The object of this book is to aid the legal profession when called upon to advise in the planning, preparation and contest of wills. It is prepared with special reference to

(I) Planning a will suitable to the testator's wishes, family and estate;

(2) Preparing a will that shall if possible accomplish the testa- tor's purpose without dispute and be capable of with- standing legal assaults;

(3) Determining when and by whom the probate of a will may be successfully contested.

The theory of this work is that a well planned and properly pre- pared will besides being a credit to the profession, is a safeguard to the estate of the testator and the happiness of his family, and that when a contest of a will is begun it should be entered upon advisedly. In these respects, it is often quite as difficult, as it is important, to properly ad- vise clients because of the fact that most works on the subject of wills view testamentary questions from the usual post mortem standpoint, when it is too late to correct any defects which may be discovered. The point of view here taken is ante-martem; that is, at a time when mistakes may be avoided, or if already made may be corrected-a point at which the most satisfactory and valuable professional services can be rendered. In other words, the plan here pursued is synthetic and pre- ventive rather than analytical and remedial.

The plans of and extracts from 78 important wills, prepared by the most eminent legal talent, constitute a valuable body of prece- dents and form Part II of the book. The wills represented are such as the Armour, Astors, Belmont, Browns (of Providence), Crockers, Evarts, Field, Goelets, Leiter, Minots, Rhodes, Sage, Stanfords, Thaw, Tiffany, Vanderbilts, Whitney, etc.

The charts contained in the boo.- it is believed will be very help- ful in the solution of difficult questions where estates or interests in property and their vesting are under consideration.

The author is an active practitioner of many years experience at the New York Bar and an expert in testamentary law. For many years he has made a special study of the subjects of the present work and a critical examination of the most important wills in this country. Much of the matter for this volume has been accumulated by him in his prac- tice during this time.
