Legislative Report February 2017

The 2017 General Assembly convened the first week of January and many bills were filed that, if passed, will have significant impact on health care and health care providers in Kentucky.

Here are some of the bills we will be watching:SB105/HB148 – would establish a new profession of certified professional midwives (CPM) in Kentucky. It would create a governing licensure board, standards for education and a scope of practice for CPMs. SB55/HB19 – would grant PAs full authority to prescribe all Scheduled II – V drugs as permitted by the PA’s supervising physician. SB101 – would allow pharmacists to administer immunizations to children age 9-17 years.SB89 – would require insurance coverage of tobacco cessation treatments. SB4 – would establish a review panel utilization in health care provider litigation. SB84 – would establish a school health coordinator in each district, who is a RN, to work in cooperation with others to promote and implement a school health service program. SB 76 – would establish the regulation of cannabis for cultivation, testing, processing, taxing and sale to those age 21 and older. SB57 – would establish a system of regulation for medial cannabis including cultivation, use and possession.

New Regulation

In addition to legislation, a significant regulation is slated to become law on 7/1/17 that will affect APRN prescribing. The regulation, 902 KAR 55:035 will add gabapentin and brivaracetam as a Schedule V drug. Schedule V drugs are exempt from the requirements instituted in HB 1, but they do show up on KASPER reports, which will help to monitor prescriptions for these drugs.

Because gabapentin and brivaracetam will be scheduled, APRNs who do not have a CAPA-CS will no longer be authorized to sign prescriptions for these medications.

So, what’s the plan for 2017?

Our big push this year will be to educate legislators about NPs and CNMs in preparation of a bill we plan to file in 2018 to remove the requirement for the CAPA-CS. We know that removing the CAPA-CS requirement has been on the wish list for many APRNs for quite some time. Senator Hornback, who sponsored our bill to remove the CAPA-NS requirement, recently agreed to sponsor the bill…. and we are thrilled!

But first, there will be significant work that will be required of all APRNs: that is, to educate legislators about the quality care provided by NPs and CNMs. They need to know who we are and what we do every day to improve access to care and the lives of the patients we serve. Cathy Waits is compiling a list of “key legislator contacts”. If you are interested in volunteering to be a contact person for your state Representative and Senator, please get in touch with Cathy. Serving as a contact person is easy and it’s not time consuming, but it can have a significant impact on the success of our future bill.

There are 30 new legislators in the Kentucky House of Representatives and it will be our job this year to educate them and all legislators in both the House and Senate about NPs and CNMs. We know from experience that many legislators still do not understand the full scope of care provided by NPs and CNMs.

While we believe that it is important to remove the CAPA-CS requirement in general, the issue that has forced it to a head is that some insurance companies are requiring the physician who signs the CAPA-CS to be credentialed with their company before they will credential the APRN. In some cases, the physician does not want to participate with that company. Therefore, the APRN cannot be credentialed and provide care for patients who have that insurance. For NPs and CNMs who own their practices it is difficult to locate a physician to sign a CAPA-CS. This is an added burden and has a significant impact on access to care. WellCare and United Health Care both have this requirement.

At the time of this writing February 8 is scheduled to be KCNPNM Legislative Day in Frankfort this year. It is hoped there will be a good turn out so that legislators can meet NPs and CNMs and learn first-hand about the quality care we provide. But the need to educate legislators is ongoing.

Recent Board Actions-November 2016The KCNPNM BOD implemented a plan to form a sister organization to be formed as a 501(c)(6) professional association whereby all things educational would stay with the existing organization and membership, career center, and other member services would move to the new organization. This will entail updating existing governing documents, proposing bylaws changes for member consideration and generating a new application for nonprofit status and governing documents. The existing organization board would retain responsibility for new board appointments. The rationale for this change is that 501(c)(6) organizations do not have limits on lobbying. Other BOD actions were as follows:

Legislative:1. Support bill updating provider responsibility regarding

domestic violence. Instead of mandating that providers report domestic violence to the Cabinet the bill calls for educating the patient/client on resources and domestic

violence programs, as well as how to obtain protective orders.

2. On the issue (last session HB296) related to statutory definition of practitioner of the healing arts, KBN is working on this with the KBMIRT.

3. Not support bill regarding certified professional midwives (CPM) as currently envisioned. Recommend that there be exploration of creating a regulatory entity for CPM practice and housing it under an already-existing board within the Cabinet for Health and Family Services instead of creating a new regulatory board.

Other actions:1. Adopted a policy calling for office hours of 8:30-5pm and

a 40-hour workweek for full-time employees.2. Approved the provision of health insurance to full-time

employees.3. Approved 2017 audit.

American Association of Nurse Practitioners Update

Advanced practice registered nurses (APRNs) across the country have many reasons to celebrate the New Year, especially APRNs serving our nation’s veterans. The United States Department of Veterans Affairs (VA) issued the final rule granting veterans direct access to APRNs. This move will improve veteran’s

access to high-quality healthcare and is in direct response to

the demands from veterans, their families and caregivers. It is hoped that certified registered nurse anesthetists (CRNAs) would be included in the next proposal. This is just one more step in the journey toward full practice authority.Be sure to visit the American Association of Nurse Practitioners webpage www.aanp.org to get the latest updates on MACRA regs. There are resources available to assist all levels of APRNs.

Certified Nurse Midwifery Update

Happy New Year! We look forward to an eventful year, hoping for increased awareness of certified nurse-midwives (CNMs) in Kentucky, as well as a renewed interest in CNM care as primary care providers for women’s health care and childbirth. The University of Louisville now has three

CNMs and their service is growing. They are hoping to add another midwife and soon have their own separate office. There is also discussion of other Kentucky practices adding one or more CNM/s. Frontier’s midwifery program continues to grow and with more midwifery opportunities in KY, we can look forward to CNM numbers growing. In addition to growth, another part of our mission in 2017 is

to increase CNM visibility and educate the public on a CNM’s education and scope of practice. Access to midwifery care is crucial for growth but not all CNM-attended births may be recorded. Underreporting (for various reasons) of midwife-attended births is a problem in some states and most likely a problem in KY. Kendra Adkisson will be conducting a statewide audit to investigate the accuracy of birth certificate data compared to Kentucky midwife birth logs. We are hoping that all midwives in active clinical practice will work with Kendra to assess this important information. Accuracy of reporting will increase visibility and demonstrate value of CNM attended births. The next Affiliate meeting for CNMs in KY will be held during the KCNPNM Conference in April. Annual KCNPNM General Membership Meeting:Be There or Be Square!!!

One of the highlights of the Coalition Conference is the Annual General Membership Meeting Luncheon, to be held on Friday, April 21, from 11 am to 12:30 pm. This is where members really get to participate in Coalition business. The meeting is particularly important this year, and every member

is encouraged to attend. Bylaws that significantly affect how the Coalition does business and performs are going to be discussed. If you are a KCNPNM member it is especially important you attend this year’s business meeting.

The Value of Membership: An Open LetterThank you for writing to me with your concerns about our recent dues increase. I appreciate that you took the time to write. The dues increase was approved by the membership at the business meeting in April. On the surface, it seems like a hefty increase but both the Membership and Finance Committees conducted research and found several facts. We have not increased dues for 9 years and we discovered that our dues were lower than other statewide NP associations in this region. I’m sure it doesn’t surprise you, but operating costs have risen these last 9 years. We want to make certain our annual revenues can meet the financial obligations of our annual budget (even in years of lower conference attendance)

Technology costs are considerable. The Coalition leadership is currently undergoing an audit in this area, exploring more robust systems that are more user-friendly to members on smart phones.

We are adding more and more “non-conference” educational offerings to further meet our mission of APRN education. We are planning to expand workshops and educational opportunities AND work toward becoming our own AANP and/or ANCC provider. This would allow for expansion of our online and streaming CE offerings.

We also want to use the funds in securing future conference venue space with plenty of room, located in close proximity to restaurants and fun activities. We have outgrown some of our venues and that’s a good thing. Our goal is to offer premiere accommodations for our excellent conference!In our recent focus group, many members said lobbying and

keeping you up-to-date are the most important benefits. Advocacy is the second prong of our mission, which includes labor-intense staff support and professional support on both sides of the aisle. An additional lobbying firm more than doubled our expenses in that area.

Leadership has also been involved in strategic planning since 2012 to keep our eyes on the big goals in the future. You know as well as I do, there are still significant barriers to full practice authority for APRNs in Kentucky. We have been developing collegial, working relationships with groups that used to oppose us no matter what we were seeking. We have come to be known as significant players by both parties in Frankfort and we are often sought out by regulators when new regulations or amendments are being considered related to health care and APRN practice. In the future we would like to have an office in Frankfort with a full-time employed lobbyist.

We also want to continue to support our professional staff salaries and benefits. At its most recent meeting, the board of directors unanimously approved a plan to offer health insurance to full-time staff at a 50/50 cost share.

We keep the Coalition membership informed on issues of concern to Kentucky APRNs. We provide easy-to-understand explanations of statutes and regulations. We defend the APRN license statute every legislative session.

What’s In It for Me?Students, be in the know! The KCNPNM Conference has made special efforts to feature programs for advanced practice nursing students this year. Seven workshops and 50 programs will help prepare students for both practice and certification. Much of the programming concentrates on medications and prescribing. One particular program, The New APRN Grad, is specifically targeted to students and recent graduates, featuring three recent graduates from schools across the state. Fees are substantially reduced for students. But, the best thing about the conference is the networking that goes on—professional support, policy updates, information on jobs. Come and join your future colleagues!

KCNPNM MediaContest—Join the FUN!!!

If you have a smartphone (or other means) to record brief videos about KCNPNM membership please consider entering the contest. Entrees will be viewed the days leading up to the KCNPNM conference and voted on at conference. Winners will be recognized at the KCNPNM Annual Banquet. Rural Health Funding InitiativeThe Rural Health Funding Initiative assists rural healthcare providers with obtaining funding in support of their organizations. A FREE webinar entitled, Funding Health in Rural America: Finding New Grants for Small Communities, is an educational session targeting Kentucky and Tennessee providers serving high-needy and rural communities on how to get funding from public and private sources. In a nutshell, the discussion will be an analysis and discussion in trends of government and private funding for rural healthcare and

communities, INCLUDING funding sources.

Improving Health Care Quality with the Quality Innovation Network

The Kentucky Nursing Capacity Consortium has recently evolved into the Kentucky Center for Nursing (KCN) and, with that, more structure and elections. At the first meeting after the election the KCN decided to work on two particular issues. The first issue pertains to the epidemic of opioid addiction in Kentucky, how pervasive it is and the educational needs of nursing in response to the epidemic. A second issue the KCN wants to address pertains to APRN data, how limited it is and the importance of improving data collection. Several APRNs will be involved in both those initiatives. Kentucky Center for Nursing Update

In 2014, the Centers for Medicare & Medicaid Services (CMS) redesigned its Quality Improvement Organization (QIO) program to enhance the quality of services for Medicare beneficiaries. With the restructuring came 14 new, multi-state consortia now called Quality Innovation Networks (QIN), with QIOs at the center of those consortia. The atom Alliance is a five state QIN conducting quality improvement (QI) activities in Kentucky, Alabama, Indiana, Mississippi and Tennessee. Qsource is the organization within atom Alliance overseeing quality improvement efforts in Kentucky.

The Alliance works through CMS contracts to implement the National Quality Strategy of Better Health and Better Care at Lower Costs. As the QIN-QIO for Kentucky, Qsource champions local-level, results-oriented change, teaches and advises as technical experts, and serves as a communicator among health care providers and practitioners. The atom Alliance is conducting QI work in the following areas: 1. Improving cardiac health and reducing disparities2. Reducing disparities in diabetes care3. Support of QI through value-based CMS reporting

programs (hospital value-based purchasing; outpatient quality reporting program; physician value-based modifier)

4. Care coordination (reducing unnecessary hospital readmissions, increasing patient nights at home, and reducing adverse drug events (ADE))

5. Quality Assurance and Performance Improvement in nursing homes

6. Antibiotic stewardship7. Improving influenza and pneumococcal immunization rates 8. Increasing screening for depression and substance misuse

in primary care

Qsource provides resources and tools to assist your practice, and offers learning opportunities through live and recorded webinars, podcasts, printed materials, and other venues. We are particularly looking for advanced practice nurses to work with us on antibiotic stewardship and ADE reduction.

Member UpdateKathy Hager, DNP, APRN, FNP-BC, CDE: Greetings, fellow advanced practice nurses. Kathy Wheeler asked me to say something about my new position as KNA President. I ran for this position because I am older and ready to give back to our profession. I have loved my 40+ years of nursing, and have never felt more empowered than I do as an APRN. One of my main goals for KNA over the next two years, will be to unite nurses behind all projects that are ‘nursing’...not just advanced practice nurses, or KNA members, or Coalition members, but the 60,000 of us that call ourselves ‘nurses’. This year that united front will no doubt include all of us helping Kentuckians understand the health care system, as it changes. ‘Healthy Nurses, Healthy Commonwealth’, another initiative, will address the importance of nurses’ health and happiness with nursing, in providing the best possible care to our population. And lastly, but very high in importance, is collaborating with every discipline in addressing the substance use disorder epidemic in our state. Working together, we can accomplish so much more! Happy New Year!

David Grant, APRN, has just returned to work after two months of intensive treatment for granulomatosis with polyangitis. Diagnosis required 10 painful months of effort and was only made possible by traveling to Cleveland Clinic. Remission will be intermittent, likely requiring periodic treatment. David says the experience has given him new insights into the patient’s side of such care, both good and bad. But, he wants everyone to know he has a new joy and love for life.

Linda Pierce, MSN, APRN, FNP-BC, cut the ribbon in the opening ceremony on December 19th, 2016, for the Fast Pace Urgent Care in Madisonville Ky. A Frontier Nursing University graduate, Linda will be the first provider for the clinic. This center provides primary care along with urgent care to all ages.

Audrey Darville, PhD, APRN, CTTS, FAANP, is working on the launch of a newly developed, all online Tobacco Treatment Specialist Training program. The program is being offered through the BREATHE group at the University of Kentucky College of Nursing in collaboration with Markey Cancer Center & the Kentucky Cancer Consortium. Tobacco Treatment Specialists are professionals from a variety of clinical backgrounds who are trained to provide evidence-based tobacco dependence treatment at all levels of intensity.

The goal is to extend the reach and accessibility of training treatment specialists through self-paced online learning. If interested in additional information contact Audrey at [email protected].

Martha Hawkins, DNP, APRN, CPNP, participated in a medical mission in the Rift Valley of Kenya in February 2016. While there, care was provided to five different small, remote villages who had previously had very little access to healthcare. One village was a tribal group who had fled the severe drought conditions in northern Kenya and settled illegally on government lands. As a refugee camp that did not want the attention of the Kenyan government for fear of being displaced from their newly reestablished homes there had been no contact with government services, including health care. A local pastor and the missionary who organized the mission had been building a relationship with the people in the village for more than a year in order to gain the trust of the elders to garner an invitation to bring in a medical team. The local pastor warned there might not be a strong turn out or warm reception. Before the day was over, nearly everyone in the village had been seen.

Theresa Hall, AGACP-BC, has just certified as an acute care nurse practitioner, after 20 years of critical care experience as an RN. Currently she teaches nursing at the Owensboro Community and Technological College, with additional work at the Owensboro Advanced Sleep Center. She is hoping to find some acute care work in the summer 2017.

Kathy Wheeler, PhD, APRN, NP-C, FNAP, FAANP, was just appointed to the Health Policy Subgroup of the International Council of Nurses Nurse Practitioner/ Advanced Practice Nursing Network. She is joined by one other US member (Elissa Ladd), two from Canada, one from Swaziland, one from China, one from Jordan, one from Palestine, one from Kenya, and one from Australia.
