FIRE SAFETYThe Institution of OccupationalSafety and Health (IOSH) hasurged the UK to revise itsapproach to fire safety in towerblocks and follow other countriesin also adopting active measures,such as sprinklers.Ahead of the first hearing in the
public inquiry into the GrenfellTower fire, in which at least 80people died, IOSH urged theinquiry to investigate UK housingproviders’ reliance oncompartmentation for high-rises –the use of fire-resistant walls andfloors to stop the spread of a fire.IOSH pointed out that relying
so heavily on a passive approachto fire safety made the UK lagbehind countries that take amore active approach, withbuildings designed to detect andextinguish fire.London’s Fire Commissioner
has also called for all residentialtower blocks to be retrofitted withsprinkler systems, and has issued aplea for the Grenfell Tower tragedyto become a “turning point” forfire safety laws.

DRIVER FATIGUE CRASH STATISTICThe AAA Foundation for Traffic Safety estimates that 21 percent of fatal motor vehicle crashes involve driver fatigue. One third of crashes involving a drowsy driver also result in injuries. The AAA Foundation also estimates that drowsy driving is involved in:• 6% of all crashes in which

T he Middle East’s oil andgas sector employs tens ofthousands of remote
workers who are manningcompressor stations, pipelinesand pump jacks. It is paramountthat these workers have thehighest standards of safetyavailable to them duringoperations. Because they workremotely, it is difficult foremployers to continuouslymonitor their safety and takeappropriate action. They face ahost of occupational hazards suchas slips and falls, electrocution,falling objects, cuts and burns andtoxic and flammable gas exposure,any of which could cause seriousinjuries or worse. When it comes to monitoring
and ensuring the safety of remotelone workers, safety managershave in the past only had a fewoptions. They could equipworkers with GPS trackingdevices and panic buttons, orassign a wireless personal gasdetector that sends alarm data toa controller. However, a panicbutton is of limited use if aworker already is down due to gasexposure, a fall or other safetyincident, and is unconscious orunable to move to activate thealarm. Personal gas detectors willwarn of a gas emergency but notother hazards. They also onlyalert the worker, meaning thatmanagers remain unaware of the
emergency. These individual personal
solutions are usually installed,maintained and monitored asseparate components, increasingthe management problem forsafety managers and potentiallyincreasing the safety risk forremote workers.
Honeywell solutionIndustrial Internet of Things(IIoT) technology is helping tochange all of this. Honeywell’scloud-based computing andwireless, mobile technology iscreating a new era of safety forlone workers, going beyondcurrent safety standards. Withtoday's connected technology,safety managers now can receive aconstant stream of real-time dataon a lone worker's exact locationas well as biophysical andatmospheric conditions, and canmonitor their safety and initiateor assist with decisive or pre-emptive safety actions like neverbefore, from any location. Remote workers may continue
to work remotely but they are nolonger alone. Cloud-based,mobile, wireless monitoringsolutions can relay essentialinformation about a worker'slocation, the presence ofdangerous gases and biometricdata about the employee back tothe employer so they can monitorworker safety.

T he Good Samaritanprinciple means a range ofdifferent things around
the world, both in accordancewith legislation and custom andpractice. It is human nature towant to help someone who needsmedical assistance, but in today’ssociety, there is understandableconcern that individuals whoattempt to help another could beat risk of having a claim broughtagainst them if that personsuffers harm as a result of theirintervention.
At the date of publication no"Good Samaritan" law exists inthe UAE. There is often confusionas to what the legal liability willbe in the UAE when a personadministers first aid, and what, ifany, the legal consequences willbe in the event the injured persondies as result of their injuries. Inthis legal update, we address thefollowing three points, inaccordance with UAE Law andShariah Law:
• Is the concept of a GoodSamaritan recognised withinthe UAE?• Can a person whoadministers first aid be held
legally accountable for anysubsequent injuries, and orcausing death in the event theinjured person dies?• What is the recommendedapproach for the delivery offirst aid in the UAE?
Good Samaritan principleWhile the origins of the GoodSamaritan principle are based on areligious parable, over time it hasdeveloped to include rescuers andfirst aid officers administering firstaid in the aftermath of anemergency. Various authoritiesaround the world have establishedlegal precedent where the law doesnot require a member of thepublic to act as would a GoodSamaritan. However, if a personchooses to do so then, in mostjurisdictions, the law offersprotection to the Good Samaritanfrom civil compensation claimsand/or criminal cases, except tothe extent that their own actscaused damage beyond that whichthe injured would have suffered if the Good Samaritan had not intervened.
Within the UAE, it is oftenasked whether or not an
individual will be held legallyliable (and face imprisonmentand/or civil responsibility for thepayment of diya or arsh) forcontributing to someone’s deathor injuries if they have providedassistance to that injured person.Understanding how the UAE Lawtreats individuals who offer firstaid (either in their professionalcapacity or in rescuecircumstances) is important.
UAE Law considerationsThe UAE does not have a stand-alone Good Samaritan law, unlikeother jurisdictions. Over the pastfew years, there have been newsreports of a draft law underconsideration, but as at the dateof this article, no such law hasbeen published. If a GoodSamaritan law were to be enactedin the UAE, it would be the firstof its kind in the GCC.
Typically, the key provisioncontained in Good Samaritanlaws provides legal immunity forthose individuals who administerfirst aid in a rescue situation,when they themselves acted ingood faith and withoutremuneration. Of course, other

considerations include theinformed consent, parental rightsand the right of the victim torefuse treatment. In the UAE,pursuant to articles 342 and 343of the Penal Code (Federal LawNo. (3) of 1987 as amended)(Penal Code), a person may bepunished if they cause the deathor injury of another person. Inaccordance with the Penal Code,causation can attach where the
person “refrained, at thatmoment, from helping thevictim… in spite of the fact thathe was capable of doing so” or “ifthe crime was committed as aresult of the offender’s failure toperform the duties imposed onhim in the performance of hisfunction, profession or craft…”.However, pursuant to article
53(2) of the Penal Code, no crimeis committed where medical
treatment is performed inaccordance with generallyaccepted scientific principles andwith the express or impliedconsent of the patient, or ifmedical interference is requiredin emergency cases. Therefore, nocriminal liability will attach to anindividual performing first aid ina rescuer situation, as long as theconditions of article 53 of thePenal Code are met.
Shariah Law considerationsBased upon a Fatwa authored bythe Official Iftaa Centre, GeneralAuthority of Islamic Affairs &Endowments on First AidProcedures in 2010 (First AidFatwa), first aid must beadministered by all people inaccordance with Shariah Law.The Fatwa states (as
translated): “Islamic Shariah isbased upon the five necessities,one of which concerns thepreservation of one’s life andproperty. Therefore, the provisionof first aid can be seen as both an
Islamic duty and a humanitariannecessity, as the first aid isadministered to save people’s livesand relieve their pain. Anytrained medical person,particularly in emergency
situations, ‘do their best efforts’ toprove immediate relief, and this issupported by the generalprovisions of Shariah that call forco-operation, helping the needyand relieving inflicted people.”Therefore, in accordance with theFatwa, no criminal liability willattach to an individual, in respectof both Shariah Law and UAELaw when they perform first aid.The opposite is true; those thatdo not assist when they witness aperson suffering can be heldcriminally accountable.
Immunity from prosecution“It is true that, while the commonlaw imposes no duty to rescue, itdoes impose on the GoodSamaritan the duty to act with duecare once he has undertakenrescue operations. The rationale isthat other would-be rescuers willrest on their oars in theexpectation that effective aid isbeing rendered.” [Lacey v US(1951) 98 F.Supp 219 at [200]]While the citation above is US
judicial obiter dicta, it is similar tothe UAE position. The UAElegislation and Shariah Lawprinciples cited above should notbe interpreted to suggest that arescuer is expected to be competent

to treat someone suffering from aheart attack, and that if they fail todo so, they will be held responsiblein the event of the individual’sdeath. Rather, the rescuer shouldseek medical assistance for thevictim as soon as possible in orderto discharge their duty.
Safety officersA first aider or safety officershould not be afraid to do theirjob for fear of legal repercussions.If a first aider witnesses anaccident at work and fails to doanything to help, and the victimdies or is seriously injured, thenthey could find themselves fallingfoul of the Penal Code. However,where they administered first aid,within their competence, andthen took the necessary steps toseek external expert medicalassistance where required,criminal liability should notattach to that person should thefirst aid not be enough to save ortreat the patient.
It is essential for companieswith an in-house first aidcapability to ensure that peopleare suitably trained and have thenecessary equipment andresources at their disposal in caseof an accident or incident. TheUAE Federal Labour Law (FederalLaw No. (8) of 1980 as amended)(Labour Law) and Ministry ofLabour Decisions No. (32) andNo. (37/2) of 1982 specify theminimum requirements for firstaid supplies, but companies arefree to (and arguably should)adopt a higher standard and caninclude additional supplies. Byway of example, the Labour Lawdoes not require companies tohave a defibrillator, but if acompany chooses to install one, itmust also ensure its staff issuitably trained to operate it.The First Aid Fatwa outlines
whether or not a nurse (and thesame test will be applied forsafety officers) will be heldaccountable for the death of a
patient, if the patient dies afterthe safety officer hasadministered first aid. Inparticular the First Aid Fatwaconcludes: “If a complaint islodged after an incident, thejudge investigating the wholesituation will determine howproperly the first aid officerperformed their job.”Therefore, while we can seek
guidance from the UAE Law andthe Shariah Law, it will only everbe up to the criminal court judgeto determine the level ofaccountability, and this decisionwill focus on whether theindividual performed their jobproperly (or refused to performtheir job), and provided adequatefirst aid in the circumstances.
Cultural sensitivitiesQuestions often arise as towhether there are religious orgender-based restrictions onwho may provide first aid towhom. As the UAE Law does notaddress cultural issues thatmight arise when a rescuer orsafety officer administers firstaid, we can only take guidancefrom the First Aid Fatwa. TheFirst Aid Fatwa deals with bothquestions (i) whether it ispermissible in accordance with
the Shariah Law for a non-Muslim to administer first aid toa Muslim, and (ii) also whether amale may administer first aid toa female. Both are answered inthe affirmative, that is thatanyone can administer first aidin situations where there is anemergency, and they will not bepunished for doing so incircumstances where they are adifferent religion or differentgender to the injured person.In practice however,
companies should ensure thatwhere any employees have aparticular objection in respect ofwho may administer medicaltreatment, that such informationis clearly recorded in their file.
Recommended approach tofirst aidProvided people act within
their competencies and takereasonable and proportionatemeasures when an accidentoccurs, then the Good Samaritanshould not fear adverse legalconsequences in the UAE. If anemergency arises, and the firstresponder is not medicallytrained, then they are under apositive obligation to seekimmediate medical assistance. Noone should ignore anotherperson’s peril, as that will beagainst Shariah principles andUAE Law. �

What are your views on thelevel of the threat ofemergencies and crisesfacing organisations andcompanies today in theMiddle East?There are many threats facingorganisations and companies inthe Middle East, ranging from therefugee crisis to terrorist attacks,and cyber security to climatechange. But what if we couldchange the way we think andmanage risk? We judge a lack ofawareness and preparation is abig part of why, for example,hurricanes, floods and othercalamities leave such chaosbehind. A lot of businesses andorganisations mistakenly adoptan ostrich managementapproach. I judge this the realthreat to ME businesses andorganisations, i.e. beingunderprepared for human-induced and natural crises anddisasters.
How can organisations bestprepare themselves for an
emergency situation or crisisbefore disaster strikes?It's perfectly natural to feel asense of panic when crises occur,but if you do it right, you canlean on your business continuitymanagement (BCM) anddisaster recovery (DR)programme. Most importantly,you must have crisismanagement preparation for thedirection and structure you needto sort things out. When we researched the reasonsbusinesses and organisationsforget what to do in the midst ofdisaster, what really stood outwas how many of the reasonslisted weren't so muchforgetting, as never really havingthe knowledge in the first place.For example:
• No executive support:without this, people willforget that there is a BCM orDR programme in place forwhen a disaster occurs. • No plans: the organisationhas done nothing to promoteany sort of disaster response
or planning mechanisms andwhen disaster strikes, there isno known prioritisation ofwhat needs to be activated. • No testing/validation:exercising and testing is aform of training, and trainingwill help people identify theirroles and build BCM plansand processes. If you neverput your plan to the test thenyou're all but guaranteed tofind flaws in the most painfulway possible once youencounter real trouble! At thevery least, you need to bringthe whole crisis team togethera couple of times a year anddo a dry run through plansfor your most predictablecrises. In an ideal situationyou do everything fromtabletop exercises to full-blown simulations involvinglocal safety officials andmembers of the communitysurrounding your business.
The better prepared you are, themore you will be able to prevent ormitigate damage from undesirable

Homeland security is top ofthe agenda for Gulf statesright now, as it is
elsewhere. But it is a highlycomplex and fragmented area,encompassing criticalinfrastructure and services, ITand communications, as well asdrawing in resources fromdefence and security tointelligence gathering.The threat to the public at large
has been well highlighted inrecent months, followingmalware outbreaks such as theWannaCry attack that hitessential services such as thoseaffecting the National HealthService in the UK. That paralysedIT networks, resulting in closedhospital wards and cancelledpatient operations.The WannaCry outbreak,
which asked victims to payUS$300 to unlock theircomputer, was one of the biggestglobal cyber attacks ever, affectingmore than 200,000 organisationsin 150 countries worldwide.It is a truly vast and complex
field. A nation’s criticalinfrastructure provides theessential services – electricity,water, healthcare – that underpinsociety and serve as the backboneof that country’s economy and its
security. It is the power we use inour work and homes, the waterwe drink, the transportation thatmoves us, the stores we shop in,the communication systems werely on to stay in touch with ourcolleagues, friends and family.And all of those areas are
vulnerable to disruption in oneway or another: from malwareoriginating from the other sideof the planet, to moreimmediate physical attacks fromterror groups or maliciousindividuals. According to the US
Department of HomelandSecurity (DHS), there are 16critical infrastructure sectorswhose assets, systems andnetworks, whether physical orvirtual, are considered so vital toa country that theirincapacitation or destructionwould have a debilitating effecton national security, theeconomy, public health andsafety. These, of course, includehealthcare, power and water, aswell as other key services such asinformation andcommunications technology and even the media.
Protecting the Gulf In the GCC region, the same
rules apply, making it just asvulnerable to natural and humanthreats. Here, the list obviouslyextends to strategic industriessuch as oil and gas,petrochemicals and maritimetransport sectors as well.Even away from these areas,
Dubai’s long list of constructionprojects, such as the venue forExpo 2020, new expressways,hotels, malls, highways and manyother individual projects onlyincreases the stakes, raising thenumber of critical infrastructuressteadily. This, in turn, heightensthe need to create strategicprotection plans and policies tomaintain them. The story ringstrue in other parts of the region.As a result, spending on this
area has gone up massively inrecent times, which is evidentfrom the UAE alone. It hasdoubled its spending onhomeland security fromUS$5.5bn (Dh20.1bn) to morethan US$10bn (Dh36.7bn),according to the annual USDepartment of Commerce’sInternational TradeAdministration report. Itsprogrammes now extend toborder and maritime patrols,customs checks in ports andairports, search and rescue

Cyber threats While the world received a wake-up call as to the impact ofphysical threats, especially withthe 9/11 World Trade Centerattacks in 2001, the importanceof cyber security is still only nowbecoming understood, such is thepace of online development.Cyber threats across the worldagainst governments, businessesand infrastructures are nowbelieved to be evolving at a fastpace, as evidenced by the recentmalware strikes. Protecting critical ICT
infrastructure and systems isimperative in the Gulf, with theUAE flagged among the top fivecountries globally that are targetsfor cyber criminals. To addressthese challenges, Gulf countries,together with global partners andindustry, are ramping up their ITsecurity efforts in a bid to tacklethe threat. But IT systems are not limited
to sole PC users at home, norclosed networks, but a vastinterconnected system linked bymachines and technology all overthe world. And, in the field, thesecontrol many of the processes
and systems that we now take forgranted in areas such ashealthcare, transport and energy.In this sense, operationaltechnology – marking theconvergence between IT andengineering – has become criticalto ensuring successful securitymanagement. Cyber securitytherefore protects the actualphysical assets and their smoothrunning on the ground, ratherthan simply the computerterminal in the office. This shift has put industry on
the front foot, with globalcorporations now among the newand unexpected champions ofcyber security, keen to roll out bestpractice to clients and users.Engineering giant Siemens, forinstance, which has a vast footprintacross the Gulf, recently teamed upwith the International Society ofAutomation to foster theawareness for industrial securityneeds and global standards."Cyber security needs to be
addressed by industrial companiesas recent global ransomware attackshave demonstrated the possibleimpacts,” said Henning Rudolf,global head of Siemens PlantSecurity Services. “Our customersneed to adequately manage theassociated cyber risk, arising fromthe vulnerabilities of IT technologycombined with the increasedconnectedness in our digital age.”
Oil and gas That clearly includes beefing upcyber security and industrystandards within the strategic oiland gas sector, the building blockfor the Gulf ’s modern day wealth.
Norwegian classification societyDNV GL recently launched aglobally applicable recommendedpractice, DNV GL-RP-G108,addressing how oil and gasoperators, together with systemintegrators and vendors, canmanage this emerging cyber threat.“Dealing with cyber security
challenges has become a keyfocus area for the oil and gassector, and there is greaterawareness of the requirementsthat need to be in place,” said PålBørre Kristoffersen, projectmanager at DNV GL – Oil & Gas.The more collaborative
approach is significant given thescale of the challenges faced, andthe ever increasing automation ofthe energy sector, like many otherbig industries. It is the result of anearly two-year-long jointindustry project with key energyand technology partners.
“Industry players needconfidence that securitycountermeasures can deal withmore frequent and sophisticatedcyber attacks, which arebecoming increasingly costly andharder for companies to recoverfrom,” he said. Kristoffersen said there has,
until now, been a lack ofguidance for the oil and gasindustry on how to implementthese requirements. The newrecommended practice, he says,puts operational technology -together with IT - in thelimelight, for better protection.Above all, it is intended toincrease the safety, availabilityand reliability of operationaltechnology systems. That’s a prerequisite if the

The ‘Claw’ is suitable for vertical access on cables with a diameterof 8mm and is worn by users as a guided type fall arrester as partof their personal fall protection equipment (PFPE), allowing themto connect their body harness to the site's permanently installedfall-arrest systems. The cable runner boasts features that enable simplified
application and reduce the risk of incorrect use, says the company.The fall arrester cannot be attached to the rope if it is held thewrong way round by the user. In order to prevent unintendedremoval, the cable runner can only be removed from the rope if theuser actively releases a locking mechanism.
