    THE EXECUTIVE COMMITTEE RECOMMENDS THAT 2.32 hectares (5.73 acres), more or less, of vacant land being Part of Lot 19, Concession 6 and designated as Parts 8, 10 and 12 on Plan 65R-32685, City of Vaughan, Regional Municipality of York, located on the east side of Pine Valley Drive, south of Major Mackenzie Drive (municipally known as 9839 Pine Valley Drive), be purchased from Maribel Dos Santos and Joao Defaria;

    THAT the purchase price be $2.00;

    THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements;

    RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of Land Division Applications B049/09, B050/09 and B051/09 as well as Zoning By-law Amendment Application Z.09.012 to facilitate the creation of four residential lots, TRCA staff established the limits of the open space lands (i.e. Parts 8, 10 and 12 on Plan 65R-32685) which are comprised of a portion of the valley corridor of a tributary of the East Humber River at this location.

    TAXES AND MAINTENANCEBased on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2012 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

Through the review of residential subdivision 19T-06V07, TRCA staff established the limits of the open space land (i.e. Block 233 on Draft Plan of Subdivision) which is comprised of a portion of the valley corridor of a tributary of the East Humber River at this location. Permanent access to the subject lands (for maintenance purposes) will be achieved through the abutting stormwater management pond Block to the east; an access easement will be required as part of the acquisition of Block 233.

Receipt of a request from Hydro One Networks Inc. to provide a permanent easement for an overhead 115 kilovolt hydro transmission line, south of the Canadian Pacific Railway line, between Bayview Avenue and Millwood Road, Don River watershed, City of Toronto (Toronto and East York Community Council Area).

    THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from Hydro One Networks Inc. to provide a permanent easement for an overhead 115 kilovolt hydro transmission line, south of the Canadian Pacific Railway line, between Bayview Avenue and Millwood Road, Don River watershed, City of Toronto (Toronto and East York Community Council Area);

    AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with Hydro One Networks Inc. in this instance;

    THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.21 hectares (0.53 acres), more or less, be granted to Hydro One Networks Inc. for an overhead 115 kilovolt hydro transmission line, said land being Part of Lot 11, Concession 3, From The Bay, City of Toronto, as shown on a plan entitled: HYDRO ONE NETWORKS COMPILED PROPERTY SKETCH;

    THAT TRCA grant the easement across the subject land on the following terms and conditions:

    (a) The easement price is to be the sum of $340,000.00;

    (b) Hydro One Networks Inc. is to pay all TRCA's legal, appraisal, survey and other costs incurred to complete the transaction;

    (c) Hydro One Networks Inc. is to fully indemnify TRCA from any and all claims for injuries, damages or costs of any nature, resulting in any way, either directly or indirectly, from the granting of this easement or carrying out construction;

    (d) Any additional conditions as deemed appropriate by TRCA's solicitor;

    THAT although Hydro One Networks Inc. is exempt from approval pursuant to Ontario Regulation 166/06 due to its status as an agency of the Province of Ontario, Hydro One Networks Inc. is encouraged to work with TRCA staff to ensure that all requirements are met for infrastructure related projects as outlined in TRCA's Valley and Stream Corridor Management Program policies / development criteria;

    THAT an archaeological investigation be completed, with any mitigative measures being carried out to the satisfaction of TRCA staff, at the expense of Hydro One Networks Inc.;

    THAT said easement be subject to the approval of the Minister of Natural Resources in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27 as amended;

    AND FURTHER THAT authorized TRCA officials be directed to take whatever action may be required to give effect thereto, including the obtaining of necessary approvals and the signing and execution of any documents.

    CARRIEDBACKGROUNDHydro One Networks Inc. has formally requested a permanent easement for the replacement and upgrading of an overhead 115 kilovolt hydro transmission line, south of the Canadian Pacific Railway line, between Bayview Avenue and Millwood Road. The new hydro service is part of the Midtown Electricity Infrastructure Renewal Project and is needed in order to meet increasing demand for hydro service in this area of the City of Toronto. Electricity demand in the midtown area continues to steadily increase as a result of redevelopment and land use intensification. In addition, a temporary working easement will be required as part of the proposed construction on TRCA lands; City of Toronto staff will administer all matters associated with the temporary easement on TRCA's behalf, in accordance with the existing management agreement between the City and TRCA.

    This portion of the proposed transmission line is situated within a regulated area; however, it is not located within the Regional Storm Flood Plain of the Lower Don River. At this time, TRCA Environmental Assessment staff is reviewing the project under the Class Environmental Assessment (CEA) process. As part of staff's preliminary review of the CEA, it has been determined that Hydro One Networks Inc. is an agency of the Province of Ontario and, consequently, is exempt from approval pursuant to Ontario Regulation 166/06. However, Hydro One Networks Inc. has been requested to participate in the technical review normally completed for these types of infrastructure projects, in accordance with TRCA's Valley and Stream Corridor Management Program.

    The subject TRCA-owned lands were acquired from the Township of East York on November 24, 1961, under the Don River Flood Plain Lands Acquisition Project.

    PlantingsAll lands disturbed by construction will be stabilized and, where deemed appropriate, revegetated with native woody and herbaceous plant material. Since the subject TRCA lands are being managed by the City of Toronto, the City's Parks, Forestry & Recreation staff will ensure that appropriate restoration occurs as part of the project.

    A plan illustrating the permanent easement location is attached.

    FINANCIAL DETAILSThe easement price is supported by a valuation opinion provided by Hydro One Network Inc.'s appraisal consultant. In addition, Hydro One Network Inc. has agreed to assume all legal, survey and other costs involved in completing this transaction.

    It is proposed that the compensation obtained from this easement be utilized for the purchase of priority properties under the 'Greenlands Acquisition Project for 2011-2015'

    RES.#B25/11 - SECURITY SERVICESAward of Contract for Various Locations. Recommends award of contract for security services for various Toronto and Region Conservation Authority locations.

    THE EXECUTIVE COMMITTEE RECOMMENDS THAT a contract to provide security services for 5 Shoreham Drive, Black Creek Pioneer Village and other Toronto and Region Conservation Authority (TRCA) facilities be awarded to Knights On Guard Protective Services, at the unit prices described in this report dated February 16th, 2011, this being the proposal that best meets TRCA specifications;

    THAT the contract be on terms and conditions satisfactory to staff including performance satisfactory to staff at all times and a 30/15 day cancellation clause by TRCA for any reason;

    AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including the signing and execution of documents.

    CARRIEDBACKGROUNDApproximately every three years, TRCA staff initiates a Request for Proposal (RFP) for provision of security services for various TRCA facilities across TRCA's jurisdiction, in particular Black Creek Pioneer Village (BCPV) and Head Office at 5 Shoreham Drive. In this instance, in addition to the core service noted, a secondary RFP was included in the package for seasonal services as required. The RFP request is for the three year period June 2011 to June 2014, subject to performance satisfactory to TRCA staff and includes provision for cancellation of the contract by TRCA for any reason on either 30 or 15 days notice.

    In both contracts, TRCA has the option for TRCA to use provider services beyond the stipulated facilities to address alarm response and other general security services as the RFP quoted billing rates as required and appropriate to the need.

    The factors to be considered with respect to the type and level of service required were stipulated in the request for proposals; specifically, the following areas of interest were identified:

    hours of service;1.insurance and licensing;2.quality of service;3.other required services;4.value added services;5.price and period of service.6.

    The RFP stipulated progressive pay scale increases for both site supervisory and regular guard staff in each subsequent year of the three year contract will be subject to review and agreement annually between TRCA and the service provider. The amount, if any, will be dictated by the economic climate of the day in conjunction with provincial policy or other issues that may impact TRCA economic decision making processes. In the event of an agreed upon wage scale increase, the provider will be compensated by TRCA with an equivalent increase in hourly rate stipulated under contract for that year.

    RATIONALEThe RFP is sent to the following six security firms that have demonstrated capacity to provide the required services:

    Knights on Guard Protective Services;Garda Security;Intelligarde international Inc.;Reilly Security;Paragon Security;Paladin Security Group Ltd.

    For purposes of comparison, the three year value of each bid was calculated based on the anticipated number of hours of service provided. Because the actual hours to be worked are unknown, the contract is awarded on an hourly unit pricing structure.

    Staff has recommended that the contracts for both the principal service to BCPV and Head Office and for seasonal services to other TRCA locations be awarded to Knights on Guard Protective Services (KOG) who is not the lowest bidder for the following reasons:

    Knights On Guard Protective Services is the lowest bidder over three years for the Principal BCPV and Head Office contract.KOG is the current long standing provider of seasonal security services as referenced in the seasonal RFP. They have provided excellent service over the term of their previous seasonal contracts. KOG's proposal submissions under both the principal and seasonal RFP's reflect the content of the respective RFP exactly as presented.The nominal difference between the top two proponents in the final sum total service costs over both RFPs for the initial year and over the total three year contract period is insufficient to warrant splitting the services between two providers. The internal costs of a complete reorientation on two different fronts between two different providers during the initial year term of service would exceed the $4,849.63 difference in Year One of service or the $5,125.35 difference in the sum totals spread over three years.

    THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the Regional Municipality of Durham to provide a permanent easement for a public alert siren, north of Beachpoint Promenade, east of West Shore Boulevard, Waterfront Pickering / Ajax Sector;

    AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with the Regional Municipality of Durham in this instance;

    THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.001 hectares (0.003 acres), more or less, be granted to the Regional Municipality of Durham for a public alert siren, said land being Part of Lot 189, Registered Plan M-7, City of Pickering, as shown on a Plan of Survey prepared by Ivan B.     CARRIEDBACKGROUNDThe Regional Municipality of Durham has formally requested a permanent easement for a public alert siren located north of Beachpoint Promenade, east of West Shore Boulevard, City of Pickering. The project consists of the construction of a tower for a public alert siren as part of emergency preparedness for the Pickering Nuclear Power Generating Station. Durham Region is implementing a public alerting system to alert residents in a three kilometre radius within 15 minutes of an event at the nuclear generating station.

    During the initial phase of the public alerting system in 2003, two sirens were proposed on TRCA-owned lands. One of the sirens was to be located on the west spit of Frenchman's Bay immediately west of the Canoe Club facilities and the other within Petticoat Creek Conservation Area. Following public consultation, four sirens were installed in the City of Pickering in 2006; however, neither of the aforementioned sirens on TRCA property were built at that time. Subsequent testing revealed that the four as-built sirens did not meet provincially legislated requirements; it has been determined, through discussions with the City of Pickering, Durham Region and the Province of Ontario, that an additional five sirens are required within Pickering in order to meet the provincial standards. The siren proposed on TRCA property will be solar powered.

    A search of proposed sites in the current phase has resulted in the need for one of the five additional sirens to be located on TRCA-owned lands. The placement of the siren at this location effectively eliminates the need for the two sirens proposed on TRCA properties in 2003.

    The proposed public alert siren is located within the Regulated Area of the Lake Ontario waterfront at this location. Pursuant to Ontario Regulation 166/06, a routine infrastructure permit will be issued for the construction of the siren.

    The subject TRCA-owned lands were acquired from the Regional Municipality of Durham on February 16, 1983, under the Pickering / Ajax Lake Ontario Waterfront Acquisition Project.

    PlantingsAll lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. The landscape plan will form part of the permit pursuant to Ontario Regulation 166/06.

    WHEREAS Toronto and Region Conservation Authority (TRCA) has received a proposal from the City of Toronto for operation of the Glen Rouge Campground and to enter into a long term Licence Agreement for the aforementioned services;

    THEREFORE LET IT BE RESOLVED THAT TRCA enter into a Licence Agreement with the City of Toronto for the operation of Glen Rouge Campground;

    THAT the Licence Agreement with the City of Toronto be subject to the following terms and conditions:

    (i) the term of the Agreement will be 10 years with an option in favour of TRCA for a 10 year renewal;

    (ii) the Commencement Date for the Licence shall be May 1, 2011;

    (iii) the Licence Fee shall be a nominal amount of two dollars ($2.00) for the duration of the Term;

    (iv) TRCA shall be responsible for the staffing and payment of all taxes and costs associated with operations of the Glen Rouge Campground;

    (v) any other terms and conditions deemed appropriate by TRCA staff and solicitor;

    AND FURTHER THAT authorized TRCA officials be directed to take whatever action may be required to implement the Licence Agreement, including the obtaining of necessary approvals and the signing and execution of any documents.

    CARRIEDBACKGROUNDTRCA is the owner of the lands occupied by the Glen Rouge Campground. Under a Memorandum Agreement dated June 14, 1961, the former Municipality of Metropolitan Toronto developed and maintained these lands for park, recreational and conservation purposes and assumed the cost and responsibility for the maintenance of the park lands.

    Glen Rouge Campground comprises of approximately 8.7 hectares located on the banks of the Rouge River in Rouge Park situated off Highway #2 at 7450 Kingston Road, just north of Highway 401 and East of the Sheppard Avenue/Port Union Road interchange. The campground consists of a total of 125 sites; 87 serviced sites, 27 unserviced sites and 11 designated specifically for cyclists and backpackers. Support facilities include a gatehouse, fully equipped washroom facility with changerooms and showers, laundry facilities, storage garage and tailer pump-out station.

    Since 1981, the City has operated the Glen Rouge Campground from approximately mid-May to mid-October, seven days a week and 24 hours per day, including holidays.

    The City of Toronto approached TRCA to pursue the possibility of TRCA entering into a License Agreement to contract out the operation of the campground . Therefore, at Authority Meeting #2/10, held on March 26, 2010, Resolution #A33/10 was approved, in part, as follows:

    ...THAT, if requested by the City of Toronto, staff be directed to explore the feasibility of TRCA assuming the operation of the Glen Rouge Campground;...

    Subsequently, direction to enter into a Licence Agreement with Toronto and Region Conservation Authority to operate the campground was approved by City Council at its meeting of August 25, 26 and 27, 2010.

    City of Toronto fulfilled its obligations under the Collective Agreement between the City and CUPE Local 416 (L416) as well as CUPE Local 79 (L79) and sent notices and held meetings as follows:

    March 12, 2010 - Ski Hills and Campground - Possible Contracting Out of Work.November 15, 2010 - Notice of Contracting Out - Glen Rouge Campground.February 9, 2011 - Meeting with L416 Contracting Out of Work Associated with the Operation of Glen Rouge Campground.

    Therefore, the City is within its rights to enter into a Licence Agreement with TRCA for operations of Glen Rouge Campground.

    RATIONALETRCA currently operates two family campground facilities located within the GTA. Albion Hills Campground set in the hills of Caledon on the banks of the Humber River and Indian Line Campground located near Highway 427 and Finch Avenue in Brampton. Both facilities offer daily, weekly, monthly and seasonal camping opportunities and are net revenue generators.

    TRCA staff has explored the feasibility of taking over the operations of Glen Rouge Campground and deem it to be a financially viable and an environmentally strategic opportunity. More specifically, Glen Rouge Campground will offer accessible, economical and sustainable outdoor experiences to both local and out of province tourists. The campground will become an integral part of TRCA’s nature based recreational offerings.

    FINANCIAL DETAILSGlen Rouge Campground is budgeted to be a financially sustainable operation with generated revenues funding operating expenses. Account code #335-01 has been set up for the operating budget.

    CARRIEDBACKGROUNDOn November 19, 2010, a report was made to the Ministry of Environment (MOE) Spills Action Centre regarding a fuel/oil spill in a tributary of the Little Rouge River adjacent to the Standard Auto Wreckers property. MOE, City of Toronto (Toronto Water) and TRCA staff immediately attended the site. Upon MOE arrival at the site, the City of Toronto staff had installed booms, pads and pillows in an attempt to contain and absorb the fuel/oil. City of Toronto staff had also determined that fuel/oil had leaked from a shipping container/sea can building on the Standard Auto Wreckers property, impacting the river. The shipping container/sea-can building was determined to have been used for pulling and storing engines. The building is located on the edge of the property, directly adjacent to the creek. The creek and adjoining property are owned by Ontario Realty Corporation (ORC), a provincial agency. TRCA property, part of the Rouge Park, is located immediately south of the spill area. Through MOE Director's Order #004585-1 for 1216 Sewells Road, Goldy Metals Incorporated, owners of Standard Auto Wreckers, has been required to investigate and remediate all areas that have been contaminated by the spill. Since that time, a section of the creek has been relocated and the spill into the watercourse has been stopped.

    At Authority Meeting #10/10, held on January 7, 2011, staff advised the Authority of the spill and of the efforts to investigate and remediate all affected areas. The Authority approved Resolution #A226/10 as follows:

    THAT the staff report on the fuel/oil spill to a tributary of the Little Rouge River from the Standard Auto Wreckers property at 1216 Sewells Road be received;

    THAT TRCA request Ontario Realty Corporation (ORC) to address the encroachments by Standard Auto Wreckers and to complete the transfer of the lands into Toronto and Region Conservation Authority (TRCA) ownership in accordance with the 2004 land transfer agreement between TRCA and the Province of Ontario;

    THAT TRCA request the Province of Ontario to undertake discussions with Standard Auto Wreckers regarding potential acquisition of the property and/or relocation of the business;

    AND FURTHER THAT the Rouge Park Alliance be so advised by the CAO's Office.

    On January 19, 2011, TRCA was advised by the Environmental Review Tribunal that Goldy Metals had appealed the matter to the Environmental Review Tribunal pursuant to section 140 of the Environmental Protection Act, R.S.O. 1990, c. E.19, as amended, with respect to Order No. 004585-1 issued by the Director, Ministry of the Environment, on December 15, 2010 under ss. 14(1) of the Environmental Protection Act. The hearing is with regards to the off-site migration of contaminant from the trench pit and surrounding area of the structure located at 1216 Sewells Road, Toronto, Ontario. TRCA is both owners of nearby lands and is an interested party. As such, TRCA received notification of the preliminary hearing, to be held March 11, 2011. TRCA has been offered the opportunity to participate at the hearing as an observer, presenter, participant or to request that the Tribunal grant party status. A copy of the notice is attached.

    On February 11, 2011, staff followed up with the Rouge Park Alliance as directed by the Authority. At their meeting on this day, the following Resolution was approved:

    THAT the Rouge Park Alliance direct staff to prepare a letter for the Chair of the Alliance seeking participant status related to the Hearing of an appeal before the Environmental Review Tribunal regarding the Standard Auto Wreckers matter;

    AND THAT the Toronto and Region Conservation Authority, which will also be seeking participant status at the appeal, be requested to allow its legal representative to serve in the same capacity for the Rouge Park Alliance.

    MOE is the lead agency with respect to ensuring that all the areas contaminated by the spill are investigated and remediated by the appellant. The spill occurred on both public and private lands. The public lands are owned by the Province of Ontario and managed by ORC. Through discussions with MOE and ORC staff, TRCA staff has committed to working with staff of MOE, ORC, Fisheries and Oceans Canada and Ministry of Natural Resources to provide the technical expertise required to ensure the valley and stream corridor system within, adjacent to, and downstream of, the spill site is restored to a level consistent with TRCA and provincial policy. The private lands are owned by Goldy Metals Incorporated and are subject to TRCA regulation and applicable policy . TRCA has a Memorandum of Understanding with the Rouge Park, and is committed to working with them and providing technical expertise on issues relating to water and natural heritage management within the watershed.

    To ensure that TRCA concerns are addressed through the Hearing process of the Environmental Review Tribunal, TRCA staff consulted with lawyers of Willms and Shier. Staff was advised that seeking participant status during the hearing would be appropriate. Being a Participant would allow TRCA to be a witness at the hearing, make oral and written submissions at the commencement and the end of the hearing, attend site visits upon request, and receive copies of documents exchanged that are relevant to TRCA’s interest. TRCA remains committed to working with Rouge Park staff through the hearing process. Together, TRCA and Rouge Park share a goal of ensuring that potential on- and off-site migration of contaminants from the Standard Auto Wreckers property is mitigated and, the valley and stream corridor appropriately restored. To do this, TRCA will advocate that the objectives and policies of the TRCA Valley and Stream Corridor Management Program (1994), the TRCA Rouge Watershed Management Plan (2007) and the provincial Rouge Park Management Plan (1994) be met.

    The Partners in Project Green Eco-Efficiency Program helps businesses identify energy conservation opportunities through a no-cost walk-through of their facility. The initial walk-through is led by TRCA or our delivery partner, the Guelph Food Technology Centre. For businesses interested in receiving a detailed energy audit and report, the roster will help connect them to pre-qualified energy management consultants. The roster will be available to interested businesses to use at their discretion and as part of their procurement processes.

    TRCA will receive a finder's fee from contracts generated through referrals to the roster equal to 15 percent of the value of the contract. This revenue will be used to offset TRCA's costs for the delivery of the Eco-Efficiency Program.

    In July 2010, with input from the Partners in Project Green Building Performance Team, and as part of a competitive procurement process, TRCA staff released a Request for Proposals (RFP) to solicit and select qualified energy management consultants. The Request for Proposals was sent to a list of 22 firms with energy management consulting practices.

    Respondents were asked to agree to the following activities:Submit a proposal of services to the client to complete an energy audit, develop an energy management plan or similar.Provide a finder’s fee to TRCA equal to 15% of the value of services delivered to clients referred by Partners in Project Green.Provide the client and TRCA with a final report using a standard reporting format.

    RATIONALETwelve proposals were received in response to the RFP from the following firms:

    Agviro Inc.;Altech Environmental Consulting Ltd.;HD Culham and Associates Ltd.;Direct Energy Business Services Ltd.;Energy Solutions Global Inc.;Enviro-Stewards Inc.;Finn Projects;Halsall Associates Ltd.;REI Power;Power Saving Systems Inc.;Stantec Consulting Ltd.; andTechnocrates Inc.

    In addition to being considered against the Partners in Project Green Public-Private Marketing Collaboration Criteria, each respondent was evaluated against the following criteria:

    Independent Consultant (Required) – Consultants must not have any financial interest in the manufacture or sales of specific energy management equipment or technologies.Energy Management Expertise (40%) – Qualifications and experience of team members.Energy Management Process (20%) – Well defined and proven approach to energy management.Professional References (40%) – Provide evidence of a track record of client implementation and verified energy reductions alongside excellent customer service. Include a minimum of two completed client reports with confidential information removed.

    The proposals were evaluated against the above criteria by Partners in Project Green Building Performance Team Members from TRCA, Enbridge Gas Distribution and Hydro One Brampton. Further review and approval was obtained from the Partners in Project Green Steering Committee. Based on this review, staff recommend the following three companies for inclusion in the Energy Management Consultant Roster:

    These respondents were selected based on the strength of their teams with both breadth and depth of expertise, the quality of their approach to energy management, and the demonstration of their ability through high quality client reports containing clear analysis and appropriate recommendations. These respondents do not have a financial interest in the manufacture or sales of specific energy management equipment or technologies. The selection team is confident that these respondents will provide a high quality service to clients that will contribute to building and protecting the reputation of TRCA and Partners in Project Green.

    FINANCIAL DETAILSThis program has no financial implication to TRCA as the program will be operated on a cost recovery basis. Consulting costs for detailed audits will be covered by the individual businesses receiving the audits, while TRCA administrative costs will be recovered through revenues generated through referrals. Revenues will be equal to 15 percent of the value of contracts signed through the referral process.

    CARRIEDBACKGROUNDNatural Resources Canada’s (NRCan) Regional Adaptation Collaborative (RAC) program is a three-year cost-shared initiative to support coordinated action towards advancing regional climate change adaptation decision-making. The Ontario Ministry of Environment (MOE) has partnered with NRCan to develop the RAC for the Province of Ontario, and within this program the Source Protection Branch of MOE is working with TRCA and York University on a source protection and climate change project to advance the integration of climate change into all aspects of source protection planning. Under the Clean Water Act, 2006 communities will identify threats to drinking water from a quality and quantity standpoint through the development of source protection plans (SPPs). Although climate change can significantly impact both the quality and quantity of drinking water, source protection committees (SPCs) have been limited in their ability to investigate the impacts of climate change in SPPs because of an absence of guidance on methods and data for modelling and assessing these potential impacts. Recently, the Ontario Ministry of Natural Resources (MNR) has developed technical tools to incorporate climate change scenarios into modelling and analysis to begin to address this gap. One of the TRCA and York University contributions to the Ontario RAC is to develop targeted training programs to create and sustain a consistent knowledge and understanding of these tools.

    RATIONALETRCA and York University have committed to apply funding from the Ontario RAC to develop source protection climate change training programs to ensure that SPCs and source protection practitioners can utilize the technical modelling methodologies and tools developed by MNR. As AquaResource Inc. was retained by MNR to develop those modelling tools and has substantial experience in developing technical training, it has been strongly recommended by both MNR and MOE that TRCA retain AquaResource to develop the source protection training programs in order to ensure continuity of knowledge and the most effective understanding of the basis for, and application of, the technical modelling tools. TRCA staff concur and therefore recommend award of the contract on a sole source basis as per Section 1.14.5 of TRCA's Purchasing Policy as follows:

This knowledge is critical for the rapid development of Lotus Notes applications to satisfy the needs of staff and improve business efficiency. AppVision has demonstrated the ability to conduct effective 'business process discovery', software solution development, subsequent application deployment and 'bug fixes' in a cost effective and timely manner. Many of the recent and planned future Lotus Notes applications are fully integrated into a system of databases. This integration requires a complete understanding of TRCA business processes and existing Lotus Notes application architectures in order to be effective.

    In 2010, AppVision was awarded the consulting services for Lotus Notes application development and administration services as per Section 1.14.5 of TRCA's Purchasing Policy as follows:

    CARRIEDRATIONALEThrough 2009 and early 2010, TRCA and Rouge Park Alliance developed a significant project with the Regional Municipality of York that would see the Region fund development of public use and natural heritage infrastructure in the Bob Hunter Memorial Park area of Rouge Park. In early 2010, TRCA and the Region signed an agreement for approximately $6 million that called for TRCA, on behalf of the Alliance, to administer the project, including approximately $1 million of natural heritage restoration.

    The first phase began in spring 2010 with the establishment of a native grass meadow north of 14

    th

    Avenue, east of Reesor Road in Markham. The second phase calls for initiation of re-establishment of a large area of forest habitats in the south west portion of Bob Hunter Memorial Park. This will begin with an area of 12.5 ha at the south end of the area to a mixture of coniferous and deciduous trees and an area of 2.3 ha near 14th Avenue (Attachment 1). The agreement that TRCA has with York Region specifies that NGOs will be the instruments by which that reforestation will occur and the budgets included in the agreement allocate $9,000 per hectare to be provided to NGOs for the acquisition of planting material.

    There are only three NGOs (Friends of the Rouge Watershed, 10,000 Trees for the Rouge Valley and Rouge Valley Naturalists) that have the capacity to undertake major plantings in the area covered by the Southeast Collector agreement. All three were approached and given to opportunity to participate and were offered areas that would suit their capacity. FRW and 10,000 Trees for the Rouge Valley both accepted and selected areas, while the Rouge Valley Naturalists declined for 2011. The Rouge Park and TRCA have subsequently assigned an area of 12.5 hectares to FRW and an area of 2.5 hectares to 10,000 Trees for the Rouge Valley. Staff therefore recommends award of a contract to FRW and to 10,000 Trees for the Rouge Valley on a sole source basis as per Section 1.14.5 of the TRCA's Purchasing Policy as follows:

    CARRIEDBACKGROUNDIn 2011, Rouge Park and TRCA will continue the process of implementing wildlife habitat and visitor experience enhancements in Bob Hunter Memorial Park. A native grass meadow was included as a first step because a park-like setting for visitors could be quickly established using grass and wildflower species that are native to the region (see Attachment 1 for proposed planting area). In future, the area could be managed to allow native trees to establish, gradually creating a natural forest or maintain the meadow.

    Grass and wildflower species that are native to the Rouge Park region are adapted to the existing soil and climate conditions and so provide the most robust species mix for long term meadow establishment. Other non-native grasses that are common in agricultural and roadside uses are inappropriate for long term habitat restorations in the Park because of their Asian and European origin.

    Native grass and wildflower mixes require special cultivation for seed production and so sources of supply tend to be limited, especially in large quantity. While there are several producers that supply for small, ‘backyard’ type plantings, supply for large acreages such as Bob Hunter Memorial Park at the rates those producers charge is prohibitively expensive. In addition, dependably successful sowing of native meadow mixes requires use of specialized grass seed drills.

    In 2010, TRCA contracted with the Rural Lambton Stewardship Network to provide native meadow seed, seed drill and expertise to plant phase one of the meadow north of 14

    Avenue in Bob Hunter Memorial Park. The Rural Lambton Stewardship Network (RLSN) has been working under a joint management arrangement with the St. Clair Region Conservation Authority planting and promoting native grass stands in southern Ontario since 1994. The group is interested in seeing establishment of native grass throughout Ontario and provides support to non-profit organizations on a cost recovery basis. The group plants several hundred acres annually, often including corporations such as Nanticoke Power, etc. and has seed production stands and seed cleaning/handling facilities. The advantage of the group harvesting its seed from known stands is minimum weed seed contamination and maximum germinability. RLSN annually surveys the market for seed cost and charges their clients what is the market rate.

    RLSN estimates their actual market price value to be $2,400 per acre but are prepared to offer Rouge Park/TRCA seed at a cost of $2,000 per acre although costs may vary slightly depending on final seed mix, so TRCA costs will be $65,217.40, plus HST for total cost of $75,000. TRCA staff concurs with RLSN's estimates.

    As they did in 2010, at no cost to Rouge Park/TRCA, they will provide use of their seed drill, float and truck to transport the drill and staff time related to planting as well as follow up inspection. The combination of these contributions plus seed subsidy of $400/acre means RLSN will contribute $16,200 in-kind to the project.

    TRCA staff will provide all site preparation as well as the tractor and staff time to do the actual planting. RLSN is prepared to re-plant the site in subsequent years if necessary. We intend to plant up to 33 acres for total cost of $65,217.40 including HST and the project is consistent with Bob Hunter Memorial Park plans and the agreement with York Region under the Southeast Collector Enhancement Project.

    RATIONALETRCA has been selected by York Region to deliver the Southeast Collector Enhancement Project in Bob Hunter Memorial Park of Rouge Park. The Rural Lambton Stewardship Network has considerable experience and materials to assist TRCA in planting and establishing native grass meadows in the Park. While RLSN is not the only group that may be able to provide seed to TRCA, they will provide seed below estimated market costs. TRCA staff concurs with RLSN's estimates. They have the greatest experience in native grass seeding in Ontario and are the only group currently associated with a conservation authority that does this work. In addition, they are the only group that will provide seed with a guarantee to re-seed if necessary. Staff therefore recommends award of the contract on a sole source basis as per Section 1.14.5 of the TRCA's Purchasing Policy as follows:

    The arrangement with RLSN has been designed so that TRCA will have access to the RLSN specialized seed drill and expertise which is something that other suppliers do not provide.
