    ONEKAMA Elizabeth Weaver was

    hoping that her retirement from theMichigan Supreme Court would lead tomore tennis, golf and other summertimeactivities.

    But, most of that is on hold as theLeelanau County resident presses hercase that Michigans system for selectingSupreme Court justices is in critical need ofreform.

    Weaver, who retired in August of 2010,spoke at the Manistee County DemocraticPartys annual Don Jennings Award DinnerSaturday night at Portage Point Inn, andthen became the eighth recipient of theaward.

    Rick Schrock, chairperson of theManistee Democrats, opened the eveningsaying, Were gathered here because webelieve in justice. Don Jennings was aperson who fought battles for justice bothlocally and in Mississippi during the civilrights struggles of the 60s. Tonight wewill honor Justice Weaver with the DonJennings award for her strong stands forustice on our Michigan Supreme Court.

    19th Circuit Court Judge James Batzerfirst talked about Jennings as he introducedWeaver.

    Don utterly transformed the legal sys-tem in Manistee, Batzer said. He madethe legal system do what it was supposed todo. The legal system is an adversary systemand Manistee had a network of people who

    were quite comfortable and no one spokeup for the ordinary person.

    Well, Don did something about it,Batzer said. He took those peoplescases, took them to court, and fought forthem. Since he was willing to fight, he justutterly transformed the legal system here inManistee County and he made it work theway it is supposed to work.

    Of Justice Weaver Batzer said, Thisis a woman of real intellect, but heres theoutstanding thing about Justice Weaver.She has been a legal scholar of uncommoncommon sense among legal scholars, and

    she knows people, ordinary people, and sheis aware of the real world and how peoplehave to live in the real world.

    Shes served in excess of 36 years asa judge and judges throughout the Stateof Michigan know theyve had a friend inJustice Weaver.

    Its a bit unusual for a Democratic Partyto officially honor a Republican-nominatedSupreme Court justice, even if a retiredone, Weaver said. But Ive reasoned that

    you, the good grassroots Democrats ofManistee County, appreciate and desiretruly independent non-partisan SupremeCourt justices, and perhaps when youconsidered my service record, you thoughtmaybe I was one. So I very humbly accept

    your honor and I thank you very much.Weaver launched her discussion of the

    reform she believes needs to take place onthe Michigan Supreme Court.

    and confidence. Do we nowhave such a Supreme Court?From my almost 16 yearsexperience, I say no. Can weever have it? I believe yes, orI wouldnt be here tonight.

    She said such a courtwould require seven inde-

    pendent justices aboutwhom the people have suf-ficient information to holdeach accountable for his orher individual or collectiveperformance.

    An independent justiceis not agenda driven anddoes not hold to or pro-mote political party lines orphilosophies or ideologies.

    An independent justice isdedicated to the rule of law,is impartial and courageous,exercises judicial restraintand self discipline, appliescommon sense, and is wise,

    honest, fair, just, kind andcharitable, orderly, civiland professional. Open, notsecretive, and non-partisan.

    Weaver said the mostimportant element intransforming the MichiganSupreme Court is to elimi-nate the unnecessary secrecunder which the court nowoperates.

    Unnecessary secrecyis the crux of the problem.It allows to take root andgrow the worst propensitiesof human nature hatred,revenge, lust for power and
