents from filing such reports. As noted above, Dr. Dipp is encouraging me to vaccinate

one of my children and is pushing the CDC agenda, stating that vaccines are safe, while at the same time

refusing to (1) demonstrate that she has extensively studied the pros and cons of vaccination, and (2)

refusing to sign a waiver to her immunity from vaccine injury if my child were to be injured by such

vaccination. In an attempt to humiliate me and make me feel guilty in one office visit Dr. Reinaldo told

me that he wished that his son did not attend the same school as mine, as mine would infect his.

Sharp Rees-Stealy and other hospitals are also profiting from both the administration of vaccines, as well

as the complications that are associated with vaccine injury and all necessary medical procedures that

are followed in such instances resulting in prolonged hospitalization and additional medical treatment.

Similar to the CDC, these hospital physicians focus on pharmacological products to address all ailments

and diseases as opposed to focusing on the strengthening of the immune system through natural and

good nutrition, use of supplements, and homeopathic remedies that do not have the negative side

effects of vaccines, as most if not all orthodox medicines which only help with symptoms, but not for

curing diseases. All one needs to do is to listen to all the side effects listed by the pharma industry in

their commercials.

- Wilma J. Wotten, MD, Health Officer & Director, Co. of San Diego Health & Human Services Agency,

et al

Ms. Wotten and other health department representatives have been working together with NACCHO

representatives in order to help to eliminate the personal and religious beliefs exemption for purposes

of school attendance,98 putting pressure on school districts to follow suit and providing incentives for

them to do so.

The San Diego County Health department further hides its own records that show that it is indeed

vaccinated children who are typically involved in related outbreaks and are the ones that spread

diseases such as whooping cough upon the masses, both vaccinated and unvaccinated.99

Department of Public Health and local health agencies in order to enforce the compulsory vaccination

program agenda.

Schools administrators are being told to not question the vaccine policy and to simply put it in place,

even though it is evident to these school principals and staff that every day more autistic and

physical/mentally affected children are appearing in their schools. One only needs to speak with the

parents of these special needs children to discover that most of these parents have stories of their

children being affected by these mandatory vaccines, and who believe their child’s present condition is

directly associated with such vaccination. To make matters worse, these parents usually remain silent

about this link between injury and vaccines due to pressure placed on them by their doctors, their

health departments, their school representatives and other authorities, who without proof dismiss their

claims.

- University of California Board of Regents, et al

In collusion with education and health departments’ personnel, as well as other unknown individuals,

the U.C. Board of Regents are violating its student’s rights as described herein by attempting to

implement mandatory vaccine policies over the entire college and university system.100

- Francisco Escobedo, Nancy Kerwin, Ernesto Villanueva, Chula Vista Elementary School District, et al

Two of my children are presently attending an elementary school in one of the Chula Vista, California

schools. Personnel from the Chula Vista Elementary School District are doing everything in their power

to ensure that parents of unvaccinated children are misinformed as to their rights not to vaccinate their

children, even though they have been informed how such actions are violating our rights101 and their

oath of office.

The text of SB 277 authorizes parents to submit a letter or affidavit in opposition to mandatory

vaccination for their child by January 1, 2016, which letter/affidavit would guarantee that such child

would not require vaccination to attend school until the next grade span.102 Gov. Brown issued his SB

277 signing statement in June 30, 2015. Even though Mr. Escobedo, Ms. Kerwin and Mr. Villanueva

knew about this, they failed or refused to issue any notice to parents of unvaccinated children to that

effect until and after the deadline had passed.

Under a Public Records Act (PRA) request the District provided correspondence from Deann (Jeffreys)

Ragsdale, Executive Director of Special Education and Instruction, to Nancy Kerwin, Executive Director of

Student, Family and Community Services, dated August 17, 2015, shortly after the passing of SB 277. In

the email it notes that children that submit a personal belief exemption before January 1, 2016 could

proceed to attend school without complying with the vaccination mandate.103 Even though it had this

information and an obligation to notify parents of unvaccinated children of this opportunity to avoid

vaccination, at least until the next grade span, the District failed or refused to do so.

In further correspondence with Ernesto Villanueva, Executive Director of Operations and Instruction,

dated July 6, 2016, Mr. Villanueva admitted that after the passage of SB 277 the District did not send any

notification of the January 1, 2016 deadline to submit the vaccine exemption letter/affidavit to parent of

unvaccinated children, even though those parents were easy to identify.104 In a second email, dated July

16, 2016, Mr. Villanueva noted that these parents were only provided notice of the letter/affidavit

dateline requirement when the District distributed its 2016-2017 school year registration packages,

which took place in or around March of 2016 – NINE MONTHS AFTER SB 277 TOOK EFFECT, ensuring

that parents of unvaccinated children who were not aware of SB 277 the January 1, 2016 deadline and

therefore missed their opportunity to opt out of the SB 277 vaccine mandate for as long as possible.105

Further, requests to the District and their Board of Education members to address the concerns of

parents of unvaccinated children and the creation of a Vaccine Citizen Advisory Committee under

District rules, as authorized by Board Policy 1220 and Administrative Regulation 1220, have been denied

without acceptable justification.106 This is a violation of all District Staff’s oath of office to comply with

the U.S. and California Constitutions and to not violate our religious rights and all our other rights as

noted herein.

- Chula Vista Elementary School District (California) Legal Representative Dean T. Adams

Mr. Dean Adams, as representative of the Chula Vista Elementary School District, has violated his

professional oath of office to uphold the Constitution and protect our 1st Amendment and other rights

by instructing the District to ignore all my requests to address my concerns regarding mandatory

vaccination for my children and other none-vaccinated children in the District, and to deny all my

requests to allow children to attend school using the religious exemption, which is in violation of our

U.S. and California Constitutions religious rights, as well as all other rights noted herein.

Mr. Adams has further ill-advised the District into denying my request to create a citizen advisory

committee to represent parents of unvaccinated children.

REMEDY AND RELIEF REQUESTED

Through this civil and criminal rights violation complaint, I and all in my class, request that the U.S.

Department of Justice, the U.S. Department of Health and Human Services, and the U.S. Department of

Education, separately or together, do the following:

1. Investigate all the claims in my complaint.

2. Establish a grand jury to present evidence against the above named Criminal Participants.

3. Take legal action against the Criminal Participants, both through civil action and criminal

prosecution to the highest extent of the law, including fines, jail time, and where applicable the

death penalty. Applicable crimes to include genocide and crimes against humanity, and

conspiracy to do the same. Legal actions in the United States should not bar any criminal actions

in international courts of justice similar to those proceedings carried out in the Nuremberg

trails.

4. Stop all funding of California state institutions, including the departments of health and

education, until such entities change their policies and start allowing unvaccinated children to

attend schools and employees to work in any area without the need or requirement of

mandatory vaccination. Specifically, that any California state funding from the U.S. federal

government associated with the departments of health and education be halted until SB 277 is

repealed or revised to allow the personal and religious beliefs exemptions to compulsory

vaccination in order to attend school or work in any employment position in the state.

5. That the U.S. Department of Justice move to eliminate the existing Vaccine Court so that vaccine

manufacturers can be held liable for any damages caused by their products, equal to what all

other manufacturers of medications and medical devices face. And

6. That the U.S. Department of Justice, through the funds collected by imposition of fines on any or

all Criminal Participants, compensate parents of children who were injured by vaccines in a fair

and equitable manner, and that the claims of all those denied such justice under the Vaccine

Court that their cases be further investigated in the light of the evidence provided herein, and

that they be allowed to bring their actions outside of the vaccine court, as would be allowed

against any manufacturer liability lawsuit.
