Montana Shooting Sports Association

Missoula, MT --(Ammoland.com)- Briefs are getting filed in MSSA v.

Holder before the Ninth Circuit Court of Appeals.

This is MSSA’s lawsuit to validate the principles of the Montana

Firearms Freedom Act.

This a challenge to federal power asserted under the Commerce Clause of

the U.S. Constitution to regulate every human (and non-human) activity

under the guise of regulating “commerce … among the several states.”

As more briefs become available, we will continue to post them at the

link below.

Appellants (those of us appealing the adverse decision of the federal

District Court) include MSSA, the Second Amendment Foundation, and

myself as the sole individual plaintiff.

Available so far are Appellants’ Principal Brief, the brief of the Center for

Constitutional Jurisprudence and the brief of the Pacific Legal

Foundation.

Expected by the deadline next Monday are the briefs of the Goldwater

Institute (now including CATO), the State of Utah (also representing

several other states), the State of Montana (now backed down from

Intervenor status to amicus status), Montana Legislators, Gun Owner’s

Foundation (Gun Owners of America [also with U.S. Justice’s Gary

Kreep] ), the Weapons Collectors Society of Montana and perhaps even

Virginia Citizens Defense League

Covington VA --(Ammoland.com)- The Fairfax County Board of

Supervisors and Delegate Dave Marsden (D) are all pouting over the

pneumatic gun bill that becomes law on July 1st!

The pneumatic gun bill, put in by Senator Roscoe Reynolds (D), passed

easily earlier this year, and was signed into law by Governor Bob

McDonnell (R). It takes away the power of localities, such as Fairfax, to

ban shooting BB and pellet guns on a person’s own property as long as

they do so in a safe manner.

As you can imagine, lowly citizens having such power and responsibility

is just too much for the poor Fairfax Board of Supervisors to bear!

Tyrants simply do NOT give up power easily.

To top it off, the Fairfax County Board of Supervisors are such

hypocrites. When Reynolds’s bill was being heard in the General

Assembly in January, a Fairfax representative assured the committee

that Fairfax had no interest in enforcing the ban on shooting air guns in

residences. But now that the bill is becoming law, the sky will fall if

people start shooting BB guns in their basements.

Sheeesh. Where are the adults when you need one?

Anyway, just to let the General Assembly know how much this new law is

hated by the people of Fairfax, the Board of Supervisors is having a

special public hearing and they will be forwarding the input to the

General Assembly!

Sooooo, they want to hear from the public, do they? I think VCDL can

oblige them! Don’t you agree, NoVA gun owners?

The nearing is going to be held on Tuesday, June 21st. More details on

time and location will be provided as the event gets closer.

I know that I’m not about to miss this circus! See you there.

this year in the Heavy Optics Division. Dueck and Voigt were also

teammates on USA’s 2008 IPSC World Shoot team where they took top

honors in the Modified Division.

JOHNSON, Vt. --(Ammoland.com)- Orion – The Hunters’ Institute

applauded the signing of H.91 by Vermont Governor Peter Shumlin,

which mandated Vermont’s fish and wildlife are to be held in public trust

by the state for the benefit of all citizens.

Using its expertise in public trust issues, Orion played a leadership role

within a broad coalition that worked to reverse an amendment passed in

the final days of Vermont’s 2010 legislative session. This amendment

changed the status of native deer and moose at a high fence shooting

facility from public to private ownership.

“Orion was very concerned about setting the precedent of

transferring ownership of public wildlife resources to

individuals for their personal gain. We viewed this as an

action that threatened wildlife management not only in

Vermont but throughout the United States,” said Eric Nuse,

executive director of Orion – The Hunters’ Institute.

“Our public trust work related to high fence issues in

Montana as well as technical papers by The Wildlife Society

and Vermont Law School gave us the legal arguments to be

successful. All of the major conservation groups and leaders

of the hunting community were ready to fight to keep our

wildlife wild. When I sent the word out to convene the public

trust coordinating group and provide expert testimony to the

legislature, there was no shortage of volunteers.”

Nuse credits Vermont Representative Kate Webb for championing this

bill in the legislature and praises the support of Fish and Wildlife

Department Commissioner Pat Berry and his staff. Others who assisted

this effort include Fish and Wildlife Board President Brian Ames, former

House Majority leader Floyd Neice, former commissioner Steve Wright,

Senator Ginny Lyons and Governor Peter Shumlin.

Hunters also played a big role in advancing the issue of Vermont fish and

wildlife being a public resource instead of being privately owned,

according to Nuse. All of the major hunting and conservation groups

contributed from the Vermont Federation of Sportsmen’s Clubs to Wild

in Vermont, the state wildlife rehabilitator group.

“It was Vermont’s hunters who were the foremost advocates

for this law and took the cause to the legislature. Vermont’s

constitution provides for hunting as a right for all citizens.

This new law prevents private individuals from taking

personal ownership of live wildlife for any purpose,” Nuse

said. “Hunters want Vermont’s wildlife to remain wild, owned

by no one and under the trusteeship of the state’s Fish and

Wildlife Department. That agency’s trained biologists provide

the stewardship to ensure future generations of all

Vermonters – hunters and nonhunters alike – will be able to

enjoy and take pride in this magnificent heritage.”

when shared. The Missouri Department of Conservation’s (MDC) recent

Discover Nature Women summer workshop showed that nature is one of

those things.

With the program’s highest attendance ever, more than 130 women

participated in the 2011 event held at Windermere Conference Center in

Roach, Mo., June 3-5. Some attended to gain valuable outdoor

experience, some to spend a weekend with friends and family and others

to make a grandmother-mother-daughter getaway.

“Discover Nature Women (DNW) provides a safe and friendly

environment where women experience hands-on outdoor

skills training at the beginner level, taught by a team of

longtime professionals,” said MDC Education Programs

Supervisor Kevin Lohraff.

Courses include fishing, basic hunting, an introduction to firearms,

archery, shotgun shooting, camping, canoeing, map and compass

reading, fly tying and Dutch-oven cooking. DNW offers a two-year

program that allows participants to complete four courses each year for a

total of eight core courses. The weekend is targeted to women 18 years

and older, along with young women age 14-17 when accompanied by a

woman 18 years or older.

“Not everyone has a chance to learn these outdoor activities

or someone who can teach them,” Lohraff said. “Discover

Nature Women is about helping women do things they might

not be able to do otherwise.”

A FAMILY AFFAIR

Many women attend DNW to learn and spend time with family. It was a

tri-generational outing for Sandi Rice’s family. Rice, who lives in

Pittsburg, Mo., attended with daughter Christy Jolly and granddaughter

Jessica Jolly, who live in Kansas City. Rice had attended a previous MDC

women’s event, but her daughter made the decision to come to DNW.

“I just thought, ‘What a great opportunity to do this

together,’” said Christy.

Grandmother and mother were thrilled to share the experience with

Jessica, who tied her first fly during the program and took it fishing at

her grandmother’s nearby home that evening.

Elizabeth Gann of Waynesville, Mo., came with her sister, Shirley Beer,

who lives in Pittsburg, Kan.

“We don’t get to see each other very often,” Gann said. “This

is a great way for us to spend some time together and do

something we don’t normally do.”

Gann said she initially thought the workshop would teach her some

outdoor skills she could practice with her husband, who hunts and

fishes.

“Then I thought, ‘No, this is about learning things for myself

and spending time with my sister,’” Gann said.

GIRLS’ WEEKEND OUTDOORS

Friends Amy Huff of Fenton, and Stephanie Allstun of Ballwin, made the

trip to learn outdoor skills from experts along with other women at

similar skill levels.

“The instructors here are just so knowledgeable,” Allstun

said. “They live it; they breathe it; they love it.”

“I wanted to be taught by someone with patience who was a

good teacher,” Huff said. “They made me feel comfortable

that I was learning it the right way.”

Huff said she looks forward to using her new archery skills with her 10-

year-old daughter, Aubrey Stuart, who started learning archery at

Meramec Heights Elementary School this past year. Her school

participates in the Missouri National Archery in the Schools Program,

which is coordinated by MDC. Stuart was the top fourth-grade girl at the

Missouri state tournament. She placed 20th out of 188 fourth- grade

girls at the National Archery in the Schools Program national

tournament in Louisville, Ky.

EXPERIENCE TO LAST A LIFETIME

Lori Gale of Festus attended DNW with her friend Amanda Sloan. But

for Gale the weekend was about more than just fun. Gale is a year away

from finishing her degree in fisheries and wildlife management at

Oregon State University, and she received an internship credit for

attending the workshop. Ultimately she wants to work in a wildlife-

related field, possibly as a conservation agent.

“It was nice coming here and talking to experts in the field,”

Gale said.

While she has prior experience in outdoor activities, Gale said the

workshop built on her own knowledge, solidifying some of her fishing

and compass skills.

“Discover Nature Women is just another way MDC makes

Missouri a great place to hunt, fish and enjoy nature,” Lohraff

said.

“Whether novices or experienced outdoorswomen,

participants gained practical outdoor skills that will help them

discover nature long after DNW’s conclusion,” said MDC

Education Outreach Coordinator Amy Francka. “All weekend I

heard nothing but positive comments from the women who

attended the event. Most women were first-time attendees and

already wanted to know when they could register for next

year.”

Columbus, OH --(Ammoland.com)- Last week the U.S. Sportsmen’s

Alliance alerted New York sporting dog owners to two bills that would

create unnecessary new regulations for sporting dog owners.

This week it is more of the same in the New York legislature.

Assembly Bill 8146, sponsored by Assemblyman Steve Katz (R- Mohegan

Lake), would require newly defined “backyard breeders” to obtain an

annual breeder permit and adhere to the same standards of care and

inspection requirements that apply to the state’s regulated pet dealers.

A “backyard breeder” is defined as anyone who breeds one

female dog for compensation.

Under the bill, these breeders are required to obtain an annual $150

permit before they are allowed to breed any dog. They must also comply

with the care, housing, and inspection requirements meant for

commercial pet dealers that are already contained in current law.

“This bill forces regulations that are designed for commercial

pet dealers onto sporting dog kennels, hobby breeders, and

individual dog owners,” said Evan Heusinkveld, U.S.

Sportsmen’s Alliance director of state services. “There is

simply no justification for applying this type of regulation to

these dog owners.”

Take Action! New York sportsmen should contact their state legislators

and ask that they oppose Assembly Bill 8146. Tell them sporting dog

owners should not be required to obtain a new costly annual permit and

comply with new regulations simply because they may breed and sell one

California Anti-Gun Bills Aim to Grab Sportsmen’s Gun Rights

Sportsmen calls needed as the California legislature is moving two anti-

gun bills.

California to Ban Airsoft Guns by Color

U.S. Sportsmen’s Alliance

Columbus, OH --(Ammoland.com)- Senate Bill 798, sponsored by Sen.

Kevin De Leon (D- Los Angeles), would ban the sale of all airguns,

including BB and pellet guns used by many sportsmen for small game

hunting and target shooting.

Under the bill, these firearms could not be sold unless the entire exterior

surface of the gun was predominately colored: white; bright hues of red,

orange, yellow, green, blue, pink, or purple; or is transparent. The bill

would effectively ban most airguns used by sportsmen as most of these

guns rightfully look like other firearms and not “toy” guns.

“Airguns, like BB guns and pellet guns, are real firearms used

by sportsmen for hunting and target shooting,” said Jeremy

Rine, U.S. Sportsmen’s Alliance associate director of state

services. “It makes no sense to ban these firearms unless they

are colored to look like a child’s water gun or other toy gun

that you would buy from the toy isle of a store. If passed,

sportsmen would be unable to continue to purchase

traditional airguns used for hunting, and law enforcement

will be unable to tell the difference between what is a real

firearm and what is a toy gun.”

The bill has passed the Senate and is schedule for a public hearing on

June 14th before the Assembly Committee on Public Safety. The hearing

will take place at 9:00 a.m. in State Capital Room 126. Sportsmen are

encouraged to attend the hearing and voice their opposition to the bill.

Assembly Bill 809, introduced by Assemblyman Mike Feuer (D- Los

Angeles), would apply the state’s handgun registry requirements to all

firearms, including rifles and shotguns commonly used by sportsmen for

hunting and recreational shooting.

Gun owners would be required to register all of their firearms and

provide personal information that includes their name, address, place of

birth, telephone number, and occupation. It would also require gun

owners to provide a detailed description of the gun, including serial

number. This bill is unnecessary and is an invasion of gun owner rights.

AB 809 has passed out of the Assembly and will head to the Senate.

Protection has released a new film documentary and companion school

curriculum as part of its continuing effort to educate New Jersey

residents about co-existing with black bears as numbers of the animals

have increased, resulting in more bear-human encounters.

More than four years in the making, the documentary entitled “Living

with New Jersey Black Bears” was developed with scientific input from

New Jersey wildlife experts. The end result is a comprehensive and up-

to-date educational film to help the public better understand and co-

exist with black bears by taking viewers into the world of the black bear

and to see how the State manages its bear population.

The 60-minute documentary, created by wildlife film producer Dan

Bertalan, explores the growing national conflict of sharing the landscape

with black bear populations, and offers a special 15-minute segment

uniquely devoted to the issue of black bears in New Jersey.

“Understanding Black Bears,” which is an adapted and expanded

classroom version of the documentary, also is now available. This new

interactive classroom curriculum covers 11 topics with 29 separate

classroom activities and will be distributed free to interested school

systems and teachers.

These new tools are part of the State’s educational portion of its

Comprehensive Black Bear Management Policy, which was approved last

year to deal with an overpopulation of black bears in the Northwest part

of the State, and a growing presence of black bears throughout the rest of

New Jersey

“Black bears are part of the wide ranging mix of wildlife that

lives in our state, providing an incredible diversity that

requires consistent and professional management by our fish

and wildlife experts,” said Amy Cradic, the DEP’s Assistant

Commissioner for Natural and Historic Resources. “The

science- and fact-based comprehensive black bear policy

recognizes that bear management requires a combination of

tools, including public education and scientific research.

“This new film and curriculum will provide an important tool

in helping our residents learn to co-exist with black bears and

to better understand the complex nature of the job faced by

our top-notch wildlife team,” said Assistant Commissioner

Cradic.

The black bear policy includes public education, research, bear habitat

analysis and protection, hunting, non-lethal bear management

techniques, enforcement of laws, and efforts to keep human food

sources, especially household trash, away from bears to limit bear-

human encounters.

New Jersey boasts a robust black bear population, estimated at more

than 3,400 bears in the northwestern part of the State. Bears sightings

have been reported in all 21 counties. Sightings have increased in recent

years in many suburban towns and even urban areas.

With New Jersey’s black bear and human populations at all time highs,

bear-human conflicts have risen during the last decade. They range from

simple nuisance bears foraging in residential trash cans or invading

backyard bird feeders to the problem of bears losing their fear of

humans, which poses a safety threat to people and can have fatal result

for bears.

Young Conservatives of Texas call upon Governor Rick Perry to add

“campus carry” to the agenda.

Tony McDonald, senior vice chairman of Young

Conservatives of Texas and a law student at the University of

Texas at Austin, commented, “By adding ‘sanctuary cities’ to

the special session agenda, Governor Perry has shown that he

intends to undo the damage done by a handful of liberal

legislators who sought to stand in the way of the majority’s

hard work.

It only makes sense that he also add ‘campus carry,’ an issue

that clearly has majority support in the Texas Legislature and

that has a much longer history than ‘sanctuary cities’ of being

blocked by parliamentary chicanery.”

During the regular session of the 82nd legislature, 88 of 150 Texas

Representatives signed on to Representative Joe Driver’s campus carry

bill, HB 750, as coauthors. And when Senator Jeff Wentworth offered a

campus carry amendment to another higher education bill, SB 1581, 21 of

31 Texas Senators voted to support it. But as happened in 2009, campus

carry passed out of the Senate only to be killed on a technicality in the

House, without ever receiving a floor vote.

Young Conservatives of Texas believe that the proven track record of

licensed concealed carry throughout Texas, coupled with the proven

track record of licensed concealed carry on numerous college campuses

outside of Texas, clearly demonstrates that there is no reason to deny

trained, licensed adults the means to protect themselves on Texas college

campuses.

McDonald concluded, “In years past, Governor Perry voiced

strong support for this cause. Our organization and many

others hope that he will embrace this opportunity to back up

those strong words with strong action.”

application deadline for 14 open Natural Resources Police Officer

(NRPO) positions statewide is this weekend, according to Lt. Tim

Coleman of the Law Enforcement Section of the West Virginia Division

of Natural Resources (WVDNR).

All candidates are required to pass a Physical Agility Test (PAT) at West

Virginia State University in Institute, W.Va., on Friday, June 10, 2011, or

on Saturday, June 11, 2011. The tests start at 8 a.m. each day. Walk-ons

will be accepted.

prompt, orderly and effective enforcement of all laws and rules of the

importance is the protection of West Virginia’s wildlife to the degree that

they are not endangered by unlawful activities

To be considered for this position, candidates must be willing to relocate

and work in any county in the state; must be willing to work all shifts and

be on call; and understand that this is a statewide position, and as such,

that the county of assignment may not be guaranteed.

Minimum qualifications include graduation from an accredited four-year

college or university with preference given to majors in natural sciences,

law enforcement, criminology, or criminal justice, or candidates may

substitute previous employment as a law enforcement officer under

certain circumstances.

The PAT consists of three parts: a 37.5 yard swim; an agility test

consisting of completing a minimum of 18 pushups in proper form in one

minute and completing 27 sit-ups in proper form in one minute; and a

1.5 mile run in 15 minutes, 20 seconds or less. Failure to satisfactorily

complete any part of the test is cause for disqualification and will

eliminate candidates from further consideration.

Directions: Take Exit 50 (Institute) off I-64; turn left onto Route 25; turn

right at the first traffic light onto Barron Drive; turn left onto Academic

Drive and park in Lot G. Enter Fleming Hall through the Chester Burris

entrance.

Simply glancing down at the back of the magazine from his cheek weld

shows the approximate number of rounds remaining.

When the magazine is full the operator will see the brass round casings

the middle window is empty only 19 rounds remain in the magazine.

Then the operator glances at the top window. When the top window is

empty only 11 rounds remain.

This three window system shows that when the middle window is empty

the operator has 2/3rds or fewer of the rounds remaining and when the

top window is empty only 1/3 of the rounds remain in the magazine.
