Work began on thelocal buscompany’s largedepot on Conway

Street near Hove Station in1939. The style ofarchitecture is unmistakableand has many similaritieswith the King Alfred and 4Grand Avenue which wereboth completed that sameyear.

A monolithic appearancewith acres of dark brick and aparticular attention tosymmetry characterise thebuildings of the day. Thedepot took a year to buildand includes offices,workshops and storageareas. There was originally acoachworks on the site butthis was closed down in 1969.

Conway Street itself wasdeveloped from the 1870sand there were certainlystables there already when anumber of local horse buscompanies combined in 1884to become Brighton, Hove &District United OmnibusCompany (not quite as catchyas Brighton & Hove Bus andCoach Company). Pubs,barracks, laundries,blacksmiths and stablescreated quite an odour andlead to complaints about smells. The walkdown the steps from Goldstone Villas wascompared to a descent into hell.

Being huge, fairly undeveloped and neara station, the depot is a propertydeveloper’s dream or, in the case of AndyLambor, a nightmare. Andy spent yearsbuilding up a portfolio in the area that,when combined with the bus depot andseveral other key plots, could have been thebiggest scheme in the city for a number ofyears. Towers, a cinema, employment spaceand homes were proposed. It was sadly notto be. The upside is that the bus company isstaying in Hove and huge investment is nowtaking place.

My recent tour, given by the company’s Business DevelopmentManager, Patrick Warner, was something of an eye-opener in that I sawseveral of the hidden areas that most will never get to see. The mostinteresting area was the pits below ground where mechanics can workbelow the buses. It was a job at Huet Car Audio in Hove that brought medown from London all those years ago. Seeing layers of Snap-on tools(the best) in glorious red cabinets did bring back memories – and,indeed, serve as a reminder that these guys take serious pride in theirwork. Another fascinating spot is the control room which shows thelocations of every moving bus in the city.

On that Friday afternoon, with a crash on the A27 and the start of half-term, ‘chaotic’ was something of an understatement.

I see ‘Without Prejudice’ and‘Without Prejudice save as tocosts’ on some letters and not onothers I receive in respect of myEmployment Tribunal case. Whatdoes it mean and do I need to putit on letters too?

‘Without Prejudice’ is a phraseused in settlement negotiationsthat basically means ‘off therecord’. What it means is that theletter, about a settlement, cannotbe shown to the EmploymentTribunal during the hearing. So anemployer can propose on a‘Without Prejudice’ basis that it isprepared to pay £5,000 in returnfor the claimant withdrawing theclaim. The claimant cannot thensay to the Tribunal: “look, youmust find in my favour becausethe employer was prepared tooffer me £5000, so my version ofevents must be correct”.

So whether stated to be ‘WithoutPrejudice’ or not, a genuineattempt to settle a dispute will notbe put before the Tribunal asevidence of an admission made bythat party.

The rationale for the rule is thepublic policy of encouraging partiesto settle their disputes out of court.The idea is that the parties canspeak freely during settlementnegotiations without the fear thatwhat they have said will be usedagainst them at the hearing. It ishoped that this will enable them toput their cards on the table and thiswill lead to a settlement.

‘Without Prejudice save as tocosts’ is used when one party wantsto make a without prejudicesettlement offer, but reserves theright to show the letter to theTribunal at the end of the hearing,when it makes an application forcosts. The argument will be that
