New York Could Lose Millions in Wildlife Funds
New York governor’s budget proposes a raid on the NY conservation
funds.

Fairfax, VA--(Ammoland.com)- The New York Department of
Environmental Conservation (DEC) is facing the loss of up to $20
million from its share of federal Pittman-Robertson and Dingell-Johnson
funding as the result of a budget proposal that would allow New York’s
Department of Budget (DOB) to tap into the state’s conservation fund.
The Pittman-Robertson Wildlife Restoration and Dingell-Johnson Sport
Fish Restoration Acts levy an excise tax on the sale of firearms,
ammunition, archery equipment, fishing equipment, motorboat and
small engine fuels, and this money is returned to the states each year via
grants from the U.S. Fish and Wildlife Service (USFWS).
State fish and wildlife agencies in turn use these funds to manage fish
and wildlife populations, acquire and improve habitat, fund hunter
education, provide public hunting, fishing and boating access, and build
and maintain public shooting ranges, among others. Hunters and anglers
have contributed an astounding $13.7 billion in these excise taxes since
1937.
But in order to receive this valuable federal funding, which is allotted
based on a formula that accounts for a state’s land area and total number
of paid hunting and fishing license holders, states must agree not to
spend license money and other dedicated wildlife funding on purposes
outside of wildlife conservation. If they do, they risk losing their federal
apportionments.
Such is the case in New York. Gov. Andrew Cuomo’s 2011-2012 budget
allows the DOB to use money from the conservation fund to balance the
state’s budget, a proposal that has put the USFWS on notice.
“Even if the DOB has no intent on using conservation fund
money for other reasons than its intent, the fact that the
budget allows for them to do so is enough for the USFWS to
withhold P-R (Pittman-Robertson) and other funding,” DEC
Division of Fish, Wildlife and Marine Resources Assistant
Director Doug Stang said July 5 in the Register-Star. “The
conservation fund would be in deep trouble without it.”
New York originally had until July 15 to address concerns raised by the
USFWS about the diversion of wildlife funds, but the state was given a
30-day extension to amend its budget or risk losing the federal money.
“The Pittman-Robertson and Dingell-Johnson programs
provide crucial funding to manage the nation’s wildlife and
fisheries,” said Hannibal Bolton, Assistant Director of the
Wildlife and Sport Fish Restoration Program. “The Fish and
Wildlife Service closely monitors situations such as this one
in New York and stands ready to take the necessary action.”
For fiscal year 2011, New York was apportioned $9,133,327 in Dingell-
Johnson and $11,215,150 in Pittman-Robertson grant funding—for a
grand total of $20,348,477.
New York could now be in jeopardy of losing some or all of that money.
“This issue needs to get fixed and fixed faster than the federal
government wants to pull our funding,” said New York
Sportfishing Federation Director Bob Danielson. “In this
fiscal climate we need every dollar we can get.”
This isn’t the first time a state has proposed to divert wildlife funds.
Arizona, Connecticut, Illinois, Kansas, New Jersey and South Dakota
have all been guilty in the past of trying to use hunters’ dollars to boost
their bottom lines.
It’s also not the first time a New York governor has raided —or proposed
to raid— the conservation fund. Former Gov. Mario Cuomo, Andrew’s
father, raided the fund to the tune of $20 million in 1990, although $15
million was later returned.
Now, 21 years later, history stands to repeat itself, unless New York
rescinds the language in its budget that allows for conservation fund
dollars to be used for something other than their intended purpose.

Ducks Unlimited Receives $1.5 Million For Shiawassee

Ann Arbor, Mich. --(Ammoland.com)- A $1.5 million grant will make
an impressive impact on conservation in the Saginaw Bay region of
Michigan with the help of Ducks Unlimited.
DU has been awarded funds to restore emergent wetlands to 940 acres of
land currently in agricultural use at Shiawassee National Wildlife Refuge.
The $1.5 million grant was formally awarded by Sustain Our Great Lakes
at a ceremony that took place at Detroit River International Wildlife
Refuge in Trenton, Mich. on Friday. SOGL awarded the funds through
the Great Lakes Restoration Initiative, the federal program designed to
target the most significant problems in the Great Lakes ecosystem,
including habitat conservation, invasive aquatic species, non-point
source pollution and contaminated sediment.
The project lies within the Shiawassee Flats, a 40,000-acre floodplain
wetland complex formed by the confluence of the Bad, Cass, Flint,
Shiawassee, and Tittabawassee Rivers. The Flats include a diversity of
natural and managed wetlands that have historically been a critical
waterfowl and waterbird stopover area in the Great Lakes region. The
Flats also provide many additional ecological and societal benefits,
including habitat for other wetland-dependent fish and wildlife, flood
control and abatement, water quality improvement, and areas for
outdoor-based recreation and education.
This restoration has two important impacts. The restored wetlands will
provide a key connection between other restored wetlands and the
Shiawassee River, providing valuable habitat for fish, waterfowl, and
other wetland-dependant species. It will also improve water quality as it
moves downstream towards the Saginaw Bay.
Saginaw Bay Watershed Initiative Network and Dow Chemical Company
provided financial support. DU also received letters of support from
several sources including U.S. Fish and Wildlife Service, United States
Geological Survey, Michigan Department of Natural Resources, Saginaw
Bay WIN, and the Shiawassee Flats Citizens and Hunters Association.
The grant was awarded through the Sustain Our Great Lakes, whose
mission is to sustain, restore, and protect fish, wildlife, and habitat in the
Great Lakes basin by leveraging funding, building conservation capacity,
and focusing partners and resources toward key ecological issues.
“Restorations of this magnitude are difficult to come by not
only in the Saginaw Bay watershed, but anywhere in the
Great Lakes basin,” said Dane Cramer, regional biologist at
DU’s Great Lakes/Atlantic Regional Office. “This project will
make appreciable impacts to the thousands of waterfowl that
migrate through Saginaw Bay and the Shiawassee Flats area
every spring and autumn as well as important fish species
and other wetland denizens.”
With more than a million supporters, Ducks Unlimited is the world’s
largest and most effective wetland and waterfowl conservation
organization with more than 12 million acres conserved. The United
States alone has lost more than half of its original wetlands − nature’s
most productive ecosystem − and continues to lose more than 80,000
wetland acres each year.

NEWTOWN, Conn --(Ammoland.com)- The latest Firearms and
Ammunition Excise Tax Collection report released by the Department of
the Treasury indicates that firearm and ammunition manufacturers
reported tax liabilities of $110.1 million in the first calendar quarter of
2011, up 8.2 percent over the same period last year.
The report, which covers the time period of Jan. 1 through March 31,
shows that $37.12 million was due in taxes for pistols and revolvers,
$33.71 million for firearms (other)/ long guns and $39.27 million for
ammunition (shells and cartridges).
Compared to the same time period in 2010, tax obligations were up 18.5
percent for pistols and revolvers, up 7.19 percent for firearms (other)/
long guns and up 0.74 percent for ammunition (shells and cartridges).

As you may know, the federal Bureau of Alcohol, Tobacco, Firearms and
Explosives (ATF) has announced that it will begin requiring the
approximately 8,500 firearms retailers in the Southwest border states

(Texas, New Mexico, Arizona and California) to keep records of and
report to ATF sales made to the same individual – within a five (5)
business day period – of more than one semi-automatic rifle that accepts
a detachable magazine greater than .22 caliber (Multiple Sales Reporting
of Certain Semi-automatic Rifles).
ATF has stated it is imposing this requirement pursuant to its “demand
letter” authority under the Gun Control Act. This week, ATF began
sending “demand letters” to border state firearms retailers implementing
this new multiple sales record keeping and reporting requirement
effective August 14, 2011.
The National Shooting Sports Foundation (NSSF) – the trade
association for America’s firearms industry – will be filing a lawsuit
challenging the legal authority of the U.S. Department of Justice (DOJ)
and ATF under the Gun Control Act to impose this new multiple sales
reporting requirement. When Congress authorized the reporting of
multiple sales of handguns it could have required the same for the sale of
long guns, but it did not. ATF is clearly exceeding its lawful authority
under the Gun Control Act. Current ATF Acting Director Ken Melson
himself has previously questioned ATF’s legal authority to impose this
new requirement.
NSSF is looking for individual firearms retailers who have received an
ATF demand letter to join NSSF in its lawsuit against the DOJ and ATF.
NSSF continues to encourage all retailers, not just those along the
Southwest border, to continue to cooperate with ATF and report any
suspicious activity. However, our primary legal concern is that this is the
proverbial “slippery slope”. If ATF is allowed to require this record-
keeping and reporting requirement of law-abiding retailers in these four
states simply by sending a letter demanding the information, than there
is no record or report ATF cannot require of any licensee (manufacturer,
distributor or retailer), anywhere in the country. ATF would simply need
to send a “demand letter” to the licensee for the information it wishes.
Congress has not given ATF this much discretion; otherwise the
protections afforded licensees by Congress under the Gun Control Act, as
amended, would be rendered meaningless.
NSSF will be funding all legal fees and expenses associated with its
lawsuit. Retailers who choose to participate in the case will have no
financial obligation. We believe that having a cross-section of retailers
(e.g., dealers from different states, dealers located far from the border
– like northern California, dealers that sell modern sporting rifles,
dealers that do not sell modern sporting rifles, dealers that have
multiple locations, and mom-n-pop dealers) will strengthen the case.
NSSF continues to urge all retailers to report any suspicious activity to
law enforcement. As a representative of Guns Galore, LLC of Killeen,
Texas, whose actions helped prevent an attempted terrorist attack at Ft.
Hood, noted an “obligation to ensure the safety of our community.”

program manager for AcuSport Corporation, is the newest member of
the NSSF Range Advisory Committee.
His 30-year career began as a firearms and fishing tackle buyer for a
retail store and included later successfully founding an indoor range and
retail operation, all qualifying him perfectly for this advisory committee.
The committee is a guiding force in NSSF’s range-policy development
and -decision making, and as a committee member, VanderWoude will
assist NSSF members who are either researching the idea of opening a
range/retail store or looking for ways to improve their sales practices.
“Having been in 85 different ranges in the last 12 months, I

the Mini-14®, Redhawk®, GP100®, 77/22®, M77® MKII, and P85®.
Roy lost his battle with cancer in December 2010 and is greatly missed
by his friends at Ruger and across the industry. Recognizing his final
contribution to the firearms community with the “Rifle of the Year”
award is a fitting tribute to a great designer.

Dallas, TX - -(Ammoland.com)- Last week, when President Barack
Obama spoke to the National Council of La Raza, he said something that
should alarm every American.
He confessed that he’d like to “bypass Congress and change the laws” on
his own. He added, “Believe me; the idea of doing things on my own is
very tempting. I promise you.”
He doesn’t need to promise us. We believe him, because we’ve been
watching his rogue behavior since the moment he entered office.
Way back in February 2010, even The New York Times unveiled his
modus operandi, in its report “Obama Making Plans to Use Executive
Power.” It summarized, “With much of his legislative agenda stalled in
Congress, President Obama and his team are preparing an array of
actions using his executive power to advance energy, environmental,
fiscal and other domestic policy priorities. [read gun control]“
Obama’s unauthorized war in Libya was just one more wayward decision
in a long line of executive-power-run-amok choices, taken despite the
fact that top Pentagon lawyers considered his unilateral Libyan invasion
to be illegal “hostilities.” And according to congressional testimony, his
own lawyers in the Office of Legal Counsel were asked to soft-pedal their
views so as to curb any further violation allegations.
What alarms me is that these perversions of power are coming from not
only the highest office in the land but also Obama’s advisers and team
(including his lawyers). In his speech to the National Council of La Raza,
the president also explained that he was taking his cues from others: “I
know some people want me to bypass Congress and change the laws on
my own.”
Of course, Obama knew that to do so at the outset of the debt debates
would have ensured his political downfall. On the other hand, swooping
down in the last hour on Capitol Hill from 1600 Pennsylvania Ave. with
his Democratic majority in the Senate to save the economy from hopeless
partisan gridlock would surely put him on the front page of Savior Daily!
Speaking of the press, what’s equally tragic is that the Obama-mania
media are jumping on the executive-power runaway express. Just this
past Thursday, CNN’s website ran an article by Jack Balkin, a
constitutional law expert at Yale, titled “3 ways Obama could
bypass Congress.” (Do you think CNN would have extended the
same clemency from Congress to former President George W. Bush?)
As The New York Times reported at the beginning of last year, Obama’s
exploits to bypass Congress are intended to “advance energy,
environmental, fiscal and other domestic policy priorities.” We now can
add America’s border problems to those, as Obama also elaborated last
week that the temptation to bypass Congress includes “not just
immigration reform.” No wonder the crowd began to chant “Yes, we
can!” (Tragically, it seems that too many citizens want a Führer more
than they do a president.)
Do we really want a power-hungry rogue president who continually is
tempted to bypass Congress? Will we continue to allow unilateral power
to our president to follow his own political whims and desires? Do we
want a supreme leader who constantly seeks ways to justify dodging our
bicameral government — the very checks and balances of our republic?
When he avoids Congress, is he not also trampling on the Constitution
and its mandates for separation of powers and teamwork among our
three branches of government?
Has the president forgotten his oath of office, “I do solemnly swear that
I will faithfully execute the office of president of the United States and
will, to the best of my ability, preserve, protect and defend the
Constitution of the United States”?
Mr. President, I strongly suggest you meditate upon the legal genius of
Joseph Story, a justice of the U.S. Supreme Court from 1811 to 1845
(appointed by President James Madison). Justice Story wrote: “The
duty imposed upon (the president) to take care, that the laws be
faithfully executed, follows out the strong injunctions of his oath of
office, that he will ‘preserve, protect, and defend the Constitution.’ The
great object of the executive department is to accomplish this purpose.”
Wow, how Justice Story’s words fly in the face of President Obama’s
thoughts about bypassing Congress.
No wonder Thomas Jefferson passionately proclaimed: “I
wish it were possible to obtain a single amendment to our
Constitution … taking from the federal government the power
of borrowing.”
God, lead Obama not into doing-things-on-his-own temptation.

WASHINGTON, D.C. --(Ammoland.com)- U.S. Sen. Jim Inhofe (R-
Okla.), a senior member of the Senate Armed Services Committee
(SASC), successfully added an amendment to the committee-passed
National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2012,
making fired small arms cartridges available for commercial sale with
certain restrictions.
It also requires the U.S. Secretary of Defense to ensure compliance with
managing commercial sale of spent ammunition.
“My amendment provides a unique opportunity for the
commercial sale of spent small arms cartridges,” said Inhofe.
“This is beneficial from a cost saving standpoint. Having
worked on this issue for some time, I am pleased to have
made this progress. Those that care about Second
Amendment Rights have put much effort into this as well.”
NRA-ILA Executive Director Chris W. Cox said, “It is
common sense that serviceable and safe military spent brass
cases are made available for commercial sale as military-
sourced spent brass cases are of the calibers most widely used
for marksmanship training and competition by civilians.”

MADISON, WI --(Ammoland.com)- The first year of an online site
developed to collect reports of black bear and bobcat sightings from
citizens produced more than 800 reports.
This information has been valuable in documenting presence and range
expansion for both species, according to wildlife biologists.
“Given that black bears are common in the northern third of
Wisconsin, we are taking a special interest in sightings within
areas designated as ‘occasional’ or ‘rare’ on the distribution
map,” said Brian Dhuey wildlife surveys researcher with the
Wisconsin Department of Natural Resources. Black bear
population and distribution in Wisconsin information is
available on the DNR website.
Black bears have been reported in 51 of Wisconsin’s 72 counties in 2011
via the online reporting site. Of those 51 counties, 23 lie in the rare or
occasionally sighted areas on the black bear distribution map.
“Many times these southern bears are young males that are
dispersing after being emancipated from their mothers,” said
Linda Olver, DNR bear biologist. “However, we have also had
reports of sows with young in both Iowa and Sauk counties.”
Of the 550 black bear observations reported so far this year, 76 percent
were lone bears. Only 24 percent of observations reported multiple
bears; typically these groups are sow with cubs, sow with yearling, or
multiple yearling bears seen together. Of the total observations, 81
percent occurred in April, May, or June.
In addition to location information, observers are asked about the
observation site habitat. Most black bears are reported along
roads/roadsides or in residential areas.
Play It Safe
Black bears are powerful wild animals. They can move with astonishing
speed and should be treated with caution and respect. But wildlife
officials say attacks by black bears on humans are very rare.
Olver has the following advice for people who may encounter
a bear: “If a bear is near your home, wave your arms and
make noise to scare the bear away from a safe position. If you
find yourself unexpectedly close to a bear, back away slowly,
do not turn and run. Go inside or take refuge in a vehicle and
wait for the bear to leave. In most cases bears are attracted to
homes because of easily available food found in bird feeders,
pet dishes and garbage cans. If the bear has found food one or
more times, it will likely return. When food is no longer
available, the visits will likely stop.”
Bobcat
More than 300 bobcats have been reported via the online reporting site
by 170 individuals. Unlike black bears, bobcats are to be reported
statewide. Bobcats have been reported in 56 of 72 counties (pdf). Only 8
percent of observations report sightings of multiple bobcats. Bobcats
were observed in upland forests (30 percent of observations) followed by
roads/roadsides (15 percent of observations) most frequently.
Trail cameras — often placed in the woods as scouting tools or as a
hobby – accounted for 47 percent of bobcat observations. These
photographs are especially valuable for documenting bobcats as they are
secretive animals and tracking their distribution is often difficult. Photos
of bobcats or black bears can be sent to wildlife management directly
from the reporting form. All photos can be viewed on the department’s
trail camera gallery.
People can continue to report bobcat sightings statewide and black bear
sighting in the southern one-third of Wisconsin. These reports are
adding to biologists’ knowledge of where these animals are calling home
in Wisconsin.

MISSOULA, Mont. --(Ammoland.com)- Improving elk habitat and
introducing thousands of students to traditional outdoor recreation and
conservation are the main themes in a list of 2011 grants for
Pennsylvania from the Rocky Mountain Elk Foundation.
All together, the new RMEF grants total $68,694 and affect Armstrong,
Bedford, Blair, Cameron, Centre, Clarion, Clearfield, Clinton, Dauphin,
Elk, Erie, Fayette, Lehigh, Lycoming, McKean, Mercer, Montgomery,
Potter, Sullivan, Washington and Westmoreland counties, plus
Philadelphia.
Three additional projects have statewide interest.
“This year, our grants will cover the costs of seed, fertilizer,
herbicide–as well as lime and a paper-mill byproduct used to
improve soil conditions–to enhance forage for elk and other
wildlife,” said David Allen, RMEF president and CEO.
“We’re pleased to support the Pennsylvania Game
Commission and Pennsylvania Department of Natural
Resources in this important work.”
Allen said about 2,100 acres of habitat will be enhanced via 2011 grants
in Pennsylvania.
Nationally, RMEF hopes to impact about 100,000 acres in 2011 to reach
the 6 million-acre lifetime mark in lands conserved or enhanced for elk
and other wildlife.
Allen thanked RMEF volunteers and fundraiser attendees for
building the organization’s conservation impact in
Pennsylvania and across elk country, saying, “Because of
their amazing passion and generous support, we’re doing
some great things locally and a national conservation
milestone is within reach.”
RMEF grants will help fund the following 2011 projects:
• Armstrong County–Provide sponsorship for Armstrong County
Sportsmen and Conservation League 2011 Youth Field Day to
introduce students to traditional outdoor recreation and
conservation.
• Bedford County–Provide sponsorship for Everett Sportsmen
Junior Rifle Club 2011 to introduce students to traditional outdoor
recreation and conservation.
• Blair County–Provide sponsorship for Keystone Sportsmen for
Youth 2011 Field Day to introduce students to traditional outdoor
recreation and conservation.
• Cameron County–Maintain and refurbish state game lands to
improve 2,050 acres of habitat for elk, deer, turkey, grouse and
other wildlife. Projects include lime, fertilizer and herbicide
applications, seeding and mowing (also affects Centre, Clearfield,
Clinton and Elk counties).
• Clarion County–Provide sponsorship for Clarion County 2011
Youth Field Day to introduce students to traditional outdoor
recreation and conservation.
• Dauphin County–Provide sponsorship for Capital Area Sportsmen
for Youth 2011 Field Day to introduce students to traditional
outdoor recreation and conservation.
• Elk County–Refurbish 50 acres of forage openings to improve
grazing conditions for elk and other wildlife on State Game Lands
#311. Project involves application of a byproduct (biosolids) from
Domtar-Johnsonburg Paper Mill to improve soil pH (also affects
McKean County); provide sponsorship for Elk County 2011 Youth
Field Day to introduce students to traditional outdoor recreation
and conservation.

Conservation projects are selected for grants using science-based criteria
and a committee of RMEF volunteers and staff along with
representatives from partnering agencies and universities. RMEF staff
and volunteers select education projects to receive grants.
Partners for 2011 projects in Pennsylvania include Pennsylvania Dept. of
Conservation and Natural Resources, Pennsylvania Game Commission,
numerous sportsmen and gun clubs, schools, businesses and many
organizations.
Since 1985, RMEF and its partners have completed 242 different
conservation and education projects in Pennsylvania with a combined
value of more than $20.5 million.

Arrasmith Conservation Award by the Inland Northwest Wildlife Counci
The Inland Empire Chapter out of Spokane was awarded MDF’s Sweat
Equity Award last year for donating almost 500 hours of labor. This
chapter was also awarded the Arrasmith Conservation Award by the
Inland Northwest Wildlife Council (INWC). The INWC is the oldest and
largest local non-profit wildlife conservation group in Washington. The
Arrasmith Award is presented to organizations that have made a
significant contribution to the enhancement of wildlife and habitat.
The Mule Deer Foundation has a long history in Washington. Two
chapters, the Yakima Chapter and the Skagit Valley Chapter in Mt.
Vernon, have been in existence for over 15 years. Three more chapters, in
Wenatchee, Winthrop and Spokane, have been raising money and
working to improve local habitat for over a decade.

Honored American Veterans Afield
Longmeadow, MA --(Ammoland.com)- Honored American Veterans
Afield (HAVA) and FMG Publications sponsored two American Heroes
from Ft. Campbell at the annual Shooting Industry Masters event in Park
City, KY on July 22-23, 2011.
These disabled soldiers were greeted with a 2-minute standing ovation
by over 350 participants from the shooting industry who understand
how their service and sacrifice exemplifies the commitment to freedom
that America’s military personnel show every day.
These soldiers represented the hundreds of veterans that HAVA serves
each year and exhibited the joy that HAVA activities brings to these
American heroes as they begin to rebuild their lives after their service
and considerable personal sacrifice.
Representing the Army on the HAVA team was SSG David Jacks, a 22-
year veteran of 4 combat tours including Desert Storm in 1991 and
Baghdad in 2005 who has won a Purple Heart and the Army Medal for

your rock lately and peaked out to take a look at our favorite industry,
we’re right in the real heat of COMPETITION SEASON!!
So, if you are of a competitive nature – or just love to shoot – or just
want to watch and hang out with a gang of like-minded folks, check out
what is going on in your favorite shooting sport.
As I’ve said several times before in these opening comments, I’m a
faithful reader of Jim Shepards’s daily emails, The Shooting Wire and
The Outdoor Wire in which he lists a whole lot of places you can go
shoot and compete. This is always the first place I go to check out what is
coming up around the country. Frankly, I’m always amazed at the sheer
number of competitive events that are listed in the two newsletters.
There are also lots of other places to look. Many of the major shooting
sports have a magazine written specifically for that venue, or you’ll find
that one of the major “gun” magazines may have large sections devoted
to a specific shooting venue. I frequently go on Google when I’m looking
for info, and find just about anything. So when in doubt you can always
search Google for shooting competitions to attend. For instance, I put in
“3-gun matches” (be sure to put in quotes or you’ll get everything from
nail guns to kitchen matches) and got about 295,000 results (in 0.25
seconds). WOW – that’s lots of results – and lots of events to check out.
Try it on your favorite shooting sport – I know you’ll be as amazed as
was I.
Then, there are all the popular TV channels and programs that you can
take a look at to see how your particular favorite competition is going.
The “Sportsman Channel” is a major carrier of all kinds of competition
coverage . Others include “Versus“, the “Outdoor Channel” – the
chocked-full Wednesday night block plus 3-Gun Nation and various
hunting shows; the “Discovery Channel” − Sons of Guns − about a gun
shop that builds weird stuff; the “History Channel” − Top Shot –
reality/competition w/guns; plus all the hunting shows that pop up on
“ESPN”. There are also many regional cable systems that feature local
hunting and gun shows, plus the local news shows, and even some “PBS”
stations run hunting shows. Keep your eye out for your favorite venue.
There will be something about it out there somewhere.
Whatever competition you are shooting, besides the gear specific to that
type of shooting, we recommend some core tools/gear for your range
