IDOT Secretary Blankenhorn is Committed to Illinois’ Infrastructure

IDOT Secretary Randy Blankenhorn told a crowd of more than 400 IAAP members and guests during IAAP’s annual convention February 23rd that he supports user fees that will provide for an increase in revenue to make the necessary investment in Illinois’ transportation system which he acknowledged drives the Illinois economy towards success. And while the “Lockbox Amendment”, which received huge support on election day last fall, will help ensure transportation related taxes and fees are used to build and maintain roads, the State has no operating budget so IDOT’s focus will be on maintaining our highway system with an emphasis on ensuring bridges are safe. Blankenhorn highlighted several big projects IDOT will be working towards, including a public-private partnership to add managed lanes on I-55 and he noted the owners of

CenterPoint Intermodal Center in Joliet have agreed to work with IDOT to build a bridge for better access to I-80. 2017 Safety Conference and Convention Highlights

Where were you last week? If you were not in Springfield for the IAAP’s 49th Annual Convention combined with the Aggregate Miner Safety Conference then you missed seeing your friends and business associates working in the aggregates industry and learning about the goods and services offered by 85 of IAAP’s associate member companies with booths in the expo. Three days of educational workshops and social events made the whole week worthwhile. Coming to Springfield gave you the opportunity to learn a lot! During the Aggregate Miner Safety Conference, Joe McGuire (Oldcastle Materials Cessford Construction) said individual employees

are responsible for identifying and mitigating hazards which could lead to unwanted events in the workplace, but some employees are willing to tolerate more risk when performing a task than others. Zach Knopp (Caterpillar Safety Services) explained how to help employees learn effective communication; how to give and receive feedback; how to focus on the message, not the messenger; and how each employee is able to contribute to workplace safety when listening and responding to another. Pat Kirk (MSHA Peru Field Office Supervisor) explained MSHA’s priority issues and safety concerns. Jack Pieper (Rockford Rigging) provided application information for safe lifting beginning with inspection and retirement criteria then proper use to abide by MSHA and OSHA standards. Mark Murray (Buckley Powder) addressed the principal causes of blasting accidents including fly rock and guarding the blast area. Ryan Seelke (law firm of Steelman, Gaunt & Horsefield) explained Section 110 liability, agents of

the operator, workplace exams, and topics pertinent to the nature of special investigations. Billy Powell (Smith & Nephew), in a very dynamic way, illustrated creative, engaging, outside-the-box ways to get employees motivated, energized and ready to listen about all aspects of safety. Jason Schlee (Vulcan Materials), recipient of the 2016 IAAP Innovative Safety & Health Leadership Program award, showed us how interactive workstations at annual refresher training results in effective training by encouraging

active participation. Gary Wangler (Illinois Eastern Community Colleges) illustrated the properties of flammable and combustible materials common on mining sites and how to keep employees safe. The safety conference wrapped up with Denver Smiddy (MSA) demonstrating best practices and new technology for fall protection, how to properly select and don fall protection products, and concluded with a demo outside. Convention Highlights The IAAP convention also included outstanding educational seminars. Sheila Beshears and Sean Stutler (IDOT Central Bureau of Materials) addresses a broad range of recent aggregate issues including how Illinois’ aggregate policy has changed and a look into the future. Chris Maynard and Kelan Moylan (TCI Manufacturing and Equipment Sales) discussed the key factors that make a high frequency screen work and how to turn waste products into sellable products. Brian Isbell (Kespry) illustrated how automated drones enhance safety measures today and where our industry will further benefit from drone technology in the near future. Jeff Taylor (Sauls Seismic) along with attorney Kelly Ratliff (Montgomery, Rennie & Johnson) provided recommendations for best management practices that improve risk management and liability protection in blasting operations and prevent regulatory issues or frivolous blast damage law suits. Daniel Goldfarb (Wildlife Habitat Council) told us how his organization works with aggregate mining companies to

gain certification and the cost/benefit of participating in WHC programs. Ed Elliot’s Safety Leadership presentation outlined steps managers can take to change the culture of their organization to assign a greater value to safety and health. Emily Coyner (NSSGA) explained the golden opportunity the new Trump administration presents to make common sense changes to environmental requirements that help the aggregates industry. Vibra-Tech’s Michael Spors explained some of the key engineering characteristics of pipelines that affect the allowable vibration limit. Tredroc Tire Services’ Steve Helfers explained various components of tire safety. Dirk Krueger (Command Alkon) highlighted how automating site processes increases productivity. IEPA Director, Alec Messina, discussed environmental topics important to the industry and answered questions from attendees. All of these topics were presented before we had the pleasure of hearing an address from IDOT Secretary Randy Blankenhorn who outlined the challenges faced

by the State of Illinois and his ideas to fix them. Many of these presentations are available for download on the IAAP website at:

www.iaap-aggregates.org/convention2017eduprogram.htm. IAAP Committee chairs reported their past accomplishments and future goals. Board of Directors member Alan Shoemaker (Tuscola Stone) was honored for his outstanding service as chair of the Safety Committee from 2012 to 2017. He has turned over the position to Jason Schlee (Vulcan Materials).

The IAAP convention once again proved to be a great opportunity for members to socialize while enjoying good food and drink in Springfield. And let’s not forget the efforts of the IAAP Public Information and Education Committee members selling 50/50 raffle tickets raising money for their educational efforts. Bob Kurz (Polydeck Screens) purchased the winning ticket and was awarded $3,100. And speaking of generosity, eight IAAP members donated 7 units of blood to the Central Illinois Community Blood Center. Your donations potentially help 28 patients receiving transfusions in local hospitals or blood may be used as red cells, platelets, cryo, or plasma.

Senate “Grand Bargain” Budget Package Stalls Progress on the Senate’s “Grand Bargain” budget package came to screeching halt on Wednesday when agreement could not be reached on the final sticking points in the package. Senate leaders had planned to vote on the entire package of a dozen bills this week. However, after passing several less controversial pieces - including proposals on procurement reform, expanded gaming, local government consolidation, Chicago teacher pension funding and spending for the remainder of the current fiscal year - the potential package fell apart when agreement could not be reached on taxes, workers’

compensation reform, education funding reform and future spending. Democrats blamed Governor Rauner for killing the package by “interjecting himself” in the process with demands. Meanwhile, Republicans blamed Democrats for pulling back concessions the Republicans thought they had won on workers’ compensation reform. The “grand bargain” package is structured so that if one bill fails to pass into law, the entire package is dead. The Senate adjourned today and will return next week. Negotiations could resume at that point after a “cooling off” period. A new amendment was introduced as the tax component of the package this morning. The 476-page amendment, Senate Amendment 3 to SB 9 (http://www.ilga.gov/legislation/100/SB/10000SB0009sam003.htm) removes the “business opportunity tax” that would apply to employers which was contained in the previous version and adds to the list of services that would be taxed. In addition to hiking income taxes, the new amendment would still decouple Illinois from the federal Domestic Production Activities Deduction (DPAD - IRS Section 199). The amendment also contains a favorable component for the industry by including “tangible personal property” used in the manufacturing (mining) process as items exempt from sales tax under the MM&E exemption. However, the bill remains a net loser for the industry and the IAAP is opposed. We maintain that any “grand bargain” budget deal should include a capital spending component. IAAP Fights Proposals to Mandate Water Monitoring at CCDD/USF Facilities

The IAAP is currently battling against two bills that have been filed to mandate water monitoring at Clean Construction or Demolition Debris (CCDD) and Uncontaminated Soil Fill (USF) facilities. HB 3056 (McDermed) is an initiative of Governor Rauner’s administration and was filed in response to recent media reports related to the issue. HB 2770 (McAsey) is identical to a proposal filed last fall which also would create a new fee structure for CCDD/USF operators. Both bills have been assigned to the House Environment Committee. We ask you, IAAP members, to contact Representatives on this House Committee (http://www.ilga.gov/house/committees/members.asp?CommitteeID=1899&GA=100) and urge them to OPPOSE this unnecessary mandate which would harm an environmentally sound program that benefits Illinois taxpayers by lowering construction costs. IAAP Industry Leadership Award Hanson Material Service’s Morris Sand Plant

The goal of this award, now in its second year, is to recognize an IAAP producer member’s mine site that has demonstrated leadership excellence within our mining industry. Leadership can be de-termined in large part by employee participation in IAAP activities and company/mine site recogni-tion award and certificate programs as well as efforts to promote the image and wellbeing of the industry, company, mine site, and its employees. All IAAP producer members were eligible, appli-cations are not required. IAAP staff and active committee chairpersons tracked the criteria throughout the past year then all the criteria were reviewed in February to determine mine sites wor-thy of the award. Hanson Material Service mines in many commu-nities in Illinois. Its employees actively serve on every IAAP member committee, chairing one committee now and enthusiastically accepting special working-group assignments that benefit all companies mining in Illinois including charting a collaborative course for the future of the Illinois State Geological Survey and the Prairie Research Institute. Two years ago, the company was rec-ognized with an Innovative Safety & Health Leadership award granted by the IAAP. In 2016, Han-son Material Service stepped up with talent and resources to host the MSHA Regional Stakeholders meeting with Joe Main and top MSHA officials. They have volunteered countless hours towards outreach to area communities including introducing kids and their parents to mined products and fossilized creatures found in the Chicago region during a PopUp Science event at Homewood Sci-ence Center. Through their generous “Rock Star” level contribution to the IAAP PAC and hosting a visit from Illinois Congressman John Shimkus to one of their quarries last year, they are helping to educate and support lawmakers affecting policy right now. And they continue to contribute to the benefit of IAAP members by sponsoring teachers attending the Rocks, Minerals & Mining workshop and serving on the IAAP Board of Directors. But one of its eight mining operations in Illinois, the Morris Sand Plant, stands out among the oth-ers promoting the company’s image and the industry as a whole. At the IAAP convention, this mine, with just five employees, has been recognized with a Community Relations award, a Certifi-cate of Achievement in Environmental Excellence, and a Rock Solid Excellence in Safety award which was achieved in part due to no MSHA violations and no reportable injuries last year. For a number of years, the mine has been part of a collaborative effort with IDNR, USGS and Army Corps of Engineers to test new methods of controlling the spread of invasive Asian Carp into the Great Lakes. Going above and beyond what is necessary to do business in a community, this mine donated wood from an old barn on site that will be used as decorative paneling at a community-based fine arts center and held an educational open house for local residents and dignitaries to give them an opportunity to witness the mining process and learn about safety measures and environ-mental efforts.

Oldcastle Materials - Cessford Construction Receives IAAP Innovative Safety & Health Leadership Award

The IAAP’s Safety Committee members devel-oped the Innovative Safety & Health Leadership award with the expectation it will highlight prac-tices by one company thereby providing others with an innovative example they may use at their own operations. The Committee grants this award to a company, workplace team, or individual demonstrating superior or exemplary contribu-tions in safety & health leadership that engage employees with the understanding of what is needed to build and sustain an injury free work-place through their innovative and collective ef-forts. Oldcastle Materials – Cessford Construction’s environmental advisor, Joe McGuire, submitted his company’s “MSHA Annual Refresher Education” program for consideration and it was selected by members of the IAAP Safety Committee for this prestigious award. Now in its third volume, these educational workbooks and the delivery process developed in 2014 goes beyond providing traditional training to employees. They meet the true definition of “education” by encouraging employees to think, solve problems, and participate through a dialogue with their co-workers. The majority of the content in the third volume focuses on leadership as it relates to safety and how stress can affect one’s performance at work. Helping employees understand they may be required

to step up and become leaders and how leadership is related to reduc-ing accidents, injuries and fatalities on mine sites is information a ma-jority of employees will typically not receive in annual MSHA train-ing. Research shows, when leadership is weak or missing, a compa-ny’s safety culture and its employees’ safety performance are affected in a negative manner. Throughout this series of workbooks, Oldcastle Materials’ Cessford Construction employees are increasing their knowledge of safety and developing a better understanding of “why” they are asked to become leaders, perform high quality risk assessments, and do task training in a manner which will prevent them and their co-workers from being injured in the workplace. As evidence of its success, by the end of 2016 the frequency of re-

portable injuries was reduced by over 50% with a downward trend over these years. There have been no loss time incidents at Cessford Construction’s mining operations in over three years. Joe McGuire’s “MSHA Annual Refresher Education” program will be featured at next year’s Ag-gregate Miner Safety Conference where you will learn how it’s approach to annual refresher train-ing may be adopted for your employees.

IAAP “Rock Solid” Safety Awards For the past fifteen years, the Illinois Association of Aggregate Producers (IAAP) Safety Commit-tee has encouraged companies to adopt systems and practices that prevent injuries or illnesses by recognizing members with its “Rock Solid” safety award program. Before this year’s awards were announced, Pat Kirk (MSHA Peru Field Office Supervisor) addressed everyone in attendance at the IAAP convention and commended their ongoing efforts to ensure miners remain safe and healthy. In developing this program, Safety Committee members identified a comprehensive list of im-portant activities or policies required for a successful safety and health program and then assigned points for undertaking and documenting each one. Point total determines Gold, Silver or Bronze level awards. This highest award, Rock Solid Excellence in Safety, is granted to companies that achieve Gold Status plus: (a) experience zero MSHA reportable or OSHA recordable injuries or illnesses; (b) experience no MSHA elevated actions (or OSHA serious violation); (c) VPID less than the national average; and (d) attain a total of 7 points in the 1-point and 15 points in the 5-point categories. Of the 33 companies and 103 operations receiving awards at the convention, 52 operations achieved Rock Solid Excellence in Safety status.

Aglime Program Outline for 2017 Season The Illinois Department of Transportation (IDOT) will begin the sampling window on April 1st and continue until May 31st and has committed to have all samples delivered to Illinois Department of Agriculture (IDOA) by June 15th. The Illinois Association of Aggregate Producers (IAAP) is committed to the program as well.

IDOT inspectors will use an aglime submittal form gathering information from producers that will be used to ensure test results are conveyed to the appropriate person at the producer company and enhance the infor-mation contained in the Illinois Voluntary Limestone

Producer Information booklet. IDOA will not accept aglime for testing directly from a producer; aglime samples must remain in IDOT possession until arriving at the IDOA lab. Unlike in previous years, IDOT inspectors will not offer aglime producers the option of a split sample. You may take your own sample for independent testing; however, limited retesting is still available as outlined below. IDOA expects to begin testing samples in mid-June. Testing will be done on newer ICP equipment using an approved ASTM method and anticipates completing testing by July 31st. The IDOA lab is committed to quality control and following standard operating procedures includ-ing using standard aglime samples to check ICP calibration before and after a run of samples. Data entry will be done into an Access database that can produce batches of results in spreadsheet form. These batches will be passed along to IAAP who will send results to individual producers via email. Producers may request limited retesting of aglime samples if they believe the testing results are in-accurate. A retest request must be made to the IAAP and done so during the time the IDOA lab is conducting aglime testing. Retests will be done using the original sample. An aglime producer may also ask for return of some sampled material for testing by an independent lab. Prior to publi-cation of the Illinois Voluntary Limestone Producer Information booklet, a producer may ask the IAAP to omit one or more of their aglime results. Test results from independent laboratories will not be published in this booklet. IDOA will use email to send Limestone Analysis Reports to producers when all laboratory analysis are completed. A target date of July 31st has been set for testing to be completed and IAAP will begin compiling the Illinois Voluntary Limestone Producer Information booklet for publication by August 15th. Evaluation of Visible Emissions Course

The Illinois Environmental Protection Agency will offer a course in the Evaluation of Visible Emissions (commonly known as Smoke School) during the week of April 10, 2017. The class will run from Wednesday, April 12 through Thursday, April 13, 2017. Class begins at 9:00 AM each morning with registration beginning at approximately 8:00 AM; everyone must sign in one time only. The Illinois Environmental Protection Agency does not charge a fee for this instruction. Please fill out the online registration form at the link below prior to April 7, 2017. If you do not have access to the Internet, contact Linda Kulek at (217) 524-0546 to request a registration form. Remember to check the designated box for either certifying the first time or recertifying.

MSHA Pausing on Exams Rule The U.S. Department of Labor will take time to review an MSHA rule on workplace examinations. Patricia Silvey, MSHA deputy assistant secretary for operations, told NSSGA that stakeholder out-reach was originally slated to begin in March but will now proceed “at an appropriate time.” “I don’t expect any change over the next month or so,” she said. The rule was published in the Fed-eral Register on Jan. 23rd and set to go into effect on May 23rd. As currently written, the rule re-quires examinations before work begins in a work area. Adverse conditions found during an exam, the dates that exams were conducted, abatements made and the name of the examiner are to be doc-umented. The rule also calls for prompt notification of affected miners to hazards found and not immediately corrected. NSSGA is pleased that the Labor Department will take time to review this rule, and has continually voiced deep concerns that it risks impeding an operator’s ability to effectively manage for safety. Trump Orders EPA to Reconsider WOTUS President Trump has ordered the Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers to review and reconsider the controversial Waters of the United States (WOTUS) rule. The executive order does not require EPA to rescind WOTUS, a rule that drasti-cally expanded the EPA’s jurisdiction of lands deemed to be bodies of water – even on private land – under vague definitions and measurements. It has been under a nationwide stay from the 6th U.S. Circuit Court of Appeals since 2015, shortly after it was enacted. “This is a positive step toward ending the threat of this gross overreach of an agency’s jurisdiction,” said Michael W. Johnson, NSSGA president and CEO. NSSGA has long advocated against the ill-conceived rule that posed serious threats to the aggre-gates industry as well as taxpayers everywhere. Operators would face additional, costly federal per-mitting, correction or mitigation, which in turn would cause increased delays and cost overruns for critical public-works projects. NSSGA also filed a lawsuit against EPA to combat the rule, a step that industry groups and more than half of the states took. Yet, these litigants have not been the on-ly opponents or critics of WOTUS. The sense of the U.S. House of Representatives is that the Waters of the U.S. rule be withdrawn, via a resolution introduced on Feb. 27. Additionally, the House Oversight and Government Reform Committee previously said the rulemaking process “was rife with legal shortcuts, predetermined conclusions, and politically-driven timelines.” Source: NSSGA Digital Aggregate

IAAP Participates in TFIC Lobby Day

IAAP Executive Director Dan Eichholz and IAAP members participated in the Transportation for Illi-nois Coalition’s first Lobby Day of the General As-sembly’s spring legislative session on February 15th. Legislators were informed that an addition $20 bil-lion will be needed over the next six years just to maintain Illinois’ current transportation infrastruc-ture network. TFIC is planning a second Lobby Day in May.
